ADDENDUM TO ZBA APPLICATION
PATRICIA WRIGHT -10 Cherrv Street - Unit 1
The Applicant, Patricia Wright, the owner of Unit 1 of the 10-1 0 ~ Cherry Street
Condominium (hereinafter the "Property"), requests Special Permit relief pursuant to ~ 139-33 A
(4) of the Nantucket Zoning By-Law, for the alteration of Unit 1 which is shown on a plan
recorded with the Nantucket Registry of Deeds in Plan File 54-B, a copy of which is filed with
the Master Deed of the 10-1 0 ~ Cheery Street Condominium dated November 18, 1998 and
recorded at the Nantucket Registry of Deeds in Book 600, Page 49, as amended by First
Amendment of Master Deed dated March 1,2006, recorded at the Nantucket Registry of Deeds
in Book 1011, Page 272. The Applicant proposes to renovate the pre-existing, non-conforming
dwelling as more fully set forth below.
The Applicant proposes to raise the existing dwelling l' -10" and install a new basement
foundation below the brick veneer. The existing height of the dwelling is 18'. The new height
of the dwelling will be 19'-10". Additionally, the Applicant proposes to move the dwelling back
away from Cherry Street from its current location by approximately 2'. This work is necessary
because when the dwelling is raised, the front door of the dwelling will need a landing and entry
step compliant with the Massachusetts Building Code, 780 CMR 8th editions. This work is also
necessary because the dwelling is currently 7" below the street level of Cherry Street. Lastly, the
Applicant proposes to demolish an existing rear "ell" of the dwelling totaling 130 s.f. and
construct a new addition totaling 180 s.f. which constitutes an addition to ground cover on the
Property of 50 s.f. The proposed new addition and basement access will be built in the buildable
part of the Property and will conform with all zoning setback and intensity requirements of the
Residential-l (R-l) zoning district. This work will be conducted in accordance with the
architectural plans prepared by Nantucket Architecture Group, Ltd., Exhibit "A" hereto and the
Certificate9f Appropriateness issued on October 1,2010, No. 55593, by the Nantucket Historic
District Commission, Exhibit "B" hereto.
The subject property is located in the Residential 1 (R-l) Zoning District. The structure
on the Property was erected between 1834 and 1848, as evidenced by the Historic Survey,
attached hereto as Exhibit "C". . The house appears in a photo of 8 Cherry Street dated circa
1880's, a copy of which is attached as Exhibit "D". The rear gable addition to the house was
added in approximately 1909 as evidenced by the Sanborne Maps dated 1909 which shows the
rear addition to the house, a copy of which is attached as Exhibit "E". Accordingly, the dwelling
is pre-existing, non-conforming as to the current intensity regulations for the R -1 zoning district.
Specifically, the R-l zoning district has a 10 foot front yard setback requirement and a 5
foot side yard setback requirement. As shown on the Site Plan prepared by Nantucket
Architecture Group, Ltd., the dwelling unit on the Premises is'located 0.72 feet from the easterly
side yard lot line and 3.06 feet from the northerly front yard lot line, a copy of said Site Plan is
attached hereto as Exhibit "F". The Property complies with the intensity regulations of the R-l
zoning district in all other respects.

As outlined above, the proposed work will be done partly within the current required 10'
front yard setback. More specifically, a total of 54 s.f. of the dwelling will be moved back
approximately 2' from the northerly front yard lot line so that it will be located 5.0' from the
front yard lot line instead of the current 3.06' from the front yard lot line. However, the
proposed new front entry step on the Premises will be erected within the current 10' front yard
setback and will be located l' from the northerly front yard lot line. The entry step totals 16 s.f.
in area so despite the fact that the entry step is getting closer to the front yard lot line than the
existing dwelling, the net result of the proposed work is that 54 s.f. of the dwelling is becoming
more conforming to the front yard setback requirement and only 16 s.f. of the proposed work
(the front entry step) is becoming more non-conforming to the front yard setback requirements.
Accordingly, there is a total net benefit of38 s.f. of the dwelling becoming more non-conforming
to the front yard setback requirements of the R -1 zoning district.
All of the other proposed work, other than raising the house, installing the new basement
foundation and installing the new front step, as set forth above, will be done in the buildable part
of the yard and outside of the zoning setback requirements of the R -1 zoning district.
Granting the proposed Special Permit will not be substantially more detrimental to the
neighborhood than the existing, non-conforming dwelling on the Property. The proposed
renovation and addition to the existing dwelling is moderate in size. The renovated dwelling will
be in harmony with other houses in this area of the island. Also, by granting the requested
Special Permit, the Board would be acting in a manner consistent with the spirit and intent of the
Zoning By-Law.
In the alternative, the Applicant requests a Variance for the above-proposed work on the
Premises pursuant to Section 139-32 due to the shape and topography of the lot and the
structures thereon such that the literal enforcement of the current 10' front yard setback and
because granting this relief does not involve substantial detriment to the public good or a
derogatiqn of the intent of the By-law.
Accordingly, the Applicants respectfully request the Board to grant the requested Special
Permit.

Charter Street
One block long, connecting Fair and Pine streets, between School and Hiller's Lane, Charter Street was opened in
1747 through the middle of Fish Lot Number 22. It was made one rod (16W) wide. The land on the north side
was owned by Damaris Coffin, who, in 1760, sold the lot at the west end to her son Micajah.1 His house, on the
comer (14 Pine), although altered, is still standing.

