ADDENDUM "A"
The Owner/Applicant David W. Fox, Jr., Trustee of the David W. Fox Jr. 2002 Trust
("Fox") asks the Nantucket Board of Appeals ("Board") to grant him a Special Permit pursuant
to Section 139-33A (4) of the By-Law to allow for the alteration and reconstruction of the pre-
existing and non-conforming primary dwelling and the preexisting and non-conforming "Bunk
House" on his 2 Lincoln Avenue property ("Property") resulting in a reduction of aggregate
ground cover, a reduction in set-back non-conformities and the incorporation fthe garage into
the "Bunk House". In addition, Fox asks the Board for Minor Site Plan Review approval for the
project pursuant to Section 139-23E(2) of the By-Law.
The Property is located at 2 Lincoln Avenue and is shown as Parcel 30 on Tax Assessor's
Map 249. The Property is located in the Residential-1 ("R -1") Zoning District and has an area of
1 0,48 Ii: square feet. The Property has 90.5i: feet of frontage on Lincoln Avenue, aggregate
ground cover of3,319i: square feet (31.7%) and a front yard set back of6.1i: feet. The minimum
lot size requirement in the R-1 Zoning District is 5,000 square feet, the minimum frontage
requirement is 50 feet, the maximum allowable ground cover ratio is 30% and the minimum
front yard set back distance is 10 feet. In addition, the existing primary dwelling is located 3.8i:
feet from the easterly side lot line, at its closest point, 4.5i: feet from the westerly side lot line, at
its closest point, and 2.7 feet from the rear lot line, at its closest point. The Bunk House on the
rear of the Property is located 1.8 feet from the easterly side lot line, at its closest point, 1.3 feet
from the westerly side lot line, at its closest point, and 1.4 feet from the rear lot line, at its closest
point. The minimum side and rear set back distance in the R -1 Zoning District is 5 feet.
The Property is non-conforming as to ground cover; the existing ground cover is 31.7%
and a maximum ground cover of 30% is allowable. The Property is also non-conforming as to

front yard set back requirements; the front steps are 6.1 feet from Lincoln Avenue and a
minimum front yard setback of 10 feet is required. The primary dwelling and bunk house are
also non-conforming as to minimum side and rear set back requirements as set forth above and
shown on the submitted Existing Conditions Plan prepared by Blackwell & Associates, Inc. for
David W. Fox, Jr. 2002 Trust dated May 13, 2010 ("Existing Conditions Plan").
Fox intends to reconstruct the primary dwelling and bunk house on the Property which
will result in the reduction of aggregate ground cover from 3,319i: square feet (31.7%) to 3,222i:
square feet (30.7%), a reduction of 81i: square feet. In addition, Fox intends to increase the
westerly side line setback distance to the primary dwelling from 4.5 feet to 6.7 feet, thereby
eliminating this non-conformity; to increase the easterly side yard set back distance to the
primary dwelling from 3.8 feet to 4.8 feet, thereby reducing this non-conformity; to eliminate the
rear yard set back non-conformity for the primary dwelling by increasing the distance from 2.7
feet to 6.8 feet; and to eliminate the easterly side yard set back non-conformity for the Bunk
House by increasing the set back distance from 1.8 feet to 11.2 feet, all as shown on the
Proposed Conditions Site Plan prepared by Blackwell & Associates, Inc. for David W. Fox, Jr.
2002 Trust dated May 13, 2010 ("Proposed Conditions Plan").
In addition, Fox intends to convert the eastern side of the Bunk House to an enclosed
garage which provides the required off-street parking space for the primary dwelling in
accordance with Section 139-18D of the By-Law. This garage parking space will comply with
the minimal dimensions for one required parking space set forth in Section 139-18A3 which
provides:
"One required parking space per lot may be reduced to a minimum dimension of
seven feet in width and 17 feet in length."

