DECISION:
1. At a public hearing of the Nantucket Zoning Board of
Appeals, on Thursday, October 14, 2010, at 1:00 P.M., at 2
Fairgrounds Road, Nantucket, Massachusetts, the Board made the
following decision on the application of CAROL S. GEISENHEIMER,
c/o Reade, Gullicksen, Hanley, and Gifford, LLP, 6 Young's Way,
Post Office Box 2669, Nantucket, MA 02584, File No. 055-10:
2. Applicant is requesting Special Permit relief pursuant to
Nantucket Zoning Bylaw Section 139-33.A. (4) and (5) (alteration
of preexisting nonconforming structures) in order to construct an
upward addition wi thin the footprint of the existing single-
family dwelling, which is situated approximately 0.8 feet from
the northerly rear lot line and approximately 1.6 feet from the
westerly side lot line in a zoning district that requires five
foot side and rear yard setbacks. The Locus is situated at 3
Kite Hill Lane, is shown on Nantucket Tax Assessor's Map 42.4.4
as Parcel 64, is shown on Land Court Plan 15208-C as Lot C, and
is registered as Certificate of Title No. 22438 in the Nantucket
County Registry District of the Land Court. The property is
zoned Residential Old Historic.
3. Our decision is based upon the application and
accompanying materials, and representations and testimony
recei ved at our public hearing. There was no Planning Board
recommendation, on the basis that no matters of planning concern
were presented. No abutter comment was received either in favor
or in opposition to the application.

4. Attorney Arthur Reade represented
Attorney Reade explained to the Board that
requesting Special Permit relief pursuant to
Bylaw Section l39-33.A. (4) and (5) in order
upward addition wi thin the footprint of the
family dwelling.

The existing dwelling is nonconforming as to rear and side
yard setbacks, being sited approximately 0.8 feet from the rear
property line and 1.6 feet from the side property line in a
zoning district that requires 5 foot side and rear yard setbacks.
Counsel for the Applicant stated that as the scope of work
will not affect the building footprint, the proposed alteration
will not be substantially more detrimental to the neighborhood
than the existing nonconformity and therefore Special Permit
relief should be granted.
5. Therefore, after a discussion with Counsel for the
Applicant, the Board finds that such a Special Permit may be
granted to approve the alteration of the preexisting
nonconforming structure as the alteration will not affect the
building footprint on the Locus. The Board determined that this
type of alteration would not be substantially more detrimental to
the neighborhood than the existing nonconformity on the Locus.
6. Accordingly, by a unanimous vote of the sitting Board,
the Board of Appeals made the finding that the proposed
alteration to the preexisting nonconforming structure would not
be substantially more detrimental to the neighborhood than the
existing nonconformity and allowed the proposed alteration to the
structure with the following condition:

a) There shall be no exterior construction done between May
15th and September 15th of any year.
