1. At a public hearing of the Nantucket Zoning Board of
Appeals, on Thursday, November 18, 2010, at 1:00 P.M., at 2
Fairgrounds Road, Nantucket, Massachusetts, the Board made the
following decision on the application of JUDITH RUSHMORE, c/o
Chris Maury, 3 Windy Way, Nantucket, MA 02554, File No. 059-10:
2. Applicant is requesting Special Permit relief pursuant to
Nantucket Zoning Bylaw Section 139-33.A.(4) and (5) (alteration
of preexisting nonconforming structures) in order to construct an
upward addition within the footprint of the existing single-
family dwelling, which is situated approximately 2.54 feet from
the northerly side yard setback and approximately 2.92 feet from
the easterly rear yard setback in a zoning district that requires
five foot side and rear yard setbacks. The structure is also
nonconforming as to ground cover ratio, having a 38.80 ground
cover ratio in a zoning district that requires a maximum ground
cover ratio of 300. The proposed renovation will not alter the
footprint of the structure. The Locus is situated at 27 Walsh
Street, is shown on Nantucket Tax Assessor's Map 29 as Parcel 80,
is shown in Plan Book 19, Page 23 as Lot 1, and title is recorded
at the Nantucket County Registry of Deeds in Book 563, Page 313.
The property is zoned Residential - 1.
3. Our decision is based upon the application and
accompanying materials, and representations and testimony
received at our public hearing. There was no Planning Board
recommendation, on the basis that no matters of planning concern
were presented. There were no letters received in favor of or in
opposition to the application.

4. Elizabeth Maury represented the Applicant at the
hearing. Ms. Maury explained to the Board that the Applicant is
requesting Special Permit relief pursuant to Nantucket Zoning
Bylaw Section 139-33.A.(4) and (5) in order to alter the
preexisting nonconforming structure. The Applicant is requesting
relief in order to construct an upward addition within the
footprint of the existing single-family dwelling.
The structure is nonconforming as it is sited approximately 2.54
from the northerly side yard setback and 2.92 feet from the
easterly side rear yard setback in a zoning district that
requires 5 foot side and rear yard setbacks.
The structure is also nonconforming as to ground cover, having a
ground cover ratio of 38.80 in a zoning district that allows for
a maximum ground cover of 300. The proposed addition will not
affect the ground cover ratio or the setback violations.
5. Therefore, after a discussion with the Agent for the
Applicant, the Board finds that such a Special Permit may be
granted to approve the alteration of the preexisting
nonconforming structure as the alteration will not intrude into
the setback any further than what presently exists and will not
affect the ground cover ratio on the Locus. The Board determined
that this type of alteration would not be substantially more
detrimental to the neighborhood than the existing nonconformity
on the Locus.
6. Accordingly, by a unanimous vote of the sitting Board,
the Board of Appeals made the finding that the proposed
alteration to the preexisting nonconforming structure would not
be substantially more detrimental to the neighborhood than the
existing nonconformity and allowed the proposed alteration to the
structure to be done in substantial conformity with the plan
entitled "Site Plan of Land to Accompany A Notice of Intent,"
prepared by Blackwell & Associates, Inc., dated October 16, 2009,
attached hereto as ~~Exhibit A."
