NANTUCKET BOARD OF APPEALS 4 Fairgrounds Road Nantucket, Massachusetts 02554 Map 66 Parce143 5 Residential Commercial-2 67 Bartlett Road Land Court Plan No. 28933-V Certificate of Title No. 20,276 At a Public Hearing of the Nantucket Zoning Board of Appeals held at 1:00 p.m., Thursday, April 14, 2011 and continued to June 9, 2011 at 4 Fairgrounds Road, Nantucket, Massachusetts on the Application of Bartlett Road Realty LLC c/o of Audax Group, 101 Huntington Avenue, Boston, Massachusetts 02199, Board of Appeals File No. 012-11, the Board made the following Decision: Applicant is requesting Special Permit relief pursuant to Nantucket Zoning Bylaw Section 139-7a (allowable uses) to allow the Applicant to operate a contractor's shop and light manufacturing on the Locus. The Locus is situated at 67 Bartlett Road, is shown on Nantucket Tax Assessor's Map 66 as Parcel 435, is shown on Land Court Plan No. 28933-V, and registered as Certificate of Title No. 22,142 at the Nantucket Registry District of the Land Court. The property is zoned Residential Commercial- 2. 2. This Decision is based upon the Application and materials submitted with it, along with the testimony and evidence presented at the two hearings. The Planning Board did not make a recommendation as the matter was not of planning concern. There were several letters regarding this Application. Some letters were asking for clarification, while others were in opposition. There were neighbors at the hearing speaking in opposition, and others requesting clarification. 3. Attorney Rhoda H. Weinman represented the Applicant. Attorney Weinman stated that the Applicant is requesting Special Permit relief pursuant to Nantucket Zoning Bylaw Section 139-7a (allowable uses) to allow the Applicant to operate a contractor's shop and light manufacturing on the Locus. The Locus is situated in Residential Commercial - 2 zoning and this type of use is permitted by Special Permit. Counsel for the Applicant represented that the Applicant also has boat storage on the Locus, but this use is allowed by right in this zoning district. 4. Prior to the hearing, the abutter to the East of the Locus had submitted letters and pictures to demonstrate the intensity of this use. These letters and pictures are in the file in at the Zoning Office and were presented at the hearing as well. The question of whether or not the uses amounted to a Major Commercial Development ("MCD") had been raised and the Applicant had submitted a site plan, to the satisfaction of the Zoning Enforcement Officer ("ZEO"), depicting the square footage of the uses on the Locus. Accordingly, it has been the determination of the ZEO that the uses on the Locus do not trigger the MCD bylaw. 5. In response to one of the letters submitted by an abutter, the Applicant has closed off one of the driveways on his abutting 4 Marble Way lot. Counsel for the Applicant clarified for the Board that the Applicant is only requesting Special Permit relief in order to operate a contractor's shop and light manufacturing on the Locus -the boat storage on the Locus is allowed by right; and, the Applicant has explained to the Board and the public that the old cars and debris in many of the pictures are on the neighboring Locus which is owned by an abutter and is not under the control of the Applicant. 6. During the course of the hearing, counsel for the Applicant indicated that the Applicant has responded to every letter sent to the Board with concerns or questions in an attempt to explain that the Application before the Board is for a contractor's shop (woodworking), and light manufacturing and clarifying that boat related storage is a permitted use in the zoning district not requiring any relief from the Board. Applicant further represented at the meeting, through counsel, that the lots has been cleaned up, trees have been planted to further screen the area and a split rail fence was installed to block off one of the entrances off of Marble Way in response to an abutter's concern. At the hearing, some of the abutters spoke in regard to the intensity of the uses on the Locus and the noise associated that can be associated with a woodworking shop. 7. The Board voted at the end of the first meeting to schedule a site visit, which was held on April 27~h. No testimony was taken at this visit, and the Board inspected the woodworking shop. The tenant for the woodworking shop testified at the second hearing held on June 9, 2011 regarding his hours of work, number of employees etc. and answered questions posed by the Board. 8. Therefore, based upon the foregoing, the Board finds that the use of the first floor space for a contractor's shop and light manufacturing is in harmony with the general purpose and intent of the Zoning Bylaw, and the contractor's shop is consistent with the uses in the neighborhood. Thus, the desired relief may be granted without substantial detriment to the public good. 9. Accordingly, by a UNANIMOUS vote, the Board of Appeals hereby GRANTS the relief by SPECIAL PERMIT under 139-7a allowing the contractor's shop and light manufacturing on the Locus subject to be done in substantial conformity with the attached site plan entitled "Proposed Site Plan 4A Marble Way in Nantucket Massachusetts," dated March 31, 2011 prepared by Nantucket Surveyors LLC, as modified and initialed by Rick Kotalac on June 9, 2011, attached hereto as "Exhibit A" and with the following conditions: i. The hours of operation shall be 7:00 a.m. to 6:00 p.m., Monday through Saturday, and no work on Sundays; ii. There shall be a maximum of three employees and three vehicles associated with the contractor's shop on site at any one time; iii. The Applicant shall screen the Locus as shown on the plan entitled "Proposed Site Plan 4A Marble Way in Nantucket Massachusetts," dated March 31, 2011 prepared by Nantucket Surveyors LLC, as modified and initialed by Rick Kotalac on June 9, 2011, which is on file at the Zoning Office; iv. There shall be air conditioning installed in the contractor's shop and the windows and doors in the shop shall be closed during the hours of operation; v. The Applicant shall install additional screening on the northeast border, and the driveway shall remain closed off; vi. There shall be no exterior carpentry related storage and no storage in the five foot easterly setback; vii. The five hundred (500) foot marine related storage area shall be screened or fenced; and, viii. The employees of the contractor's shop shall enter and exit the property to and from Bartlett Road, and not from Marble Way.
