NANTUCKET ZONING BOARD OF APPEALS 2 Fairgrounds Road Nantucket, Massachusetts 02554 18 Bartlett Road Parcel 982 Residential Commercial - 2 45 Old South Road Plan No. 2006-02 Book 1194, Page 48 1. At a Public Hearing of the Zoning Board of Appeals held at 1 :00 PM on Thursday, February 10, 2011, in the garage area at 2 Fairgrounds Road, Nantucket, Massachusetts, on the Application of Downeytlake Inc., as owner; Karsten Reinemo as Applicant, of PO Box 1444, Nantucket, MA 02554, Board of Appeals File No. 010-11, the Board made the following decision: 2. Applicant is requesting Special Permit relief pursuant to Nantucket Zoning Bylaw Section 139-7a (allowed uses) for light manufacturing on the Locus. The Locus is situated at 45 Old South Road, is shown on Nantucket Tax Assessor's Map 68 as Parcel 982, is shown on Plan No. 2006-02, and title is recorded at the Nantucket County Registry of Deeds in Book 1194, Page 48. The property is zoned Residential Commercial- 2. 3. Our Decision is based upon the Application and accompanying materials and representations and testimony received at our public hearing. The Planning Board has expressed their support with the condition that the access to Old South Road remain as an "exit" from the premises and that the Applicant will need to apply to the Planning Board for a second driveway cut on the Locus. There were letters in opposition to the application that were included in the file. 4. The Applicant represented himself at the hearing. The Applicant explained to the Board that he is requesting Special Permit relief in order to operate light manufacturing on the Locus. The proposed use is for a small carpentry shop and retail on the Locus. Retail is allowed by light; but, light manufacturing (small carpentry shop) requires Special Permit relief. The Applicant acknowledged the letters of opposition on file and mentioned that there is a deed restriction in place that would prevent the Applicant from conducting this sort of business. This deed restriction was the focus of one such letter. The Board and the Applicant concluded that this deed restriction is beyond the purview of the Board of Appeals and should the Applicant proceed to pursue this commercial operation, the Applicant will need to address this restriction with the abutters. 5. Therefore, based upon the foregoing, the Board finds that a grant of special permit relief for the proposed light manufacturing as allowed under Nantucket Zoning Bylaw Sections 139-7a, would be in harmony with the general purpose and intent ofthe Zoning Bylaw and consistent with similar commercial uses in the immediate neighborhood. 6. Accordingly, by UNANIMOUS vote, the Board GRANTS the requested relief by SPECIAL PERMIT pursuant to Nantucket Zoning Bylaw Section 139-7 with the following conditions: (a) The Applicant shall screen the Property line as shown on the plan entitled, "Karsten Reinemo, 45 Old South Road, Commercial Buidling," dated January 12, 2011, attached hereto as "Exhibit A"; (b) The hours of operation for commercial fabrication or manufacturing shall be not earlier than 7:00 A.M. nor later than 6:00 P.M on Monday through Friday; shall not be earlier than 7:00 A.M. nor later than 12:00 P.M. on Saturday; and there shall be no such operations on Sundays; (c) There shall be no outside storage of goods and materials; (d) When commercial fabrication or manufacturing is being done, all exterior doors and windows in the shop area shall be closed. The garage shall be equipped with air conditioning to help facilitate this requirement; and, (e) The parking and loading layout shall be in substantial compliance with the attached "Exhibit A."
