Zoning By -Law per Ch. 139 § 33A (3)(a), that the proposed reconstruction, extension or
structural change to the pre- existing, nonconforming single family dwelling does not

Fairgrounds Road, Nantucket, Massachusetts, the Board made the
following decision on the application of MATTHEW SANFORD AND
CECIL LYON SANFORD, c/o Butters Brazilian, LLP, 1 Exeter Plaza,
Boston, MA 02116, File No. 051 -11:
2. Applicant is requesting Special Permit relief pursuant
to Nantucket Zoning Bylaw Section 139- 33.A.(3)(a) and (4)
(alteration of preexisting nonconforming structure) in order to
alter the pre- existing nonconforming single family dwelling.
The proposed alteration will not increase the nonconforming
nature of the structure. The structure is nonconforming as to
side yard setback, having a side yard setback of 2.4 feet in a
zoning district that requires a five (5) foot side yard setback.
In the alternative, the Applicant is requesting Variance relief
pursuant to Nantucket Zoning Bylaw Section 139 -32 (variances)
from the intensity regulations in Section 139 -16 (intensity
regulations - setbacks) in order to complete the work requested.
The Locus and structures thereon are otherwise conforming to the
intensity regulations of the Residential Old Historic zoning
district. The Locus is situated at 15 Pleasant Street, is shown
on Nantucket Tax Assessor's Map 42.3.3 as Parcel 125, is shown
in Plan Book 13, Page 7, and is recorded at the Nantucket County
Registry of Deeds in Book 1236, Page 1. The property is zoned
Residential Old Historic.

3. Our decision is based upon the application and
accompanying materials, and representations and testimony
received at our public hearing. There was no Planning Board
recommendation, on the basis that no matters of planning concern
were presented. There were no comments either in favor of or in
opposition to the application.
4. Attorney John Brazilian represented the Applicant.
Attorney Brazilian explained to the Board that Applicant is
requesting Special Permit relief pursuant to Nantucket Zoning
Bylaw Section 139- 33.A.(3)(a) and (4) (alteration of preexisting
nonconforming structures) in order to alter the preexisting
nonconforming single- family dwelling without increasing the
nonconforming nature of the structure.
Attorney Brazilian stated that the existing structure is
nonconforming as to side yard setback, having a side yard
setback of 2.4 feet in a zoning district that requires a five
(5) foot side yard setback. The proposed alteration, which is
to the rear of the structure and is a proposed 459 square foot
addition as shown on the attached "Exhibit A," will not encroach
any further into the setback than the existing side yard setback
encroachment and will be done entirely outside the side yard
setback.
Attorney Brazilian stated that alternative, the Applicant is
requesting Variance relief pursuant to Nantucket Zoning Bylaw
Section 139 -32 (variances) from the intensity regulations in
Section 139 -16 (intensity regulations - setbacks) in order to
complete the work requested.
5. Therefore, after a discussion with counsel for the
Applicant, the Board finds that such a Special Permit may be
granted to approve the alteration of the preexisting
nonconforming structure as the alteration will not intrude into
the setback any further than what presently exists and that this
type of alteration would not be substantially more detrimental
to the neighborhood than the existing nonconformity on the
Locus.
6. Accordingly, by a unanimous vote of the sitting Board,
the Board of Appeals made the finding that the proposed
alteration to the preexisting nonconforming structure would not
be substantially more detrimental to the neighborhood than the
existing nonconformity and allowed the proposed alteration to
the structure to be done in substantial conformity with the plan

entitled "The Sanford Residence, 15 Pleasant Street, Nantucket,
MA 02554," prepared by Milton Rowland & Associates, dated July
13, 2011, attached hereto as "Exhibit A," with the following
conditions:
a. There shall be no exterior construction between May
15th and September 15th of any year;
b. The proposed addition shall be 459 square feet as
referenced on the attached "Exhibit A "; and,
c. All work shall be done outside of the setbacks on the
Locus.

TECHNICAL AMENDMENT:
1. At a public hearing of the Nantucket Zoning Board of
Appeals, on Thursday, January 12, 2012, at 1:00 P.M., at 4
Fairgrounds Road, Nantucket, Massachusetts, the Board made the
following decision on the application of MATTHEW SANFORD AND
CECIL LYON SANFORD, C/O Butters Brazilian, LLP, 1 Exeter Plaza,
Boston, MA 02116, File No. 051 -11:
2. The Applicant is requesting the Board amend the existing
ZBA decision (ZBA Decision No. 051 -11) in order to substitute
the revised site plan after said plans were modified at the
Historic District Commission ( "HDC ") . The original approved
plan had a total of 459 square feet of ground cover added to the
existing structure which was comprised of the porch which was
glassed in (235 square feet) and the addition of the rear ell
(224 square feet). Under the modified plan, the glass has been
eliminated from the porch and the rear ell has 441 square feet
of added ground cover as opposed to the previous 224 square
feet, as shown on the revised plan.
3. Accordingly, the Board of Appeals, by unanimous vote of the
sitting members, found that the proposed alteration is a
technical amendment and voted to amend the decision as follows:
a. There shall be no exterior construction between May
15th and September 15th of any year;
b. The proposed addition shall be 441 square feet and
all work shall be done in substantial conformance as
shown on the attached "Exhibit A "; and,

c. All work shall be done outside of the setbacks on the
Locus.
