Addendum Nantucket Zoning Board of Appeals Application of NIR Retail LLC (Owner and Contract Lessor) And Vladislav Todorov and ~lena Markova, (Applicant and Contract Lessee) A portion of 4 South Water Street, f/k/a ~Crush Cosmetics" Vladislav Todorov and Milena Markova, (Applicant and Contract Lessee), C/O Vaughan, Dale, hunter, stetina and Beaudette, P.C., POB 659, Nantucket, Massachusetts 02554, are Contract Lessees from NIR Retail LLC (Owner and Contract Lessor) for a portion of 4 South Water Street (the "Premises"). 4 South Water Street consists of two retail store spaces: "Posh" and a vacant retail store space formerly known as "Crush Cosmetics" ("Crush"). The Applicant is seeking Special Permit relief under Section 139- 33 (A) (4) (a) and (b) (al teration of use of pre-existing nonconforming structures) of the Nantucket Zoning By-Law ("By-Law") to change the retail store space formerly known as Crush to a restaurant. Addi tionally, Applicant is seeking Special Permit relief pursuant to Section 139-18 B (2) (a) and (b), waiving the requirement to provide off-street parking spaces and Section 139-20 C (1), (2) and (3), waiving the requirement to provide an off-street loading facility, both which are otherwise required under Section 139-18 (Off-street parking requirements) and Section 139-20 (Off-street loading facilities) of the By-Law. The Premises is located in the Commercial Downtown Zoning" District (COT). The subject structure that currently houses Crush and Posh was found in a prior decision of the Zoning Board of Appeals (ZBA Decision File No. 020-86, a copy of which is attached) to be pre- existing, non-conforming as at the time was its use, being a restaurant (The Opera House)that did not provide parking for its clientele or employees. In this prior decision the Zoning Board found that the premises benefited from a total of thirteen (13) grandfathered parking spaces. By way of background, and as stated in the 1986 Special Permit, the Premises was formerly used as a restaurant (known as the "Opera II " i! Ii . < < .. . .' House") dating back to approximately 1948. The Zoning Board granted the above Special Permit allowing the use of the Premises to change from a restaurant occupying the whole Premises to two separate retail store spaces. The Special Permit further blessed the Premises by waiving the off street parking requirement under the By-Law. More specifically, the Special Permit waived a total of 13 parking spaces for the two newly created retail store spaces. The Applicant is seeking a Special Permit to change the retail store space formerly known as Crush into a creperie having a total of no more than three (3) employees working in the restaurant at peak hours and a total of nineteen (19) seats on the first floor of the restaurant. The second floor of the space will be dedicated to storage and a small office and a small basement area will be dedicated to storage. As shown by the floor plans drawn by McMullen and Associates, dated March 8, 2011, attached as Exhibit "B", the proposed restaurant space is located on the first floor of the premises and is comprised of 561 +/- square feet; the second floor is the same size and made up of storage, an office and a bathroom; the basement area, also dedicated to storage, is 561 square feet in size. As noted, the retail store space (jewelry store), Posh, is also located in the Premises. Posh is comprised of a total ground floor space of approximately 633 square feet in size all which is allocated to retail space. Posh consists of one (1) floor and has one (1) employee at peak hours in the store. Per the following parking chart, the total parking spaces that are otherwise required to be provided by the applicant due to the proposed new restaurant use and existing retail use are nine (9) spaces. The Premises otherwise conforms to the requirements of the CDT Zoning District; provided however the Premises is pre-existing, nonconforming as to its lots size and as to its ground cover ratio. No changes to the structure of the building are proposed as part of this application. Applicant's request seeks to change the use of the Premises from a retail space to a restaurant. This changed use is in harmony with the surrounding area in Town and will not be substantially more detrimental to the neighborhood than the retail use which previously existed. Additionally, Applicant is merely seeking to ratify the historic and current conditions with respect to the Premises' use and its physical inability to provide parking and a loading zone. Applicant's request is consistent with the spirit and intent of the By-Law. Accordingly, Applicant respectfully asks that the Board approve the requested Special Permit relief. The Premises is situated at 4 South Water Street (the "premises"), is shown on Nantucket Tax Assessor's Map 42.3.1 as Parcel 176, is shown in Plan Book 23, Page 70, and title is 1 recorded at the Nantucket County Registry of Deeds in Book 978, Page 261. The property is zoned Commercial Downtown. 3. Our decision is based upon the application and accompanying materials, and representations and testimony received at our public hearing (collectively, the "Application") . There was no Planning Board recommendation, on the basis that no matters of planning concern were presented. Staff received neither letters in favor of nor in opposition to the Application. 4. Attorney William Hunter represented the Applicant at the hearing. Attorney Hunter stated that the Applicant is seeking zoning relief under Section 139-33 (A) (4) (a) and (b) (alteration of use of pre-existing nonconforming structures) of the Nantucket Zoning By-Law ("By-Law") to change the retail store space formerly known as Crush to a restaurant, Special Permit relief pursuant to Section 139-18 B (2) (a) and (b) to waive the requirement to provide off-street parking spaces, and Special permi t relief pursuant to Section 139-20 C (1), (2) and (3) to waive the requirement to provide an off-street loading facility. 5. The Applicant, through their attorney, told the Board that the Premises currently houses two retail stores called Crush, a cosmetic store and Posh, a jewelry store. The Premises was found in a prior decision of the Zoning Board of Appeals (ZBA Decision File No. 020-86, the "1986 Decision") to, at that time, house a use (namely, The Opera House Restaurant) that pre-dated zoning and that, at that time, did not, nor ever had, provide parking for its clientele or employees. In this prior decision the Zoning Board found that the Premises benefited from a total of thirteen (13) grandfathered parking spaces. Attorney Hunter further stated, by way of background, that in the 1986 Decision, the restaurant use was described to date back to approximately 1948. On that basis, in the 1986 Decision, the Zoning Board granted a Special Permit allowing the use of the Premises to change from a restaurant occupying the whole Premises to two separate retail store spaces. The Special Permit further blessed the Premises by waiving the off street parking requirement under the By-Law. More specifically, the Special permi t waived a total of 13 parking spaces for the two newly created retail store spaces. 6. In the current application, the Applicant is seeking a Special Permit to change one of the two retail store spaces, specifically the one formerly known as Crush, into a restaurant, more specifically, a creperie having a total of no more than three (3) employees working in the restaurant at peak hours and a total of nineteen (19) seats on the first floor of the restaurant. The second floor of the space will be dedicated to 2 storage and a small office. The small basement area associated with the proposed creperie will be dedicated to storage. As shown by the floor plans drawn by McMullen and Associates, dated March 8, 2011, included in the Application, the proposed restaurant space is located on the first floor of the Premises and is comprised of 561 +/- square feet; the second floor is the same size and made up of storage, an office and a bathroom; the basement area, also dedicated to storage, is 561 square feet in size. As noted, the retail store space (jewelry store), Posh, is also located in the Premises. Posh is comprised of a total ground floor space of approximately 633 square feet in size all which is allocated to retail space. Posh consists of one (1) floor and has one (1) employee at peak hours in the store.
