The applicant requests a Special Permit under Nantucket
Zoning By-law §139-16.C(2), in order to obtain relief from
the side yard setback requirement (10 feet in this Limited
Use General-1 zoning district) with respect to the existing
structures upon locus. The principal dwelling, formerly a
garage/greenhouse and converted to use as a dwelling in
1974, is sited with a setback of about 9.7 feet from the
southwesterly side lot line at the closest point. The
secondary dwelling was constructed in 1980 as a garage and
converted to use as a dwelling in 1984, and is sited with a
setback of about 8.0 feet from the northeasterly side lot
line at the closets point. Under X139-16.C(2), the Board
of Appeals is empowered to grant a special permit to
validate unintentional setback intrusions not greater than
five feet into a required yard and not closer than four
feet to a lot line. (The requirement that the siting have
been based upon a licensed survey is inapplicable, since
the siting of both structures took place before 1990.)

DECISION:
1. At a public hearing of the Nantucket Zoning Board of
Appeals, on Thursday, August 12, 2010, at 1:00 P.M., at 2
Fairgrounds Road, Nantucket, Massachusetts, the Board made the
following decision on the application of C. WILLIAM RICH, JR.,
c/o Reade, Gullicksen, Hanley, and Gifford, L.L.P., 6 Young's
Way, Post Office Box 2669, Nantucket, MA 02584, File No. 046-10:
2. Applicant is requesting Special Permit relief pursuant
to Nantucket Zoning Bylaw Section 139-16.C(2) (unintentional
setback intrusion) in order to validate the existing structures
on the locus. The main dwelling is sited as close as 9.7 feet
from the southwesterly lot line in a zoning district that
requires a ten (10) foot side yard setback. The secondary
dwelling is sited as close as 8.0 feet from the northeasterly
side yard setback in a zoning district that requires a ten (10)
foot side yard setback. The structures and locus are otherwise
conforming to the intensity regulations of the Zoning Bylaw. The
site is located at 11 Brewster Road, is shown on Nantucket Tax
Assessor's Map 54 as Parcel 224, is shown as Lot 105 on Land
Court Plan 10937-5, and is registered as Certificate of Title No.
10538 at the Nantucket County Registry District of the Land
Court. The site is zoned Limited Use General - 1.
3. Our decision is based upon the application and
accompanying materials, and representations and testimony
received at our public hearing. There was no Planning Board
recommendation, on the basis that no matters of planning concern
were presented. No abutter comment was received either in favor
or in opposition to the application.

4. Attorney Whitney Gifford represented the Applicant.
Attorney Gifford explained to the Board that the Applicant is
requesting Special Permit relief pursuant to Nantucket Zoning
Bylaw Section 139-16.C(2) (unintentional setback intrusion) in
order to validate the existing structure on the Locus.
Attorney Gifford stated that the principal dwelling, formerly a
garage/greenhouse which was converted to a dwelling in 1974, is
sited approximately 9.7 feet from the southwesterly side lot line
in a zoning district that requires a 10 foot side yard setback.
The secondary dwelling was constructed in 1980 as a garage and
was converted to be used as a dwelling in 1984 and is sited
approximately 8 feet from the northeasterly side yard setback in
a zoning district that requires a 10 foot side yard setback.
5. Therefore, after a discussion with the Applicant and
Counsel for the Applicant, the Board finds that such a Special
Permit may be granted to validate the unintentional setback
intrusion as the intrusion is not greater than 5 feet into a
required yard and not closer than four feet from a lot line and
that the burden of correcting said intrusion substantially
outweighs any benefit to an abutter of eliminating said
intrusion.
6. Accordingly, by a unanimous vote of the sitting Board,
the Board of Appeals made the finding that the burden of
correcting the two setback intrusions on the locus substantially
outweighs any benefit to an abutter of eliminating said
intrusions and subsequently validated main dwelling sited as
close as 9.7 feet from the southwesterly lot line and the
secondary dwelling sited as close as 8.0 feet from the
northeasterly side yard setback with the condition that no
further construction of structures, nor additions to the existing
structure, shall take place without further relief by the Board
of Appeals, as shown on the plan entitled "Building Location Plan
in Nantucket, MA", prepared by Charles W. Hart and Associates,
Inc., dated June 30, 2010.
