his matter before the Board)
10 foot front yard setback. The Premises is conforming as to separation with the
Primary and Secondary Dwellings separated by more than the required twelve
scalar (12') feet.
The proposed addition to the Primary Dwelling of a duplicate ofthe
original front porch acts to enhance the sense of historic streetscape for Pleasant
Street and is in keeping with other dwellings similarly sited upon their lots in this
neighborhood and therefore is not substantially more detrimental to the
neighborhood.
By granting the SPECIAL PERMIT, the Board will be acting in a manner
consistent with the spirit and intent of Section 139-33A of the By-Law. In the
alternative and to the extent one may be necessary or required, the Applicant
requests a V ARIANCE for the proposed work.
The Applicants respectfully request that the Board vote in favor of the
requested SPECIAL PERMIT.

Historical note
The Sanborn Map@ Collection consists of a uniform series of large-scale detailed maps depicting the
commercial, industrial, and residential sections of cities. The maps were designed by surveyor D.A. Sanborn in
1866 to assist fire insurance agents in determining the degree of hazard associated with a particular property.
Sanborn Maps@ illustrate in outline form the site, size, shape, construction and building material of dwellings,
commercial buildings, and factories. Details of buildings include fire walls, the location and number of windows
and doors, style and composition of roofs, wall thickness, cracks in exterior walls, and makes of elevators. The
maps also indicate building use, sidewalk and street widths, layout and names, property boundaries, distance
between buildings, house and block numbers, location of water mains, hydrants, piping, wells, cisterns, and
fuel storage tanks. .

Dear John:
Phelan Brothers, LLC, owner of the above referenced property, seeks a SPECIAL
PERMIT and FINDING pursuant to Section 139-33(4)(a) and (b) and Section 139-33(5) of the
Nantucket Zoning By-Law. The applicant proposes to extend a pre-existing, nonconforming

DECISION:
1. At a public hearing of the Nantucket Zoning Board of
Appeals, on Thursday, September 9, 2010, at 1:00 P.M., at 2
Fairgrounds Road, Nantucket, Massachusetts, the Board made the
following decision on the application of 65 PLEASANT STREET, LLC,
F/K/A PHELAN BROTHERS, LLC, A NEW YORK COMPANY, c/o Vaughan,
Dale, Hunter, Stetina, and Beaudette, P.C., PO Box 659,
Nantucket, MA 02554, File No. 052-10:
2. Applicants are requesting Special Permit relief
pursuant to Nantucket Zoning Bylaw Section 139-33.A(4) (a) and (b)
(alteration of preexisting, nonconforming structures) and Section
139-33.A. (5) (extension of preexisting, nonconforming structures)
in order to extend a preexisting front yard setback intrusion
while not making the nonconforming distance more nonconforming.
The existing front yard setback violation consists of a
preexisting front porch and stairs. The Applicant proposes to
remove the existing porch and construct a front porch running
across the distance of the front elevation of the dwelling but
not extending further into the front yard setback than the
existing front porch. Other than the preexisting front yard
setback violation, the locus is otherwise conforming to the
intensi ty regulations of the Zoning Bylaw. The site is located
at 65 Pleasant Street, is shown on Nantucket Tax Assessor's Map
55 as Parcel 36.2, and title is recorded at the Nantucket County
Registry of Deeds in Book 696, Page 330. The property is zoned
Residential - 1.

3. Our decision is based upon the application and
accompanying materials, and representations and testimony
recei ved at our public hearing. There was no Planning Board
recommendation, on the basis that no matters of planning concern
were presented. One abutter spoke in favor of the application at
the hearing.
4. Attorney Bill Hunter represented the Applicant.
Attorney Hunter explained to the Board that the Applicant is
requesting Special Permit relief pursuant to Nantucket Zoning
Bylaw Sections 139-33.A. (4) (a) and (b) and 139-33.A. (5) in order
to extend a preexisting front yard setback intrusion while not
making the nonconforming distance more nonconforming.
Attorney Hunter presented photographs to the Board that showed
that at one time there was a historic porch sited where the new
porch is proposed to be located. Attorney Hunter further stated
that the existing setback violation consists of a preexisting
front porch and stairs and the Applicant proposes to remove said
porch and construct in its place a historically accurate front
porch running across the distance of the front elevation of the
dwelling but not extending further into the front yard setback
than the existing front porch.
The primary dwelling on the Locus is nonconforming as to front
yard setback having a front porch located approximately 7.4 feet
from the front property line in a zoning district that requires a
10 foot front yard setback. The Locus is otherwise conforming to
the intensity regulations of the Zoning Bylaw.
5. Therefore, after a discussion with the Applicant and
Counsel for the Applicant, the Board finds that such a Special
Permit may be granted to approve the alteration of the
preexisting nonconforming structure as the proposed porch will
not intrude any further into the front yard setback than the
existing front yard setback violation on the Locus. The Board
determined that this type of alteration would not be
substantially more detrimental to the neighborhood than the
existing nonconformity on the Locus.
6. Accordingly, by a unanimous vote of the sitting Board,
the Board of Appeals made the finding that the proposed
alteration to the preexisting nonconforming structure would not
be substantially more detrimental to the neighborhood than the
existing nonconformity and allowed the proposed alteration to the
structure with the conditions:

a) That that no further construction of structures, nor
additions to the existing structure, shall take place
without further relief by the Board of Appeals, as shown
on the plan entitled "Building Location Plan in
Nantucket, MA", prepared by Charles W. Hart and
Associates, Inc., dated August 3, 2010;
b) There shall be no exterior construction done between
Memorial Day and Labor Day of any year; and,
c) That the Applicant shall ensure that the siting of the
front step of the new porch will be verified by a
licensed surveyor to insure that upon construction it
comes no closer to the front yard property line than the
front step of the current pre-existing non-conforming
stoop.
