D~.RCO (010-80), after due deliberation, "t-l1e Board fourrl: 1. This is an application for a Special PeITd_t to operate a restau rant without providing parking spaces and a variance fran the requirement for off-street loading facilities. The premises are located on IDvJer India street in the original Old Historic District where parking spaces were minimal curl ,,,ere not required of other restaurants. The Petitioner has indicated a willjngness to abide by the conditions which may :be imposed on this operation. 2. The property is limited to 40-foot frontage and as tP..e lot is largely coverecl hy the building, b"lere is no available loading area. Loading fran the street may be allowed subject to controls imposed by the Board of Selectmen. As the nei0hborhood is entirely ccrnner- cial in nature, the restaurant is a perroi tted use, but its operatio in this congested area should :te stricly regulated to avoid offen- sive noise, crlors, and. traffic. 3. The application for relief from parking requirements is granted and the application for relief fran the off-street loading facility is allowed subject to the follovling conditions of tDis Special Permit: a. Loading and deliveries from India Street sD.all be restric as to times set for"t-n. by the Board of Selectmen. b. The restaurant shall have no windov7S or coors facing the :Roberts House or Four Seasons Guest House. c. 'The restaurant shall D..ave no outside service area, take-ou food, nor audible music tP..at shall infringe upon the peace of the neigDfurhocrl. The above request for a Special permit and Variance was granted. with conditions by the unanirrDus vote of the Board. At a public hearing of the Nantucket Zoning Board of Appeals, on Thursday, November 18 and December 9, 2010, at 1:00 P.M., at 2 Fairgrounds Road, Nantucket, Massachusetts, the Board made the following decision on the application of DONALD E. DEMARCO, of 9 India Street, Nantucket, MA 02554, File No. 058-10: 2. Applicant is requesting Special Permit relief pursuant to Nantucket Zoning Bylaw Section 139-18.B. (2) (parking waivers) in order to waive the parking in order for the Applicant to provide outdoor seating for his restaurant located at 9 India Street. Additionally, the Applicant is requesting a Modification to condition #3 of Zoning Board of Appeals Decision No. 010-80 in order to allow an outdoor service area. The Locus is situated at 9 India Street, is shown on Nantucket Tax Assessor's Map 42.3.1 as Parcel 123, is shown in Plan Book 15, Page 87 as Lot 3, and title is recorded at the Nantucket County Registry of Deeds in Book 165, Page 49. The property is zoned Commercial Downtown. 3. Our decision is based upon the application and accompanying materials, and representations and testimony recei ved at our public hearing. There was no Planning Board recommendation, on the basis that no matters of planning concern were presented. Staff received various letters both in favor of and in opposition to the Application. 4. Attorney Bill Hunter represented the Applicant at the hearing and Mr. DeMarco was present as well. Attorney Hunter 1 stated that the Applicant is requesting Special Permit relief pursuant to Nantucket Zoning Bylaw Section 139-18.B. (2) in order to waive any additional parking necessary for the Applicant to provide outdoor seating for his restaurant located at 9 India Street. At the initial hearing, the Applicant stated that he is planning on adding 7 or 8 tables, which will result in an additional 32 spaces. The parking requirement for a restaurant in the core district is 1 space for each 8 seats. Additionally, the Applicant would be required to provide 1 parking space for each 3 employees or workers on peak shift. Depending on whether or not the Applicant believes there will need to be additional workers for the additional seating, the Applicant will be requesting a waiver of either 4 or 5 parking spaces. Additionally, the Applicant is requesting to Modify condition #3 of Decision No. 010-80 in order to allow an outside service area. The Applicant has noted that many other restaurants in the downtown have outdoor service areas. At the November 18, 2010 hearing, there were discussions between the Board, the Applicant, and the abutters regarding the concerns the abutters have. Specifically, the abutters, some of whom were represented by Counsel, stated that the increased noise from the outdoor patio area would be nuisance as the direct abutters' bedroom window is next to the patio. The Board suggested the Applicant and the neighbors attempt to come to a compromise and continue the application to the December 9th hearing. 5. At the December 9th hearing, the Applicant and his Counsel came back to the Board with a modified proposal. The Applicant stated that there would be no outdoor music, no live music outdoors, 24 seats in the outdoor seating area, no bar or bar seating area, and no customers outside past 10:30 pm on any night. The Applicant also requested that this relief be granted to the Applicant and should the Locus come under different ownership, the relief would need to be reapplied for. Attorney Keith Yankow, representing the Masters, abutters to the Locus, again requested that the Board deny the application as the noise would be a detriment to his Clients' well-being. Andrew Willauer, another abutter, suggested that the Board have a yearly review of the application to ensure all of the conditions are being met and the neighbors are satisfied. Attorney Hunter and his client agreed to this idea and also informed the Board that they would be purchasing Nantucket Regional Transportation Authority (NRTA) passes as a condition of the requested parking waiver. 2 6. Therefore, after a discussion with the Applicant, Counsel for the Applicant, and Counsel for the abutters, the Board finds that such a Special Permit may be granted to modify the existing Condition #3 of Decision No. 010-80 in order to allow for an outdoor service area. The Board also found that granting a Special Permit to waive the required parking spaces would be in harmony with the general purposes and intent of Section 139-18 of the Nantucket Zoning Bylaw and that compliance with the parking requirements would be physically impossible for the applicant to provide as the Locus is in the Commercial Downtown area. 7. Accordingly, by a unanimous vote of the sitting Board, the Board of Appeals made the finding that the proposed Modification of Decision No. 010-80 to eliminate Condition #3 and the parking waiver of 4 spaces would be in harmony with the general purposes and intent of the Zoning Bylaw pursuant to the following conditions: a. The outdoor service area shall be limited to twenty (20 seats); b. All patrons must vacate the outdoor patio area by 9:30 pm; c. An awning, with sides, must be installed that covers the entire service area; d. The Applicant shall purchase four (4) NRTA passes annually; e. Access to the outdoor patio area shall only be through the restaurant and not through the gate by the patio area; f. There shall be no bar or service bar in the outdoor patio area; g. This Special Permit shall be exclusive to Donald E. DeMarco and should the Locus change ownership, the new owner will need to reapply to the Board of Appeals; h. There shall be no take-out service in the outdoor patio area; and, i. The Applicant shall apply annually to the Board of Appeals in order to review the outdoor service area, so long as the outdoor service area is being used on the Locus.
