Executive Session Minutes
January 28, 2011
Executive Session took place at Nantucket Memorial Airport's SRE Building, 13 New South Road,
Nantucket, at 2:30 p.m.
Three Commissioners were present, E. Vaughan, R. Atlee and C, England. S. Egan was travelling back
from Florida and D. Macintyre could not be located. After a roll call vote the commission entered
executive session to discuss the Devine litigation.
Airport Manager, Al Peterson was also present.
It was noted that the defense of sovereign immunity had not been raised during the course of the most
recent Devine lawsuit claiming damages for trespass. Under the circumstances the commission thought it
would be prudent to terminate the employment ofthe DeRensis fIrm as defense counsel and turn to new
Town counsel, the Kopelman fIrm for its defense. It was so voted unanimously via a roll call vote.
Meeting adjourned, 2:45 p.m.
