Addendum
The Applicant seeks a Special Permit pursuant to Nantucket
Zoning By-law (the "By-law") X139-33.A(4) to alter a structure
that is pre-existing nonconforming as to height by relocating a
portion of the structure on the lot in such a way that it meets
all setback requirements but continues to be nonconforming as to
height and__by adding _dormers that _are__partially above thirty
feet (30'). The existing structure has a height of about
thirty-four feet (34'), and the proposed structure will have a
height of about thirty-three and one-half feet (33.5'). The
structure as so relocated will otherwise meet all dimensional
requirements of the By-Law.
The Locus is located at One Kimball Avenue, Assessor's Map 30,
Parcel 33, and is zoned R-20.

2. Applicant is requesting Special Permit relief pursuant
to Nantucket Zoning Bylaw Section 139-33.A.(4) (alteration of
preexisting nonconforming structures) in order to alter a
structure that is preexisting nonconforming as to height by
relocating a portion of the structure on the lot in such a way
that it meets all setback requirements, but continues to be
nonconforming as to height and by adding dormers that are
partially above thirty (30) feet. The existing structure has a
height of about thirty-four (34) feet and the proposed structure
will have a height of about thirty-three and one-half (33.5)
feet. The structure, as so relocated, will otherwise meet all
dimensional requirements of the bylaw. The Locus is situated at
1 Kimball Avenue, is shown on Nantucket Tax Assessor's Map 30 as
Parcel 33, is shown on Land Court Plan No. 9009-H as Lot 15, and
is registered as Certificate of Title No. 23,766 in the
Nantucket County Registry of the Land Court. The property is
zoned Residential - 20.
3. Our decision is based upon the application and
accompanying materials, and representations and testimony
received at our public hearing. There was no Planning Board
recommendation, on the basis that no matter of planning concern

was presented. There was a letter on file with the Zoning Board
of Appeals requesting more information for said application.
4. Attorney Sarah Alger represented the Applicant at the
hearing. Attorney Alger explained that the Applicant is
requesting Special Permit relief pursuant to Nantucket Zoning
Bylaw Section 139-33.A.(4) in order to alter a structure that is
preexisting nonconforming as to height by relocating a portion
of the structure on the lot in such a way that it meets all
setback requirements, but continues to be nonconforming as to
height. A small portion of the southeast corner of the
property, not at issue here, is located in a Residential-1
zoning district.
5. Further, the Applicant proposes to add dormers that
are partially above thirty (30) feet. Said dormers will be
located to the northerly and southerly sides of the structure
and in the process of their construction all or a portion of the
roof of the existing structure may need to be removed and
rebuilt.
The existing structure has a height of about thirty-four (34)
feet, and the proposed structure will have a height of about
thirty-three and one-half (33.5) feet. The structure, as so
located, will otherwise meet all dimensional requirements of the
Bylaw. The existing structure is nonconforming as to side yard
setback having a setback on the west of about 3.51 feet, where
10 feet is required, but such nonconformity will be cured by the
relocation of the structure.
6. Accordingly, the Board of Appeals, by unanimous vote
of the sitting members, found that the proposed alteration to
relocate the structure, nonconforming as to height, to a
conforming location on the lot and to rebuild the roof and
construct dormers on the northerly and southerly sides of the
structure having a height of about 33.5 feet will not be
substantially more detrimental to the neighborhood than the
existing nonconformity. Therefore, the Board granted relief
with the following conditions:
a. There shall be no exterior construction between June 15th
and September 15th of any year;
b. All work shall be done in substantial compliance with
the site plan entitled, "Proposed Conditions Site Plan to
Accompany Zoning Board of Appeals Application," prepared
by Blackwell & Associates, Inc., dated June 8, 2011, and

attached hereto as ~~Exhibit A," as the same may be
modified by the Nantucket Historic District Commission
and the Nantucket Conservation Commission; and,
c. To the extent feasible, the Applicant shall protect the
neighboring sidelines during the construction process.
