Weld, request Special Permit relief pursuant to Section 139-33 (33)(A)(5) or 139-33(A)(4) of the Nantucket Zoning By-Law ("By-Law"), or, alternatively a Variance under Section 139-32 for their property located at 16 Gardner Street (hereinafter "the Property"). The Property is shown on a Plan recorded in Plan Book 17, Page 79 at the Nantucket Registry of Deeds, as Parcel 16 on Tax Map 42.3.4 and is also shown on a Plan drawn by Earle & Sullivan, Inc., dated September 21, 2010, a copy of which is attached hereto as Exhibit "A ". The Property is located in the R-1 Zoning District. As shown on the Exhibit "A ", there is one dwelling on the property. As evidenced by the attached Zoning Affidavits, the dwelling existed in its current location and configuration with no material alterations since a time prior to 1972. Please see Zoning Affidavits by Majorie A. Collie dated January 20, 1998, and Francis Weld, dated October 14; 2010, attached hereto as Ezhibit "B ". The dwelling is cited as close as .2' from the southerly side yard lot line in a zoning district that requires a side yard set back of 5' and as close as 2.5' from the front yard lot line in a zoning district that requires a front yard set back of 10'. As such, the dwelling is apre-existing non-conforming structure with respect to the current intensity regulations under the By-Law. ,The applicants seek permission to demolish the small one story rear portion of the dwelling and replace it with the proposed addition. The location of the proposed addition is more clearly shown on the plot plan prepared by Earle & Sullivan, Inc., dated September 21, 2010, attached as Ezhibit "C" and on the architecture plan prepared by Rebecca Weld attached as Exhibit "D ". As shown on Exhibit "D ", the proposed addition is part one story and part two story and increases the square footage of the dwelling by ninety-three (93) square feet, an addition that is well within the allowable ground cover ratio for the locus. Exhibits "C" and "D" illustrate that a minor portion (seven (7) square feet) of the dwelling, where the two story portion of the proposed addition is located, is cited as close to 3.9' from the southerly side yard lot line, intruding into the southerly side yard set back by 1.1'. However, as Exhibit "C" shows, the proposed addition will not increase the non conforming distance of the current set back violations on the property, nor will it create any new non conformities. The area of the dwelling where the remaining one story portion of the proposed addition is located, including the additional ninety-three (93) square feet, is located fully within the buildable area of the property. A complete and detailed drawing of the proposed addition is shown on the architecture plans prepared by Rebecca Weld, dated _ June 12, 2010, attached as Exhibit "E" Under Section 139-33 (A)(5) of the By Law: Where an existing structure violates a front, rear or side line set back distance, the Board of Appeals may issue a special permit permitting the extension of the structure, pro ded that the non conforming distance is not made more non conforming and the boar of appeals finds that the extension will not be substantially more detrimental to the neighborhood. Additionally, under Section 139-33(A)(4) of the By Law: Pre-existing non-conforming structures or uses maybe extended or altered, provided that (a) no such extension or alteration shall be permitted unless there is a fmding by the _ permit granting authority or by the special permit granting authority ...that such change, extension or alteration shall not be substantially more detrimental than. the existing nonconforming use to the neighborhood, and (b) A special permit supported by such finding is granted. Accordingly, the applicants seek Special Permit relief under Section 139-33(A)(5) or 139-33(A)(4) of the By-Law to demolish the rear single story portion of the dwelling and to replace it with the proposed addition. The area of the dwelling in the southerly side yard set back where the proposed addition is located is de minimis. The proposed addition will not increase the non conforming distance of the current set back violations on the property, and the renovated dwelling will be compliant with the Zoning By-Law in all other respects. Furthermore, the proposed work will not be substantially more detrimental to the neighborhood than the existing dwelling. Applicants are requesting Special Permit relief pursuant to Nantucket Zoning Bylaw Section 139-33.A.(4) and A.(5) (alteration of preexisting nonconforming structures) in order to demolish the small one story rear portion of the dwelling and replace it with the proposed addition. The Structure is nonconforming as it is sited as close as 0.2' from the side yard setback in a zoning district that require a 5 foot side yard setback and is sited as close as 2.5' from the front yard setback in a zoning district that requires a 10 foot front yard setback. Part of the addition will be sited in the side yard setback; but, will not intrude any further into the setback than what currently exists. In the alternative, the Applicant is requesting Variance relief pursuant to Nantucket Zoning Bylaw Section 139-32 (variances) from the intensity regulations in Section 139-16 (intensity regulations - setbacks) to perform the work requested. The Locus is situated at 16 Gardner Street, is shown on Nantucket Tax Assessor's Map 42.3.4 as Parcel 116, is shown on Plan Book 17, Page 79, and title is recorded at the Nantucket County Registry of Deeds in Book 560, Page 301. The property is zoned Residential - 1. 1 3. Our decision is based upon the application and accompanying materials, and representations and testimony received at our public hearing. There was no Planning Board recommendation, on the basis that no matters of planning concern were presented. Staff had received several letters from abutters in support of the Application. 4. Therefore, after a discussion with Counsel for the Applicant, the Board finds that such a Special Permit may be granted to approve the alteration of the preexisting nonconforming structure as the alteration will not intrude into the setback any further than what presently exists. The Board determined that this type of alteration would not be substantially more detrimental to the neighborhood than the existing nonconformity on the Locus. 6. Accordingly, by a unanimous vote of the sitting Board, the Board of Appeals made the finding that the proposed alteration to the preexisting nonconforming structure would not be substantially more detrimental to the neighborhood than the existing nonconformity and allowed the proposed alteration to the structure to be done in substantial conformity with the plan entitled "Plot Plan to Accompany Zoning Board of Appeals Application for #16 Gardner St," prepared by Earle & Sullivan, Inc., dated September 21, 2010, attached hereto as "Exhibit A."
