ADDENDUM TO ZBA APPLICATION
ABREM QUARY OWNERS ASSOCIATION TRUST
ABREM QUARY OWNERS ASSOCIATION TRUST U/D/T DATED September 26,
2007 and recorded in Book 1105, Page 3 at the Nantucket Registry of Deeds (hereinafter "Abrem
Quary") seeks a Modification to Comprehensive Permit No. 066-00, granted by the Board, dated
April 27, 2001, recorded at the Nantucket Registry of Deeds in Book 1057, Page 271, by adding
to Exhibit "A" for the Exhibit of record, "Other" The Applicant requests an exception and waiver
from ~120-6 Sewer Privilege Fee with regard to connection to the Town sewer system, including
Article 56 approved at the September 3, 2004 Town Meeting which created a new sewer district
and increased sewer connection fees as they apply to this project.
The Developer, Nantucket Homes For People, Inc., could not have requested this
exception or waiver in its original permit, The Compass Rose Development (aJk/a Abrem Quary)
Comprehensive Permit (the "Permit"), which was filed with the Nantucket Town Clerk on April 27, 2001.
At that time, the Sewer Privilege Fee set forth in Warrant Article 56 at the April, 2004 Town Meeting,
had not been approved and ~120-6 did not exist in the Town by-laws. The Permit pre-dates the
enactment of the Sewer Privilege Fee. Pursuant to Paragraph 14 of the Permit, Nantucket Homes for
People was granted permission to install and connect to the Nantucket Sanitary Sewer System. No sewer
privilege fee is included or implied in this paragraph. The Abrem Quary Permit was appealed and was
not final until December, 2006. In 2007, the Developer requested sewer pennits for the 28 single-family
dwelling units pennitted in the 2001 Comprehensive Pennit. All of the 28 homes in the Abrem Quary
40B subdivision have subsequently been individually assessed a Privilege Fee of$6,322.15 per home.
The Rugged Scott 40B also has a Comprehensive Permit filed February, 2006 and was granted an
exception by the Zoning Board of Appeals waiving the Sewer Privilege Fees. If the Abrem Quary Permit
was issued after the enactment of the Sewer Privilege Fee in 2004, it is unquestionable that Abrem Quary,
like Rugged Scott, would have asked the Board for a waiver of the fee based on its 40B status.
Furthermore, Abrem Quary is comprised of 28 year-round residents. In these circumstances, it is fair and
equitable that the Abrem Quary owners, like Rugged Scott owners, be exempt from the Sewer Privilege
Fee.
The Sewer Privilege Fee imposes an undue financial hardship on both neighborhoods of year-
round residents who qualified for an opportunity to purchase a home under 40B fmancial guidelines.
The Abrem Quary Homeowners Association attended a Selectmen's meeting to request a waiver
of the fee on April 14, 2010. At that meeting, Town Counsel opined that a waiver ofthe fee would fall
under the jurisdiction of the Zoning Board of Appeals as a Modification to the original Comprehensive
Permit.
Accordingly, the Abrem Quary homeowners respectfully request the Board grant this
Modification, waive the Sewer Privilege Fee for each homeowner and grant the Abrem Quary
homeowners an exception in their Comprehensive Permit which provides as follows:
"The Homeowners in the Abrem Quary 40B Subdivision are exempt from
any Town by-law or regulation relative to local decision-making with
regard to connection to the Town sewer system, including Warrant Article
56 approved at the April 2004 Town Meeting creating a new sewer district
and any increased sewer connection fees as they may apply to this
project."
In the alternative, the Abrem Quary homeowners respectfully request the Board grant a
Waiver of the Sewer Privilege Fees for all of the homes in their 40B subdivision.

The Town of Nantucket ("Town"), acting by and through its duly elected and now serving members of its
Board of Selectmen, having the powers of the Sewer Commissioners and acting pursuant to the authority
of St. 2008, c. 396, ~ 8, G. L. c. 83, ~ 17 and the Town's vote on Article 4 at the Town's April 12, 2005
Special Town Meeting, having complied with all the preliminary requirements prescribed by law, having
determined the cost of the improvements to the Surfside wastewater treatment facility and its aPmlrtenant
equipment, fixtures and facilities (the "Surfside Sewer System"), which improvemeq~ includ6=>among

To see if the Town will vote to adopt the sewer districts having the metes and bounds, area and
territory having the capacity and other parameters as is set forth in a Plan on file with the office of the Board
of Selectmen, or to take any other action with respect thereto.

