O'Mara, Dale Waine, Kerim Koseatac, Lisa Botticelli, ~ k Poor, and Susan McCarthy. Members absent: Michael Angelastro Staff: John Brescher Call to Order: Chairman Toole called the meeting to order at 1:03 PM. II. Approval of the Agenda: A motion was made (O'Mara) and duly seconded to approve the agenda as written. The vote was 5-0 in favor. III. Approval of the Minutes: A motion was made (O'Mara) and duly seconded to approve the minutes of the July 14, 2011 ZBA meeting. The vote was 5-0 in favor. IV. Other Business: ^ Approval of FY 2011 Annual Town Report: The Board requested to have another month to review the Annual Town Report. ^ Minor Modification - 15 Quidnet Road: Attorney Sarah Alger explained to the Board that there was a typographical error on the decision from 1999. Specifically this error transposed "Lot 3" and "Lot 4" and asked to have the decision corrected. The Board determined that this type of relief could be considered a minor modification and a motion was made (Botticelli) and duly seconded to approve the requested relief. The vote was 5-0 in favor. Continued to October 13, 2011 041-11 Middle C, LLC 56 Centre Street Fitzgerald Action Deadline September 12, 2011. Attorney Julie Fitzgerald, Melissa Philbrick, and Rachel Hobart represented the Applicants. Attorney Fitzgerald explained that the Applicants are a protected use under MGL Ch.40A, Section 3 as an educational facility. Furthermore, there is no change to the square footage and no loading zone proposed to the site. Ms. Philbrick showed the Board the plans of the changes between the first application and the application before the Board now. Ms. Philbrick also explained that the Applicants would like to lease the property to Nantucket Community Music Center (NCMC) and the Nantucket Community School. Ms. Philbrick also explained to the Board that there had been a meeting between the Applicants and the abutters. While not all the concerns were addressed, the Applicant revised their plan by scaling back the scope of the project, examining various access scenarios, and attempted to determine how to alleviate the bad parking behavior in the neighborhood. Some of the suggestions to alleviate the traffic problems were traffic passes, encourage the use of the shuttle, carpool, and coordinate and overlap schedules and trips to minimize the number of vehicles needing to park downtown. Ms. Philbrick also explained that the existing kitchen is ancillary and that the Applicants would not sub-lease for private events. Ms. Philbrick read the conditions she had proposed and had given the Board ahead of time into the record. Kerim Koseatac asked what Middle C, LLC actually is and whether or not it is a non- profit. Ms. Philbrick explained that while they are not anon-profit, so long as they lease to non- profits, they are eligible for the Chapter 40A, Section 3 exemption. At 1:43, Chairman Waine called a recess. At this point, Board member O'Mara left the hearing due to illness. Chairman Waine asked the Applicants if they would like to continue with four Board members and the Applicants declined and instead requested the matter be continued to a date certain. A motion was made (Koseatac) and duly seconded to continue the matter to August 18~ at 1:00. The vote was 4-0 in favor. ^ 044-11 Lindsay 8 Tawpoot Wilson Action Deadline October 12, 2011. The Applicant requested the matter be continued to the September 8~ meeting. VI. New Business ^ 049-11 Lemberg 53 Pochick Avenue Glidden Action Deadline November 9, 2011. Attorney Richard Glidden represented the Applicant. Attorney Glidden explained that the applicant is requesting a Special Permit in order to increase the lot area of their undersized lot. Said increase will not make the lot conforming, but it will make it less nonconforming. A motion was made (Botticelli) and duly seconded to approve the requested relief. The vote was 5-0 in favor. Attorney Steven Cohen represented the Applicant. Attorney Cohen explained to the Board that the applicant is requesting Special Permit relief in order to alter a preexisting nonconforming structure without increasing the nonconforming nature of the structure by not being any closer to the setback than the existing structure. A motion was made (Waine) and duly seconded to approve the requested relief. The vote was 5-0 in favor.
