Special permits or variance relief applying for: The pre-existing, nonconforming two-story structure is a single family dwelling on a lot of about 8,880 SF in the Residential Old Historic zoning district, where 5,000 SF is the minimum required. The dwelling has about 1,459 SF of ground cover and an ancillary garage has about 261 SF of ground cover, for a total ground cover ratio of about 19.4% where 50% is allowed. The dwelling is sited as close as 0.4 feet from the eastern/side lot line at its closest point where the minimum side yard setback is 5 feet. Further, the garage is located within a peninsula at the rear ofthe lot and is sited as close as 2.3 feet from the eastern/side lot line, as close as 1.1 feet southerly/rear lot line, and as close as 1.1 feet from the western/side lot line at its closest points, all within the 5 foot setbacks. These nonconformities pre-exist the 1972 adoption of the Nantucket Zoning By-law. The locus and structures thereon are conforming in all other respects. Applicants propose to alter and expand the dwelling including the portion currently within the side setback by adding about 315 SF of ground cover and other changes, as per the attached plans. The proposed alterations and expansion would not be closer to the easterly side lot line than the existing structure. The front portion of the dwelling will have little or no alteration, and will not be removed from its foundation. No alteration to the non-conforming garage is proposed. Accordingly, Applicants request relief by Special Permit under Nantucket Zoning Bylaw Section 139-33.A (4) for the alteration of a pre-existing nonconforming structure where the change is not substantially more detrimental to the neighborhood than the existing nonconformities. (4) (alteration of preexisting nonconforming structures) to alter and expand the preexisting, nonconforming dwelling by constructing an addition, a portion of which will be wi thin the easterly side lot line. The existing dwelling is sited as close as 0.4 from the easterly side yard lot line in a zoning district that requires a five foot side yard setback. The proposed alterations will not be closer to the easterly side lot line than the existing structure. The Locus is situated at 34 India Street, is shown on Nantucket Tax Assessor's Map 42.3.4 as Parcel 151, is shown in Plan Book 9, Page 39, and title is recorded at the Nantucket County Registry of Deeds in Book 1016, Page 233. The property is zoned Residential Old Historic. 3. Our decision is based upon the application and accompanying materials, and representations and testimony recei ved at our public hearing. There was no Planning Board recommendation, on the basis that no matters of planning concern were presented. No abutter comment was received either in favor or in opposition to the application. 1 4. Attorney Arthur Reade represented the Applicant. Attorney Reade explained to the Board that the Applicants are requesting Special Permit relief pursuant to Nantucket Zoning Bylaw Section 139-33.A. (4) in order to alter and expand the preexisting, nonconforming dwelling on the Locus. The dwelling is nonconforming as it is sited as close to 0.4 feet from the easterly side yard lot line in a zoning district where a 5 foot side yard setback is required. Further, the garage is located within a peninsula at the rear of the lot and is sited as close as 2.3 feet from the easterly side lot line and as close as 1.1 feet from the southerly rear yard lot line and 1.1 feet from the westerly side lot line at its closest points in a zoning district that requires a 5 foot side yard setback. Attorney Reade stated that the Applicants propose to alter and expand the dwelling including a portion currently within the side yard setback by adding about 315 square feet of ground cover. Of the 315 square feet, only a portion of this is sited within the setback. The proposed alterations and expansions would not be closer to the easterly side lot line than the existing structure. The front portion of the dwelling will have little or no alteration and will not be removed from its foundation. No alteration to the garage is proposed. 5. Therefore, after a discussion with Counsel for the Applicant, the Board finds that such a Special Permit may be granted to approve the alteration of the preexisting nonconforming structure as the alteration will not intrude any further into the easterly setback than the existing setback violation on the Locus. The Board determined that this type of al teration would not be substantially more detrimental to the neighborhood than the existing nonconformity on the Locus. 6. Accordingly, by a unanimous vote of the sitting Board, the Board of Appeals made the finding that the proposed alteration to the preexisting nonconforming structure would not be substantially more detrimental to the neighborhood than the existing nonconformity and allowed the proposed alteration to the structure with the conditions: a) That all work shall be done in substantial conformity with the plan entitled "Building Location Plan in Nantucket, MAli , prepared by Charles W.
