DECISION:
1, At a public hearing of the Nantucket Zoning Board of
Appeals, on Thursday, August 12, 2010, at 1:00 P.M., in the
Conference Room at 2 Fairgrounds Road, Nantucket, Massachusetts,
the Board made the following decision on the application of
BRENDA LEE HALL, TRUSTEE OF ANTHEM TRUST of 33 Vesper Lane,
Nantucket, MA 02554, File No. 044-10:
2. Applicant is requesting Variance relief pursuant to
Nantucket Zoning Bylaw Section 139-32 (variances) from the
intensity regulations in Section 139-16 (setbacks) in order to
allow steps to be sited in the easterly setback, Said steps are
as close as 2.375 feet from the easterly side yard setback in a
zoning district that requires a five (5) foot side yard setback.
The site is located at 33 Vesper Lane, is shown on Nantucket Tax
Assessor's Map 55 as Parcel 126 and 126,1, is shown on Plan File
No. 2008-6, and title is recorded at the Nantucket County
Registry of Deeds in Book 1015, Page 186. The site is zoned
Residential - 1,
3, Our decision is based upon the application and
accompanying materials, and representations and testimony
received from the applicant at our public hearing. The Planning
Board recommendation was that this matter was not of planning
concern. Staff received one letter in support of the
application. There were no letters in opposition to the
application.
4. At the hearing, Brenda Lee Hall represented herself. Ms.
Hall explained to the Board that this application is identical to
ZBA Application No. 008-10. Application No. 008-10 was withdrawn
due to the resignation of one of the sitting Board members. In
the present instance, the Applicant is requesting Variance relief
pursuant to Nantucket Zoning Bylaw Section 139-32 (variances)
from the intensity regulations in Section 139-16 (side yard
setback) to be allowed to site a step as close as 2.375 feet to
the side yard setback in a zoning district that requires a five
(5) foot side yard setback, Ms, Hall explained to the Board that
due to the siting of the house and the location of a side door,
the steps intruding into the setback are necessary.
Staff has received a letter of support from the abutter directly
to the east of the steps - the abutter who would be most affected
by the intrusion,
Ms, Hall presented approved HOC drawings to the Board showing the
exact location of the steps and how far into the setback they
would intrude,
5. After due deliberations on the hearing, the Board finds
that owing to the circumstances relating to the soil conditions,
shape or topography of such land or structures and especially
affecting such land or structures but not affecting generally the
zoning district in which it is located, a literal enforcement of
the provisions of this chapter would involve substantial
hardship, financial or otherwise, to the applicant, and that
desirable relief may be granted without substantial detriment to
the public good and without nullifying or substantially
derogating from the intent or purpose of such bylaw.
Specifically, due to the siting of the structure and the location
of the side door, the Board found that Variance relief would be
appropriate in this instance.

6. By a vote of FOUR in favor and ONE (Toole) opposed, the
Board votes to grant the requested Variance to allow for the
construction of steps in the side yard setback to be as close as
2 feet, 4.5 inches as shown on the plan entitled "Site and Floor
Plan," prepared by BPC Architecture, dated July 9, 2010, and
attached hereto as "Exhibit A."
