It is vacant land but is being prepared for relocation of industrial uses being relocated from two residential locations, one of which directly abuts Miacomet Pond, as well as new uses. The Town of Nantucket and the Nantucket Islands Land Bank have worked for several years to accomplish this goal. The Planning Board has granted a Major Commercial Development permit (04-11) and the Historic District Commission has approved the commercial structures (notably on its consent agenda, which is designated for projects deemed to require minimal review). The locus and planned structures thereon will be conforming to the CI Zoning District and Special Permit relief granted in the MCD, in all respects, except for height. The MCD does grant height relief for a proposed antenna, but the Planning Board is not empowered to grant such relief for buildings in the CI District. Applicant now seeks a Variance under Nantucket Zoning Bylaw Section 139-32 from the height regulations of Section 139-17. W\Dwr--r--r--r--r-- ~ ''''0 Attachinent A Zoning Board of Appeals Industry Road Trust PROJECT OVERVIEW Reis Trucking (Reis), is seeking approval from the Zoning Board of Appeals for a Variance under Nantucket Zoning Bylaw Section 139-32 from the height regulations of Section 130-17 for a Metals Recovery and Recycling Building it proposes to construct as part of a Major Commercial Development (MCD). The project site is located on two contiguous parcels ofland at 10 Industry Rd. (69-294) and 8 Shadbush Rd. (69- 293) in the Commercial Industrial zoning district. These parcels were acquired under the tenns of a Purchase and Sales Agreement among the Reis family, the Town of Nantucket, and the Nantucket Islands Land Bank. Key elements of this 4 year effort include: . An environmentally significant parcel of pond-front land at 80 Miacomet Avenue was conveyed by the Reis family to the Land Bank for perpetual conservation purposes. Reis will continue its uses at this property under a lease with the Land Bank until construction at the Industry Rd. site progresses sufficiently to allow Reis to vacate the property. . 11 separate articles at 3 Town Meetings were passed to create the Commercial Industrial zoning district, authorize the land exchange with the Reis family, and create the industrial park in which the site is located. . Reis Trucking has agreed to relocate its commercial and industrial activities at 80 Miacomet Ave. and at 57 & 59 Surfside Rd. to the Industry Rd. site when its new facilities are constructed. The removal of all commercial/industrial uses at Miacomet Ave. will be proceed as a first priority once all approvals and permits are secured for the new facilities have been secured and work on the new site has progressed to a state that will support this first phase of the relocation. . Once its operations have been relocated to Industry Rd, Reis has agreed to abandon all grandfathered rights to operate industrial businesses at 57 & 59 Surfside Rd. and to file deed restrictions to prevent similar businesses from being operated at these parcels in the future. . Reis has agreed to support a Town Meeting article to rezone 57 & 59 Surfside Rd, from the present RC2 zoning to R5 and CN in keeping with the character of the surrounding neighborhood. An article to accomplish this re-zoning will appear on 2011 A TM warrant. . Dedication of a large parcel of pond front land to conservation, relocation of commercial/industrial uses away from residential neighborhoods, and abandonment ofRC2 zoning at the Surfside Rd parcels all support and further the Town's planning objectives as articulated in the Master Plan and provide significant public benefit. . In order to secure a Massachusetts Endangered Species Act (MESA) permit for the industrial park land, the Town was required to place into perpetual conservation four acres of undisturbed open land ("mitigation acreage") for every one acre of industrial park land. . In addition, a 14,000 sq ft area in the northeast comer of Applicant's site is protected by a conservation easement. The chain link security fence that encloses the site was constructed to exclude this area and the Land Bank will manage the area as an undeveloped buffer to New South Rd. . The Planning Board found in its decision that the mitigation acreage required by environmental permitting, together with the 14,000 sq. ft. conservation easement satisfied the open space requirements of the zoning bylaw with no additional screening or landscaping features. In addition, .'cJ".,.......""'.'-.., " " AttachInent A Zoning Board of Appeals Industry Road Trust a vegetated buffer has been prescribed along Madequecham Valley Rd to screen the entire industrial park area from traffic along that roadway. . Industry Rd. and Shadbush Rd. are interior roadways within the industrial park, much like the adjacent Bunker Rd. industrial development on Airport property. Collectively, these industrial zoned areas benefit from a wide buffer of conservation land that extends out to the Milestone Rd. No signage is permitted at the intersection of Milestone Rd. and New South Rd (Bunker Rd.) in order not to encourage casual vehicle traffic in this commercial/industrial area. The buildings in this area are nearly all constructed using steel frames and metal skins and installations there have historically been exempted from screening and setback requirements that are appropriately applied in mixed use zoning districts. The following is a summary of businesses and facilities that will be operated upon the site: . A residential and commercial rubbish collection business, including the storage of trucks, roll-otf containers and other associated equipment. . Receiving, sorting and recycling of scrap metals and other recyclable materials. . An excavation and construction business, including earth moving, land clearing, driveway and roadway construction and repair, water, sewer and other utility installation, septic system construction, building jacking and moving, and similar activities. . A general trucking business to include loading, unloading, transporting, and storage of bulk materials and other cargo. . A concrete batching and delivery business to include installation and operation