The existing primary dwelling and Bunk House on the Property are pre-existing, non-
conforming structures which pre-date the enactment of the Nantucket Zoning By-Law on July 1,
1972 as evidenced by a Deed for the Property from Elizabeth P. Wynegar to Bert N. Honea and
Mary E. Honea dated August 29, 1960 and recorded in Book 120, Page 312 at the Nantucket
Registry of Deeds which provides, in pertinent part, that the Property includes". .. the dwelling
house and all other buildings thereon, at North Shore near the Cliff and being Lots 42, 43 and 44
on a Plan of Nantucket Bluffs recorded in Nantucket Deeds Book 62, Page 80 ..."
This residential project will enhance the Property and the Lincoln Circle neighborhood,
will eliminate and/or reduce zoning non-conformities affecting the Property and will not be
substantially more detrimental to the neighborhood than the existing structures on the Property.
Fox asks the Board to grant the requested Special Permit Reliefpursuant to Section 139-33A(4)
of the By-Law, Minor Site Plan Review Approval pursuant to Section 139-23E(2) of the By-
Law, and for whatever additional zoning reliefthe Board deems just and proper.

Permit Application packets, two (2) separate sets of address mailing labels, and a

DECISION:
1. At a public hearing of the Nantucket Zoning Board of
Appeals, on Thursday,. July 8, 2010, at 1:00 P.M., at 2
Fairgrounds Road, Nantucket, Massachusetts, the Board made the
following decision on the application of DAVID W. FOX, Jr.,
TRUSTEE OF THE DAVID W. FOX JR. 2002 TRUST, c/o Vaughan, Dale,
Hunter, Stetina, and Beaudette, PC, PO Box 659, Nantucket,
Massachusetts 02554, File No. 041-10:
2. Applicant is requesting Special Permit relief pursuant
to Nantucket Zoning Bylaw Section 139-33.A. (alteration of
preexisting, nonconforming structure) in order to reconstruct the
primary dwelling and Bunk House on the Locus. The Locus is
nonconforming to the following intensi t'y regulations: to maximum
allowable ground cover, having a ground cover ratio of 31.7% in a
zoning district with a maximum ground cover ratio of 30%; to
front yard setback, having a structure sited as close as 6.1 ~
feet from the front yard setback in a zoning district that
require a 10 foot front yard setback; and to side and rear yard
setbacks having the primary dwelling sited as close as 3.8 ~ feet
from the easterly side lot line, as close as 4.5 + feet the
westerly side lot line, and 2.7 ~ feet from the rear lot line and
a Bunk House sited as close as 1.8 ~ feet from the easterly lot
line, 1.3 ~ feet from the westerly side lot line, and 1.4 ~ feet
from the rear yard lot line in a zoning district that require a 5

