At a public hearing of the Nantucket Zoning Board of Appeals, on Thursday, August 11, 2011, at 1:00 P.M., at 4 Fairgrounds Road, Nantucket, Massachusetts, the Board made the following decision on the application of EUGENE D. ATKINSON and CAROL ATKINSON, C/O SARAH F. ALGER, P.C., 2 SOUTH WATER STREET, NANTUCKET, MA 02554, File No. 094-99: 2. The Applicant is requesting a minor modification to ZBA Decision No. 094-99. It was noted that in paragraph 6 of the decision, there was a typographical error that switched "Lot 3" for "Lot 4." In the body of the decision, the Applicant is proposing to convey Lot 3 on the 55-5 plan to an abutter and to retain Lot 4 on the 55-5 plan. However, in paragraph 6 it is noted that Lot 4 is being conveyed and Lot 3 is being retained. Further, the decision should be modified to refer to the "lots" as "parcels" because on Plan File 55-5, the lots are referred to as "parcels." Therefore, the Applicant is requesting that the Board modify the decision so that paragraph 6 of the decision reflects that Parcel 3 is being conveyed and Parcel 4 is being retained. 3. Accordingly, the Board of Appeals, by unanimous vote of the sitting members, found that the proposed alteration is a minor modification and voted to modify the decision so that paragraph 6 of the decision reflects that Parcel 3 is being conveyed and Parcel 4 is being retained.
