The applicant, a private membership club, uses the locus for
its beach club facilities, as described in the decisions in
Files Nos. 030-05 and 063-05. It now proposes to reconfigure
and reconstruct its parking lot and driveways, increasing the
number of spaces from 38 to 56. The stairway access from the
parking area to the beach club facilities will be reconfiqured
and improved. Part of the proposed parking area will be on
the Greenhill property, which the applicant has the right to
use pursuant to a recorded easement. The applicant therefore
requests modification of the Special Permit and Variance
relief granted in File No. 065-90 , as modified in Files Nos.
030-05 and 063-05, to approve the proposed work. Since a
portion of the parking area and driveway aisle lie within the
easement area on the Greenhill property, the applicant also
requests relief by Special Permit under Nantucket Zoning By-
law ~ 139-18.B(1) .

DECISION:
1. At a public hearing of the Nantucket Zoning Board of
Appeals, on Thursday, January 13, 2011, at 1:00 P.M., at 2
Fairgrounds Road, Nantucket, Massachusetts, the Board made the
following decision on the application of SANKATY HEAD GOLF CLUB,
INC. , for itself and for ROBERT F. GREENHILL and MARY GAYLE
GREENHILL, c/o Reade, Gullicksen, Hanley & Gifford, LLP, Post
Office Box 2669, Nantucket, Massachusetts 02584, File No. 004-
11:
2. The applicant, Sankaty Head Golf Club, Inc. (~Sankaty"),
a private membership club, uses the locus for its beach club
facilities, as described in the decisions in Board of Appeals
Files Nos. 030-05 and 063-05. These facilities are mainly upon
land owned by Sankaty, and partly upon adj acent land owned by
Robert F. Greenhill and Mary Gayle Greenhill (together,
~Greenhill"), pursuant to a recorded easement held by the Club
upon the Greenhill land. The Club proposes to reconfigure and
reconstruct its parking lot and driveways, increasing the number
of parking spaces from 38 to 56, and reconfigure and improve the
stairway access from the parking area to the beach club
facili ties. The existing layout of the beach club facilities
was approved by the Board of Appeals in the decisions in Files
Nos. 030-05 and 063-05, and accordingly the applicant requests
modification of the Special Permit and Variance relief granted
by the Board of Appeals in File No. 065-90, as modified in Files
Nos. 030-05 and 063-05, to approve the proposed work. Since a
portion of the parking area and driveway aisle lie within the

easement area on the Greenhill property, the applicant also
requests relief by Special Permit under Nantucket Zoning By-law
~139-18.B(l), for the provision of parking on other property by
easement. The Club property is situated at 18 Hoicks Hollow
Road, Assessor's Map 23, Parcel 9, and is shown upon Land Court
Plan 10070-A as Lot A. The Greenhill property is situated at 8
Hoicks Hollow Road, Assessor's Map 23, Parcel 5, and is shown
upon Land Court Plan 9314-E as Lot 1. All of the subject
property is situated in the Limited Use General-3 zoning
district.
3. Our decision is based upon the application and
accompanying materials, and representations and testimony
recei ved at our public hearing. There was no Planning Board
recommendation, on the basis that no matter of planning concern
was presented. Except for the presentation by counsel to the
applicant, there was no support nor opposition presented at the
public hearing, and no correspondence was received by the Board
of Appeals regarding this application.
4. As presented by the applicant's counsel, the applicant
desires to improve the parking lot for the beach club
aesthetically and by providing additional parking spaces, and by
improving the steps from the parking area to the beach club and
make them safer. The Greenhill property which is subject to the
easement held by the Club is already being used for a portion of
the parking lot, and this will be increased. The applicant
represents that Greenhill has approved the specific plan which
is presented with this application, with regard to the impact
upon the remainder of the Greenhill property. Other than the
technicali ty that this plan modifies the site plan previously
approved by the Board of Appeals, and increases the use of the
Greenhill property for provision of parking, there is no impact
upon zoning compliance of the locus. A site plan showing the
proposed layout of parking upon the locus, prepared by Charles
w. Hart and Associates, Inc., dated December 9, 2010, is
attached hereto in a reduced format as Exhibit A.
5. Accordingly, the Board of Appeals, by unanimous vote of
the four sitting members, found that the changes proposed by the
applicant are consistent with the terms and conditions of the
present zoning permits affecting the locus, and that the
provision of off-site parking spaces upon the easement area
within the Greenhill property will be in harmony with the
general purpose and intent of the Zoning By-law; and accordingly
voted unanimously to grant the requested relief, modifying the
si te plan approved in connection with prior decisions of the

Board of Appeals as cited above in accordance with Exhibit A,
and granting relief by Special Permit under ~139-18.B(1), for
the provision of parking on the Greenhill property by easement.