of a concrete batch plant, and the operation and storage of concrete mixer trucks, concrete pump trucks, and other associated equipment and materials associated with the production and delivery of concrete. . Storage and sale of bulk materials related to excavation and concrete production operations such as topsoil, hardener, common fill, sand, shells, gravel, mulch, stone dust and other associated materials. . A mechanical shop as well as garages and storage facilities for maintenance and inside storage of trucks and other equipment . Materials processing and recycling including: receiving and storing trees and brush and processing the same into wood chips and mulch; receiving and storing leaf and yard waste and processing the same into composted topsoil; and receiving concrete, brick and asphalt rubble and processing the same into crushed concrete road base material . Mining of sand for use in Reis' concrete and excavation businesses and for retail sale. The height of this 90 ft by 110 ft building is driven by the size and type of equipment that must operate inside, including excavators, dump trucks and dump trailers that must be able to move with the dump bodies in a fully elevated position. To safely accommodate these operations the minimum required interior clear height is approximately 33 feet as shown on the equipment operating envelope diagram on the following page. Shown below are the critical dimensions of the steel frames for the building, and in particular the interior clear height dimension. . The depth of steel frame members at the eaves and a 1 on 12 roof pitch lead to a peak height of approximately 40 ft above the finished elevation on three sides. The back of the building faces the lower portion of the site and the back wall rests directly on the 16 ft retaining wall that surrounds this lower portion of the site. Applying the prescribed formula from the Zoning Bylaw Section 139-16 the height above mean grade for three sides of the building (the front and the two gable ends) is 39 ft while for the back the height above mean grade is 46.75 ft. At a public hearing of the Nantucket Zoning Board of Appeals, on Thursday, May 12, 2011, at 1:00 P.M., at 4 Fairgrounds Road, Nantucket, Massachusetts, the Board made the following decision on the application of INDUSTRY ROAD TRUST, c/o Reade, Gullicksen, Hanley, and Gifford, LLP, 6 Young's Way, Post Office Box 2669, Nantucket, MA 02584, File No. 028-11: 2. Applicant is requesting Variance relief pursuant to Nantucket Zoning Bylaw Section 139-32 (variances) from the height requirements in Section 139-17 (height requirements) to allow the average height above mean grade of the building to be 40.9 +/- feet (39 +/- feet above mean grade for three sides and 46.75 +/- feet above mean grade for the back side of the structure), where the bylaw provides that the average height is not to exceed 30 feet above mean grade and no one side is to exceed 32 feet above mean grade. The Locus is situated at 10 Industry Road, is shown on Nantucket Tax Assessor's Map 69 as Parcel 293, is shown on Plan File 2010-62 as Lot H, and title is recorded at the Nantucket County Registry of Deeds in Book 1276, Page 56. The property is zoned Commercial Industrial. 3. Our decision is based upon the application and accompanying materials, and representations and testimony received at our public hearing. There was no Planning Board recommendation, on the basis that no matter of planning concern was presented. There was no support, nor opposition presented by the public at the public hearing. No correspondence was received by the Board of Appeals regarding this application. 4. Charles F. O'Neil and Attorney Steven Cohen represented the Applicant at the hearing. At the hearing, 1 Attorney Cohen stated that the Applicant is requesting Variance relief pursuant to Nantucket Zoning Bylaw Section 139-32 from the height requirements of Section 139-17 in order to construct a metals and recycling building on the locus. The Applicant is in the process of relocating the Reis Trucking operations from the mid-island area to a site on Industry Road. The Applicant explained that the building in question has to exceed the height limitations for two reasons. First, in order to properly house and operate the excavators, dump trucks, and dump trailers that must be able to move with the dump bodies in the fully elevated position, there must be a minimum interior height of 33 feet (plus more for roof pitch) in the structure. Secondly, on the rear side of the structure the land has to be excavated so that the trucks are at a lower grade. Accordingly, the entire structure must exceed the height limitations, and one side has to exceed it by much more. As background, the Town of Nantucket and the Nantucket Islands Land Bank have worked for several years to relocate the Reis Trucking business from a residential and environmentally sensitive area abutting Miacomet Pond to the Commercial Industrial zone located near the airport. The Planning Board has granted a Major Commercial Development permit (04-11) and the Historic District Commission has approved the commercial structures. The Locus and planned structures thereon shall be conforming to the Commercial Industrial zoning district and Special Permit granted by the Planning Board, except for height. The Major Commercial Development does grant height relief for a proposed antenna, but the Planning Board is not empowered to grant such relief for buildings in the Commercial Industrial zoning district. 5. Accordingly, the Board of Appeals, by unanimous vote of the sitting members, found that the requested variance can be for this specific structure outside conditions affecting the zoning district generally; that a literal enforcement of the provisions of Chapter 139 of the Code of the Town of Nantucket would involve substantial hardship to the Applicant; that desirable relief may be granted without substantial detriment to the public good; and that the relief would not nullify or substantially derogate from the intent or purpose of said Zoning Bylaw. Accordingly, the relief requested from Section 139-17 is granted by VARIANCE, such relief to be in substantial compliance with the relief sought.
