1. At a public hearing of the Nantucket Zoning Board of
Appeals, on Thursday, May 12, 2011, at 1:00 P.M., at 4
Fairgrounds Road, Nantucket, Massachusetts, the Board made the
following decision on the application of LAURA JAN HEDRICK, of
94 Worcester Street, Boston, MA 02118, File No. 025-11:
2. Applicant is requesting Special Permit relief pursuant
to Nantucket Zoning Bylaw Sections 139-33.A.(4) and (5)
(alteration of preexisting nonconforming structures) in order to
alter the preexisting nonconforming structure is nonconforming
as to side yard setback, being sited as close as 6.5 feet to the
side yard setback in a zoning district that requires a 10 foot
side yard setback. The Applicant proposes to construct a porch
at the rear of the structure. This porch will not be any closer
to the side yard setback than the existing structure. In the
alternative, the Applicant is requesting Variance relief
pursuant to Nantucket Zoning Bylaw Section 139-32 (variances)
from the intensity regulations in Section 139-16 (intensity
regulations -side yard setback) to install said porch. The
Locus is situated at 1 McGarvey's Way, is shown on Nantucket Tax
Assessor's Map 72 as Parcel 7, is shown in Plan Book 18, Page 3,
and title is recorded at the Nantucket County Registry of Deeds
in Book 169, Page 338. The property is zoned Residential - 20.
3. Our decision is based upon the application and
accompanying materials, and representations and testimony
received at our public hearing. There was no Planning Board
recommendation, on the basis that no matter of planning concern
was presented. There was no support nor opposition presented at

the public hearing, and no correspondence was received by the
Board of Appeals regarding this application.
4. Laura Jan Hedrick represented herself at the hearing.
At the hearing, Ms. Hedrick stated that she is requesting
Special Permit relief pursuant to Nantucket Zoning Bylaw Section
139-33.A.(4) and (5) in order to allow the Applicant to
construct a porch at the rear of the structure. The structure
is preexisting, nonconforming as to side yard setback, being as
close as 6.5 feet to the side yard lot line in a zoning district
that requires a ten (10) foot side yard setback.
The proposed porch will not be any closer to the side yard
setback than the existing structure and is drawn in on the
attached plan.
In the alternative, the Applicant is requesting Variance relief
pursuant to Nantucket Zoning Bylaw Section 139-32 (variances)
from the intensity regulations in Section 139-16 (intensity
regulations -side yard setback) to install said porch.
5. Accordingly, the Board of Appeals, by unanimous vote
of the sitting members, found that the proposed Special Permit
could be granted by a finding that such an alteration will not
be substantially more detrimental to the neighborhood than the
existing nonconformity and will not increase the nonconforming
nature of said structure. Therefore, the Board granted relief
by Special Permit pursuant to Nantucket Zoning Bylaw Section
139-33.A.(4) and (5) to allow the applicant to construct a porch
to be sited no closer than 6.5 feet from the side yard lot line
as shown on the altered plan entitled, "Mortgage Inspection Plan
in Nantucket, Massachusetts," dated February 27, 2006, prepared
by Nantucket Surveyors, LLC and altered by hand by Laura Jan
Hedrick, attached hereto as "Exhibit A."