FINANCE COMMITTEE MOTION: Moved that Chapter 41 (Board of Sewer Commissioners) of the
Code of the Town of Nantucket, is hereby amended as follows (NOTE: new language is shown as
highlighted text; language to be deleted is shown by strikeout; these methods to denote changes
are not meant to become part of the final text):
Add a new Section 41-3, as follows:
S 41-3.
Sewer Districts.
The Board of Sewer Commissioners is authorized to layout, construct, maintain and
operate a system or systems of common sewers and main drains in public or private
ways for a part of the Town as set forth below for the public convenience or the public
health with such connections and other works as may be required for a system or
systems of sewerage or drainage and sewage treatment and disposal within the sewer
districts setforth below. Such worksfor sewage treatment and disposal may include
any wastewater treatment facility for treating, neutralizing or stabilizing sewage
including treatment or disposal plants; the necessary intercepting, outfall and outlet
sewers, pumping stations integral to such facilities; and equipment and appurtenances
related to theforegoing. For the purposes of this chapter the word "sewage" shall
mean wastewater from homes, public buildings, commercial or industrial
establishments, or any combination thereof, and shall include any surface or ground
water that may be present therein.
The following systems of common sewers and main drains are hereby designated:
a. Town Sewer District - an area outlined in blue on a map entitled,
"Comprehensive Wastewater Management Plan, (Proposed) TO WN
SEWER DISTRICT", with a summer average daily flow capacity of
2,800,000 mgd, dated March 2004, (onfile in the office of the Board of
Selectmen) within which all sewage shall be collected, transported to,
treated by and disposedfrom the Surfside Wastewater Treatment
Facility;

hereby amended as follows (NOTE: new language is shown as highlighted text; language to be
deleted is shown by strikeout; these methods to denote changes are not meant to become part of
the final text):
~120.1. Payment for use of drains and sewers.
A person who enters his/her particular drain onto a main drain or common sewer, or who by more
remote means receives benefit thereby for draining his/her land or buildings, shall pay to the Town a
proportional part of the charge of making and repairing the same, and of the sewer privilege
charges, not already assessed, of making and repairing other main drains and common sewers and
sewage treatment facilities through which the same discharges and/or of the permanent privilege for
entering said main drain or common sewer, which shall be ascertained, assessed and certified by
the Board of Selectmen acting as the Board of Public works pursuant to the authority of MGL c. 83,
~15, Chapter 169 of the Acts of 1965 as amended by Chapter 459 of the Acts of 1987, or any other
applicable law.

I.' BACKGROUND OF APPLICATION
An application for a Comprehensive Permit pursuant to Massachusetts General Laws
("MGL") Chapter 40B, Sections (9) 20-23 ("the statute") for 72 units of housing was filed with the
Nantucket Zoning Board of Appeals ("the ZBA") by Rugged Scott LLC (the "Applicant"
hereinafter) on April 30, 2003. The Applicant agreed that the initial Public Hearing could be
scheduled for July 31, 2003 and granted an extension, which was duly filed with the Nantucket .
Town Clerk. The location of the property that is the subject of this application is four separate
parcels at 15 and 19 Rugged Road. and 6 and B Scott's Way. Notice of the Public Hearing on the'
Application was duly posted in the Town and County Building, was mailed to the Applicant,
abutters, owners of land directly opposite on any public or private street or way, abutters to the
abutters within three hundred feet of the property lines of the subject property, the Nantucket
Planning Board and other Town Agencies, and was published in the Nantucket Inquirer and
MilTOrnewspaper on July 10 and 17,2003. A Public Hearing on the Application was first held in
the Large Group Instruction Room of the Nantucket High School, 10 Surfside Road, Nantucke~
Massachusetts at 6:00 PM on July 31. 2003, and was continued to September 25,2003, October
30,2003, November 20,2003, December 17, 2003, January 29.2004, February 19.2004. and
again to March 17, 2004, during which the ZBA, the neighbors. and other concemed parties'
discussed changes to the plan with the Applicant. The public hearing was closed on March 17,
2004. The ZBA was assisted by Mr. Edward Marchant, a consultant, hired to advise on the 40B
statute and procedural questions. The ZBA also received a report from the Nantucket Planning
Board, dated October 27. 2003, which commented on requested waivers, traffic issues, density,
Jot layout, -housing type and location. The members of the ZBA hearing this application were Mr,
Edward J. Sanford, Chairman, Mr. C. Richard Loftin, Mr. Edward Murphy, Mrs. Nancy J. Sevrens,
and Mr. David R. Wiley.
The ZBA has adopted no local rules and regulations governing applications filed pursuant
to MGL Chapter 408, and accordingly, the model rules prepared by the Commonwealth of
Massachusetts, Department of Housing and Community Development (DHCD), are the rules
applicable to this Application.
The Public Record of this Decision includes, but is not limited to, the Application,
including reports, plans, and specifications, supplemental materials listed in Exhibit 8; the
correspondence between the Applicant and. the ;lBA, agency and peer review reports, written
material received during the public process; and such other information on file with the ZBA at the
~antucket Zoning Board of Appeals office.
The ZBA issued a Decision on this Application dated May 25, 2004, granting a
Comprehensive Permit for construction of forty (40) units, with numerous conditions. The
Applican.t appealed the Decision to the Commonwealth of Massachusetts Housing Appeals
Committee (Docket No. 04-13); and there was also an appeal of the Decision In Nantucket
Superior Court (Lisa P. Dias, and Kenneth F. Dias and Usa P. Dias as Trustees of Daisey

