Applicant seeks a special permit pursuant to CH 139 Q) 16 C (2) to validate an unintentional set-
back intrusion of 1.5 feet into the front yard set-back requirement at 18 Rabbit Run Road. The
required front yard set-back is 35 feet and a corner of the porch is located 33.5 feet from the
front lot line.
Applicant also seeks a modification of special permit 2007-07 seeking to validate the ground
cover of the structure as-built. The modification would be to allow the ground cover of the
structure to be increased by 25 square feet from 2,346 square feet to 2,381 square feet. There is
25 square feet of second floor living space above a porch which was inadvertently not counted
as ground when the surveyor staked out the~building.