Chester Street
.'
A single block between Centre and North Water has retained the name of Chester Street, which originally desig-
nated the main thoroughfare from Capaum to the Great Harbor, the longest stretch of which today is called West
Chester (see below). The two come together where Centre becomes North Centre, and the eastward continuation
of Chester Street proper, beyond the intersection of North Water and Cliff Road, is called Easton Street.

1. At a public hearing of the Nantucket Zoning Board of
Appeals, on Thursday, December 9, 2010, at 1:00 P.M., at 2
Fairgrounds Road, Nantucket, Massachusetts, the Board made the
following decision on the application of PATRICIA WRIGHT, c/o
Vaughan, Dale, Hunter, Stetina, and Beaudette, PC, PO Box 659,
Nantucket, MA 02554, File No. 070-10:
2. Applicant is requesting Special Permit relief pursuant to
Nantucket Zoning Bylaw Section 139-33.A. (4) (alteration of
preexisting nonconforming structure) in order to alter the
Applicant's preexisting nonconforming structure. The Applicant
proposes to raise the existing dwelling 1'-10" and install a new
basement foundation beneath the brick veneer. The Applicant also
proposes to relocate the dwelling back from Cherry Street
approximately 2 feet. As proposed there will be a new front
entry step located approximately 1 foot from the northerly front
yard lot line. Finally, the Applicant proposes to demolish part
of the existing dwelling and construct a new addition that will
add about 50 feet of ground cover. The proposed addition will
conform to all intensity regulations on the Locus. The dwelling
is nonconforming as to front yard setback being located as close
as 3.06 feet from the front yard setback in a zoning district
that requires a 10 foot front yard setback and as close as 0.72
feet from the side yard setback in a zoning district that require
a 5 foot side yard setback. In the alternative, the Applicant is
requesting Variance relief pursuant to Nantucket Zoning Bylaw
Section 139-32 (variances) from the intensity regulations in
Section 139-16 (intensity regulations setbacks) in order to
perform the work requested. The Locus is situated at 10 Cherry

Street, Unit 1, is shown on Nantucket Tax Assessor's Map 55 as
Parcel 383.1, is shown on Plan File 54-B, and title is recorded
at the Nantucket County Registry of Deeds in Book 1238, Page 318.
The property is zoned Residential - 1.
3. Our decision is based upon the application and
accompanying materials, and representations and testimony
recei ved at our public hearing. There was no Planning Board
recommendation, on the basis that no matters of planning concern
were presented. There were no letters received in favor of or in
opposition to the application.

Attorney Jeff Stetina represented the Applicant at the
Attorney Stetina explained to the Board that the
is requesting Special Permit relief pursuant to
Zoning Bylaw Section 139-33.A. (4) for the alteration of
the 10-10 ~ Cherry Street Condominium.
Specifically, the Applicant proposes to raise the existing
dwelling 1'-10" and install a new basement foundation below the
brick veneer. The existing height of the dwelling is 18' and the
new height will be 19'-10". Additionally, the Applicant proposes
to move the dwelling back from Cherry Street from its current
location by approximately 2'. This work is necessary because
when the dwelling is raised, the front door of the dwelling will
need a landing and entry step compliant with the Building Code.
Additionally, the Applicant proposes to demolish an existing rear
"ell" of the dwelling totaling 130 square feet and construct a
new addition totaling 180 square feet. The proposed new addition
will conform to all zoning setback and intensity regulations of
the R-1 zoning district.
The structure on the Locus is nonconforming as it is located 0.72
feet from the easterly side yard lot line in a zoning district
that requires a 5 foot side yard setback and 3.06 feet from the
front yard lot line in a zoning district that requires a 10 foot
front yard setback.
However, proposed new front entry step on the Premises will be
erected within the current front yard setback and will be located
1 foot from the northerly front yard lot line.
The Board suggested to the Applicant that a crawl space to the
northerly section of the dwelling. The Board also suggested that
the Applicant receive a letter from the neighbors that
indemnifies them from any potential liability during the
construction process. The Applicant agreed to both of these
suggestions by the Board.

5. Therefore, after a discussion with Counsel for the
Applicant, the Board finds that such a Special Permit may be
granted to approve the alteration of the preexisting
nonconforming structure and to raise the structure l' -10" as
al though the brick steps will further intrude into the setback
than what presently exists, the relocation of the dwelling will
result in a net benefit as more of the structure will be outside
the setback. The Board determined that this type of alteration
would not be substantially more detrimental to the neighborhood
than the existing nonconformity on the Locus.
6. Accordingly, by a unanimous vote of the sitting Board,
the Board of Appeals made the finding that the proposed
alteration to the preexisting nonconforming structure by raising
the structure 1'-10" would not be substantially more detrimental
to the neighborhood than the existing nonconformity and allowed
the proposed alteration to the structure to be done in
substantial conformity with the plan entitled "Renovation and
Additions to 10 Cherry Street" prepared by Nantucket Architecture
Group, attached hereto as "Exhibit A" with the following
conditions:
a. There shall be no exterior construction between Memorial
Day and Labor Day of any year; and,
b. Prior to the start of construction, Staff shall receive
a letter of indemnification between the Applicant and
the direct abutters. Staff is in receipt of that
letter dated January 3, 2011.
