An Appeal from this Decision may be taken pursuant to Section 17 of Chapter 40A, Massachusetts General Laws. NANTUCKET ZONING BOARD OF 2 Fairgrounds Road Nantucket, Massachusetts Assessor's Map 20, Parcel 96 20 Broad Street Commercial Downtown ( `CDT" ) DECISION: APPEALS 02554 Book 556, Page 296 Plan Book 20, Pg. 96 1. At a public hearing of the Nantucket Zoning Board of Appeals, on Thursday, May 12, 2011, at 1:00 P.M., at 4 Fairgrounds Road, Nantucket, Massachusetts, the Board made the following decision on the application of Twenty Broad Street, LLC Lessee of the property located at 20 Broad Street, c/o Vaughan, Dale, Hunter, Stetina, and Beaudette, 2 Whaler's Lane, PO Box 659, Nantucket, MA 02554, File No.029-11: 2. Applicant requested Special Permit relief pursuant to Nantucket Zoning Bylaw Section 139-33.A.(4) and (5) (alteration of preexisting nonconforming structures) in order to erect an awning on the east side of the existing structure on the property. A portion of awning will encroach into the rear yard setback no closer than .9 feet from the rear lot line. The existing structure on the property is presently sited as close as .4 feet from the rear lot line in a zoning district that requires a 5 foot rear yard setback. Alternatively, the Applicant requested Variance relief pursuant to Nantucket Zoning Bylaw Section 139-32 (variances) from the intensity regulations in Section 139-16 (intensity regulations - setbacks). The Locus is situated at 20 Broad Street, is shown on Nantucket Tax Assessor's Map 42.4.2, Parcel 33, is shown in Plan Book 20, Page 96 and title is recorded at the Nantucket County Registry of Deeds in Book 556, Page 296. The property is zoned CDT. 3. Our decision is based upon the application and accompanying materials, and representations and testimony received at our public hearing. There was no Planning Board recommendation, on the basis that no matters of planning concern 1 were presented. There were letters of support in favor of the application. 4. Attorney Jeff Stetina and Michael Getter, the Lessee of the property, spoke before the Board. Attorney Stetina explained to the Board that the Applicant is requesting Special Permit relief pursuant to Nantucket Zoning Bylaw Section 139-33.A.(4) and (5) in order to erect the proposed awning. Specifically, Mr. Getter explained to the Board that the Applicant proposes to erect an awning on the east side of the existing structure on the property. A portion of the awning will be sited in the rear yard setback but will be no closer than 0.9 feet from the rear lot line. The existing structure, as presently sited, is approximately 0.4 feet from the rear lot line and has been in this location since a time prior to July 1972. 5. Therefore, after a discussion with Counsel for the Applicant, the Board finds that such a Special Permit may be granted to approve the alteration of the preexisting nonconforming structure as the alteration will not intrude into the setback any further than what presently exists. The Board determined that this type of alteration would not be substantially more detrimental to the neighborhood than the existing nonconformity on the Locus. The Board imposed the following conditions on the Special Permit: (1) The Applicant shall cease serving alcohol in the outdoor seating area by 11:30 PM, and (2) The Applicant shall cease playing music in the outdoor seating area by 11:00 PM. 6. Accordingly, by a unanimous vote of the sitting Board, the Board of Appeals made the finding that the proposed alteration to the preexisting nonconforming structure would not be substantially more detrimental to the neighborhood than the existing nonconformity and allowed the proposed alteration to the structure to be done in substantial conformity with the plan entitled "Plan to Accompany Zoning Board of Appeals In Nantucket, MA" prepared by Bracken Engineering, Inc., dated May 9, 2011, attached hereto as "Exhibit A" and subject to the two conditions stated above.
