TO THE NANTUCKET ISLAND RESORTS LLC
APPLICATION FOR VARIANCE
Nantucket Island Resorts LLC (hereinafter "Applicant") seeks a Variance, pursuant to
Massachusetts General Laws Chapter 40A, Section 10 and Section 139-32 A of the Nantucket Zoning By-
law ("Bylaw"), from the requirements of Section 139-2 (Defmitions:TENT) to allow an awning/tent to be
erected for a period exceeding thirty (30) days per year. In the alternative, the Applicant requests a Finding
from the Zoning Board of Appeals that the proposed awning is not a tent and, therefore, no zoning relief to
construct the awning is required.
Applicant's property is known as the Jared Coffin House and is located at 29 and 27 Broad Street,
Nantucket ("Property"). The Property comprises two lots shown on Land Court Plans 32088-A and 33109-
A registered at the Nantucket Registry District of the Land Court (see plans attached hereto as Exhibit A).
The Property is owned by the Applicant by virtue of Certificate of Title No. 108072 at said Registry
District. The Property is located in the Residential Downtown Commercial District (RCDT) and is
currently used as an inn and restaurant.
By way of background, the Applicant has the opportunity to enliven the property with a new
restaurant which has recently opened. Applicant proposes to install an awning upon the Premises for the
purpose of shading and protecting patrons using the outdoor patio on the east side (Broad Street side) of the
Jared Coffin House (see HDC approved plans attached hereto as Exhibit B). In seeking a building permit
for construction of the awning, the Zoning Enforcement Officer has rendered an opinion that the awning is
in fact a tent as defined in Section 139-32 A of the Bylaw and, therefore, requires relief in the form of a
Variance from this Board to allow the tent to be erected for a period exceeding thirty (30) calendar days per
year.
Due to the design of the east facade of the Jared Coffm House and the way that facade relates to
the already established outdoor patio, a conventional awning cannot be hung for the full length of one of its
sides from the Jared Coffm House. Therefore, a smaller "breezeway" awning from the service entrance of
the Jared Coffin House will act as a connecting walkway to a larger awning that then spans the outdoor
patio. This proposed awning is similar to an awning which existed on the property during the 1960s (see
patio photos ca. 1960 attached hereto as Exhibit C). Because this awning is not conventional in design,
(due to the shape of the historic brick structure that it would otherwise be hung from and connected to), the
question of its character has arisen: is it an awning or a tent? The Applicant respectfully suggests that this
is a request for an awning pursuant to Section 139-2 of the Bylaw given its connection to the building, the
fact that it will not be secured by pegs in the ground, and its proposed use in covering an outdoor dining
area.
To the extent the Board determines that the awning is a tent, the relief requested meets the
Variance standards set forth in M.G.L. c. 40A, § 10 and Section 139-32 of the Bylaw. Specifically, the
Board may grant a Variance when it specifically finds that because of circumstances relating to the soil
conditions, shape or topography of such land and especially affecting such land or structures but not
affecting generally the zoning district in which the land is located, a literal enforcement of the provisions of
by-law would involve substantial hardship to the Applicant and the desired relief maybe granted without
substantial detriment to the public good and without nullifying or substantially derogating from the intent
and purpose of the Bylaw.
Given the Applicant's use of the two contiguous lots as one parcel for the purpose of operating an
inn and restaurant, as well as the construction, design and character of the Jared Coffin House and the way
the facade of this historic structure relates to the already established outdoor patio (which especially affects
this locus and does not affect generally the RCDT zoning district), a literal enforcement of the provisions
of by-law would involve substantial hardship to the Applicant. Furthermore, the relief requested may be
granted without substantial detriment to the public good and without nullifying or substantially derogating
from the stated intent and purpose of the Town of Nantucket Zoning Bylaw to "promote the health, safety,
convenience, morals and general welfare of its inhabitants, to lessen the danger from fire and
congestion..." To the contrary, the relief requested is in harmony with the intent and purpose of the Town
of Nantucket Zoning By-law. Construction of the awning will not fiu-ther exacerbate any existing
congestion in the RCDT district and, moreover, will promote the convenience, safety and general welfare
of any inhabits who patronize the outdoor patio in the same way numerous other awnings in the RCDT
district promote such purposes.
Conclusion
To the extent the Board finds that the awning is a tent pursuant to Section 139-2 of the Bylaw,
allowing the construction of a tent in this location for a period exceeding 30 days per calendar year meets
the Variance standard set forth in the Bylaw and M.G.L. c. 40A §, 10. Therefore, the Applicant asks the
Board to vote in favor of the Variance as requested. In the alternative, the Applicant asks the Board to find

that the structure is an awning and not a tent and under those circumstances, that no zoning relief is
required.
