DECISION:
1. At a public hearing of the Nantucket Zoning Board of
Appeals, on Thursday, July 8, 2010, at 1:00 P.M., at 2
Fairgrounds Road, Nantucket, Massachusetts, the Board made the
following decision on the application of DONALD DIMOCK of 44
Bartlett Road, Nantucket, MA 02554, File No. 040-10:
2. Applicant is requesting Special Permit relief pursuant
to Nantucket Zoning Bylaw Section 139-30 (special permits) to be
allowed to construct a standalone storage structure as allowed in
Section 139-7. A. (allowed uses). The site is located at 54
Bartlett Road, is shown on Nantucket Tax Assessor's Map 66 as
Parcel 100, is shown on Plan File No. 2009-37, and title is
recorded in the Nantucket County Registry of Deeds in Book 146,
Page 123. The site is zoned Residential Commercial - 2.
3. Our decision is based upon the application and
accompanying materials, and representations and testimony
recei ved at our public hearing. There was no Planning Board
recommendation, on the basis that no matters of planning concern
were presented. No abutter comment was received either in favor
or in opposition to the application.
4. Donald Bracken represented the Applicant at the
hearing. Mr. Bracken explained to the Board that the Applicant
is requesting Special Permit relief pursuant to Nantucket Zoning
Bylaw Section 139-30 (special permits) to be allowed to construct

a standalone storage structure as is allowed in Section 139-7.A.
The original proposal for the structure triggered the Major
Commercial Development standards of the zoning bylaw as the
original proposed storage structure was to be 5000 square feet.
After discussion with the Board and the Applicant, it was
determined that the Applicant would revise his plan to show the
storage structure being approximately 4990 square feet and show
fi ve (5) parking spaces. By doing so, the Maj or Commercial
Development bylaw would not be applicable to the Applicant's
proposal and relief could subsequently be granted by the Board of
Appeals.
5. Therefore, after a discussion with the Applicant and
the Agent for the Applicant, the Board finds that such a Special
Permit may be granted to approve the construction of said storage
structure, with the proposed modifications to reduce the size of
the structure to 4990 square feet and to show the five (5)
parking spaces, in the Residential Commercial - 2 zoning district
and that such a Special Permit is in harmony with the general
purpose and intent of the zoning bylaw as this is an allowable
use in this zoning district subject to approval from the Board of
Appeals.
6. Accordingly, by a unanimous vote of the sitting Board,
the Board of Appeals made the finding that the proposed storage
structure would be in harmony with the general purpose and intent
of the zoning bylaw subject to the following conditions:
a) That said storage structure shall be approximately 4990
square feet and will be constructed as shown on the plan
enti tIed "Outdoor Storage Area Site Plan in Nantucket,
MA", prepared by Bracken Engineering, Inc., dated May 5,
2010 attached hereto as "Exhibit A";
b) There shall be five (5) parking spaces on the locus; and,
c) The Applicant
