DECISION:
1. At a public hearing of the Nantucket Zoning Board of
Appeals, on Thursday, March 10, 2011, at 1:00 P.M., at 2
Fairgrounds Road, Nantucket, Massachusetts, the Board made the
following decision on the application of TOWN OF NANTUCKET, 16
Broad Street, Nantucket, MA 02554; NEIL J. RUTHER, TRUSTEE OF
THE ELLERY WOODWORTH NANTUCKET TRUST, 29 W. Susquehanna Avenue,
Suite 610, Townson, MD 21204; and MARK WHITE AND BARBARA WHITE,
PO Box 1251, Nantucket, MA 02554, File No. 015-11:
2. Applicant is requesting Special Permit relief pursuant
to Nantucket Zoning Bylaw Section 139-33.A.(8) (alteration of
preexisting nonconforming lots) in order to alter the following
preexisting nonconforming lots by adding parcels from the Town's
Yard Sale program to said lots. The lots, as so altered, will
still not meet the minimum lot size of the LUG-2 and LUG-3
zoning district.
3. Our decision is based upon the application and
accompanying materials, and representations and testimony
received at our public hearing. There was no Planning Board

recommendation, on the basis that no matter of planning concern
was presented. Except for the presentation by the applicant,
there was no support nor opposition presented at the public
hearing, and no correspondence was received by the Board of
Appeals regarding this application.
4. John Brescher represented the Applicant. At the
hearing, Mr. Brescher stated that the Applicant is requesting
Special Permit relief pursuant to Nantucket Zoning Bylaw Section
139-33.A.(8) (alteration of preexisting nonconforming lots) in
order to alter the lots that have been affected by the Town's
Yard Sale program. The subject lots will all increase their
respective lot areas, but will still be undersized for the
zoning district in which they are located. Below is a chart
illustrating said increases:

5. Accordingly, the Board of Appeals, by unanimous vote
of the sitting members, found that the proposed Special Permit
could be granted by a finding that such a change in size shall
not be substantially more detrimental than the existing
nonconformity to the neighborhood and that such a Special Permit
will not create or increase any existing nonconformity and
subsequently approved the requested relief allowed the requested
relief to be in done in substantial compliance with the plans
entitled, "Plan to Acquire Land for General Municipal Purposes
Vernon Street, Waverly Street, and Adams Street," prepared by
Nantucket Surveyors, LLC, dated September 9, 2010, revised
February 7, 2011, attached hereto as "Exhibit A", "Plan to
Acquire Land for General Municipal Purposes Vernon Street and
Waverly Street," prepared by Nantucket Surveyors, LLC, dated
September 9, 2010, attached hereto as "Exhibit B", and Plan No.
2011-16, filed with the Nantucket County Registry of Deeds.
