At a public hearing of the Nantucket Zoning Board of Appeals, on Thursday, July 14, 2011, at 1:00 P.M., at 4 Fairgrounds Road, Nantucket, Massachusetts, the Board made the following decision on the application of MARY E. GLOWACKI, PO Box 389, Nantucket, MA 02554, File No. 033 -11: 2. Applicant is requesting Variance relief pursuant to Nantucket Zoning Bylaw Section 139 -32 (Variances) from the intensity regulations in Section 139 -16 (intensity regulations - frontage) to grant relief from the frontage requirement in order to validate the subject lot as separately marketable and buildable. The Locus is situated at Old South Road, is shown on Nantucket Tax Assessor's Map 68 as Parcel 126, is shown on Land Court Plan 16514 -81, and is registered as Certificate of Title No. 12,206 in the Nantucket County Registry District of the Land Court. The property is zoned Residential - 20. 3. Our decision is based upon the application and accompanying materials, and representations and testimony received at our public hearing. At the hearing, Ms. Bunting explained to the Board that the Applicant is requesting Variance relief pursuant to Nantucket Zoning Bylaw Section 139 -32 (Variances) from the intensity regulations in Section 139 -16 (intensity regulations - frontage) to grant relief from the frontage requirements of the bylaw in order to validate the subject lot as separately marketable and buildable. 11 Leslie Snell, the Senior Planner for the Town of Nantucket, gave a detailed history of the parcel and the recommendation of the Planning Board. Ms. Snell explained that the lots in question were shown on a Land Court Plan that pre -dates the adoption of the Subdivision Control Law (1955) and they meet the minimum dimensional standards for the R -20 zoning district, except for frontage. However, because Miller Lane has not been laid out as a road, the lots do not have frontage and are not regarded as buildable. Ms. Snell further added that had the property owner realized after the adoption of zoning that the lots did not have frontage, they could have provided an access easement pursuant to Section 139-33E(l) (b) of the Zoning Bylaw, which would have cured the situation. However, the owner had no indication that the status of the lots was in jeopardy and they were believed to have frontage on a parcel of land known as Millers Lane, which in addition to the name, the shape of which gives the appearance of a road. In addition, the lots have been assessed by the Tax Assessor as buildable lots for years. All other lots shown on the 1955 Land Court Plan, located within the triangular piece of land between Old South Road and so- called Millers Lane, have legitimate frontage and are buildable. On several occasions in recent years the Planning Board reviewed the subject lots and made recommendations on access to the Board of Selectmen and County Commissioners. Efforts to extend the public lay -out of Miller Lane to provide frontage was not positively acted upon. Ms. Snell also discussed how an application to the Planning Board could be submitted for an Approval Required (AR) subdivision to create a roadway to provide frontage to these lots. The applicant could also submit an application to the Planning Board for an Approval Not Required (ANR) plan to create lots using Old South Road as frontage. Either of these options would require at least one new driveway or roadway access point on Old South Road, which is contrary to sound traffic and safety considerations, and these options may result in the creation of additional lots. Therefore, the Planning Board recommends granting the requested variance in order to validate the lots as separately marketable and buildable so to have less of a development impact than the other options mentioned. 5. Accordingly, the Board of Appeals, by unanimous vote of the sitting members, found that the requested variance can be granted to this specific lot without affecting the zoning district generally; that a literal enforcement of the provisions of Chapter 139 of the Code of the Town of Nantucket would involve substantial hardship to the Applicant; that desirable K relief may be granted without substantial detriment to the public good because any alternative means of granting the Applicants these separately marketable and buildable lots would create a new access of Old South Road, which is against sound traffic and safety considerations; and that the relief would not nullify or substantially derogate from the intent or purpose of said Zoning Bylaw. Accordingly, the relief requested from Section 139 -17 is granted by VARIANCE with the following conditions: a. That access to the lots must be limited Miller Lane, via an easement over Lot 46, and in the case of Lot 44, an easement over Lots 45 and 46; and, b. That the lots shall be prohibited from any further division which results in additional building lots.