foot side and rear yard setback. The Applicant proposes to
reconstruct the primary dwelling and Bunk House on the Locus
which will result in a reduction of the ground cover ratio to
30.7%. Additionally, the Applicant proposes to increase the
westerly side yard setback from 4.5 feet to 6.7 feet, to increase
the easterly side yard setback distance from 3.8 feet to 4.8
feet, to increase the rear yard setback from 2. 7 feet to 6.8
feet, and to eliminate the easterly side yard setback non-
conformity by increasing the setback distance from 1.8 feet to
11.2 feet. Finally, the Applicant intends to convert the eastern
side of the Bunk House to an enclosed garage. In addition, the
Applicant is requesting Minor Site Plan Review approval pursuant
to Nantucket Zoning Bylaw Section 139-23E (2) (site plan review).
The site is located at 2 Lincoln Ave, is shown on Nantucket Tax
Assessor's Map 30 as Parcel 249, is shown as Lots 42, 43, 44 in
Book 62, Page 80 at the Nantucket Registry of Deeds, is shown as
Lot 2 on Land Court Plan No. 33167-B and Lot 13 in Book 71, Page
350, and is registered as Certificate of Title No. 23419 at the
Nantucket County Registry District of the Land Court, and title
is recorded at the Nantucket County Registry of Deeds in Book
1209, Page 160. The site is zoned Residential - 1.
3. Our decision is based upon the application and
accompanying materials, and representations and testimony
recei ved at our public hearing. There was no Planning Board
recommendation, on the basis that no matters of planning concern
were presented. There were no letters of support or opposition
to the application.
4. At the hearing, Counsel for the Applicant informed the
Board that the Applicant is requesting Special Permit relief
pursuant to Nantucket Zoning Bylaw Section 139-33.A. (4)
(alteration of preexisting, nonconforming structure) to allow for
the alteration and reconstruction of the preexisting and
nonconforming primary dwelling and the preexisting nonconforming
"Bunk House" on the locus. Counsel stated that this application
will result in a reduction of aggregate ground cover, a reduction
in setback nonconformities, and the incorporation of the garage
into the "Bunk House." In addition to relief pursuant to
Nantucket Zoning Bylaw Section 139-33.A, the Applicant is also
requesting Minor Site Plan Review approval pursuant to Section
139-23.E.2) of the Bylaw.
Counsel stated that the property is presently nonconforming as to
aggregate ground cover ratio (31% in a zoning district with a
maximum ground cover of 30%) and a front yard setback of 6.1 feet
in a zoning district that requires a 10 foot front yard setback.
Additionally, the existing primary dwelling is located 3.8 feet
from the easterly side lot line, at its closest point; 4.5 feet

from the westerly side lot line, at its closest point; and 2.7
feet from the rear lot line, at its closest point. The side and
rear yard setbacks in this zoning district are 5 feet. The Bunk
House at the rear of the property is located 1.8 feet from the
easterly side lot line, at its closest point; 1.3 feet from the
westerly side lot line, at its closest point; and 1.4 feet from
the rear lot line, at its closest point.
Counsel described the work detail by informing the Board that the
Applicant intends to reconstruct the primary dwelling and Bunk
House on the locus which will result in the reduction of
aggregate ground cover ratio from 31.7% to 30.7% (a reduction of
81 square feet). In addition, the Applicant intends to increase
the westerly side line setback to the primary dwelling from 4.5
feet to 6. 7 feet, thereby eliminating this nonconformity; to
increase the easterly side yard setback distance to the primary
dwelling from 3.8 feet to 4.8 feet, thereby reducing this
nonconformity; to eliminate the rear yard setback nonconformity
for the primary dwelling by increasing the distance from 2.7 feet
to 6.8 feet; and to eliminate the easterly side yard setback
nonconformity for the Bunk House by increasing the setback
distance from 1.8 feet to 11.2 feet. In turn, the Applicant
intends to convert the eastern side of the Bunk House to an
enclosed garage that will comply with the parking requirements of
the Bylaw.
Counsel for the Applicant argued to the Board that these
al terations would result in the property becoming less
nonconforming and relief should be granted as this alteration
will not be substantially more detrimental to the neighborhood
than the existing nonconformities.
5. Accordingly, by a vote of FOUR in favor and ONE opposed
(Koseatac opposed), the Board of Appeals made the finding that
the alteration of the pre-existing, nonconforming single-family
dwelling and "Bunk House" upon the locus as proposed would not be
substantially more detrimental to the neighborhood than the
existing conditions and that Minor Site Plan Review approval
would be appropriate pursuant to Nantucket Zoning Bylaw Section
139-23E(2), and therefore granted the requested relief by Special
Permit, subject to the following conditions:
(a) The alterations shall be constructed in
substantial conformity to Nantucket Historic District Commission
Certificate of Appropriateness Nos. 54893, 55076, and 55104, as
may be amended from time to time; and,
(b) The work shall be completed in substantial
conformity to the site plan entitled, " Proposed Conditions Site
Plan to Accompany Zoning Board of Appeals Application in

Nantucket Mass," dated July 20, 2010, prepared by Blackwell and
Associates, Inc., attached hereto as "Exhibit A."
