At a public hearing of the Nantucket Zoning Board of Appeals, on Thursday, October 13, 2011, at 1:00 P.M., at 4 Fairgrounds Road, Nantucket, Massachusetts, the Board made the following decision on the application of J. RODERICK PEACOCK AND MARIA PEACOCK, c/o Sara F. Alger, P.C., 2 South Water Street, Nantucket, MA 02554, File No. 068 -11: 2. Applicants are requesting Special Permit relief pursuant to Nantucket Zoning Bylaw Section 139- 16.C.(2) in order to validate the unintentional setback intrusion of about five (5) inches into the required five (5) foot side yard setback. In the alternative, the Applicants are requesting Variance relief pursuant to Nantucket Zoning Bylaw Section 139 -32 from the intensity regulations in Section 139 -16 (intensity regulations - setbacks) to validate the intrusion. The Locus is situated at 26 King Street, Siasconset, is shown on Nantucket Tax Assessor's Map 73.4.2 as Parcel 111, is shown as Lot 1, Plan File 49 -K, and is recorded at the Nantucket County Registry of Deeds in Book 518, Page 131. The property is zoned `Sconset Residential - 1. 3. Our decision is based upon the application and accompanying materials, and representations and testimony received at our public hearing. There was no Planning Board recommendation, on the basis that no matters of planning concern were presented. There were no comments either in favor of or in opposition to the application. 1 4. Attorney Sarah Alger represented the Applicants. Ms. Alger explained to the Board that the Applicants are requesting Special Permit relief pursuant to Nantucket Zoning Bylaw Section 139- 16.C.(2) in order to validate the unintentional setback intrusion of about five (5) inches into the required five (5) foot side yard setback area. Attorney Alger informed the Board that the work was applied for in 2007 (building permit No. 035 -07) and it has recently brought to the Applicant's attention that such an error occurred. Therefore, they Applicants are requesting the Board of Appeals grant a Special Permit to validate this unintentional setback intrusion. 5. Therefore, after a discussion with the Attorney for the Applicants, the Board finds that such a Special Permit may be granted to approve unintentional setback intrusion of five (5) inches into the required five (5) foot side yard setback on the basis that the burden of correcting the intrusion substantially outweighs any benefit to any abutter of eliminating said intrusion. The Board came to this finding because of the absence of abutter comment and because the intrusion is de minimis (i.e., about five inches). 6. Accordingly, by a unanimous vote of the sitting Board, the Board of Appeals made the finding that the burden of correcting the unintentional setback intrusion substantially outweighs any benefit to any abutter of eliminating said intrusion and therefore allowed the intrusion to exist as shown on the plan entitled "As -Built Plot Plan, 26 King Street in Nantucket, Massachusetts," prepared by Nantucket Surveyors, Inc., dated September 12, 2011, attached hereto as "Exhibit A."