4,2 The Applicant. at its expense or with the contribution of other parties. shall
design to Town' of Nantucket specifications. and construct, an extension of and
connection to tho municipal wastewater sewer system which shall service the structures
on the site (the "proj ect sewer system"), This Decision shall constitute all required local
approvals for said project sewer system, HOWever. pdor to construction, ~ Applicant
shall obtain all State approvals that may be requlred for the project sewer system,
including but not limited to any permit and/or waiver from the Administrative Consent
Order dated October 3D, 2003 issued in the matter of "Surfs ide Wastewater Treatment
FacilIty, ACOP-B0-03-1Q002, Groundwater Discharge Permit, SE #1-200", if any. This
system is projected ~ consist of an internal sower networ1c serving the 44 dwelling units
and clubhouse, 12 (twelve)-inch sewer line to be constructed along the westerly side of
Fairgrounds Road from Newton Road (a.k.a. New Town Road) to a manhole
approximately 250 feet north of the Rotary. At Newton Road (&.k. a. New Town Road),
the existing eight-inch sewer line must be capped off. Upon completion and acceptance
of these improvements, the Applicant shall promptly convey the sewer line to the Town.
An easement covering all portions of the sewer line within the site shall also be granted to
the Town. No septic systems shall be allowed within the subject property.

DECISION:
1. At a public hearing of the Nantucket Zoning Board of
Appeals, on Thursday, June 10, July 8, and October 14, 2010, at
1:00 P.M., at 2 Fairgrounds Road, Nantucket, Massachusetts, the
Board made the following decision on the application of ABREM
QUARY HOMEOWNERS ASSOCIATION, c/o Vaughan, Dale, Hunter, Stetina,
and Beaudette, PO Box 659, Nantucket, MA 02554, File No. 039-10:
2. Applicants are requesting a waiver of the Sewer
Privilege Fees for all of the homes in their 40B subdivision. In
the alternative, the Applicants are requesting a Modification to
their Comprehensive Permit to waive said Fees. The sites are
located at 1, 3A, 3B, 5A, 5B, and 7 Field Avenue, 2A, 2B, 4A, 4B,
4C, 6A, 6B, 6C, 8A, 8B Folger Avenue, 1-6 Sasemin Way, and 1-6
Kinikinnik Ave, are shown on Nantucket Tax Assessor's Map 80 as
Parcels 400-427, are shown as Lots 1-28 on Plan 2006-90, and the
Comprehensive Permit is recorded at the Nantucket County Registry
of Deeds in Book 1057, Page 271. The site is zoned Limited Use
General - 1.
3 . Our
accompanying

decision is based upon the application and
materials, and representations and testimony
our public hearing. There was no Planning Board

recommendation, on the basis that no matters of planning concern
were presented. Staff had received a letter of support from the
Housing Nantucket Office and a letter in opposition to the
Application from the Town Manager's Office. Various members of
the Homeowner's Association were present to voice their support
at the Public Hearings. Members of the public were present at
the public hearings as well to urge the Board to deny the
request.
4. Attorneys Bill Hunter and Jeff Stetina represented the
Applicants at the hearings. Tracy MacDonald, the president of
the Aberm Quary Homeowners Association, represented the
Applicants as well. At the first public hearing, Attorney Hunter
explained the nature of the application to the Board. Attorney
Hunter informed the Board that the Applicants, the Homeowners
Association of Abrem Quary, are requesting a waiver of the Sewer
Privilege Fees for all of the homes in their 4 OB subdivision.
Specifically, the Homeowners Association was requesting a waiver
of Section 120-6 of the Town Bylaw - the section of the Bylaw
that addresses the privilege fees.
Attorney Hunter explained that Article 56, which was approved at
September 3, 2004 Town Meeting, created a new sewer district and
effecti vely created this Privilege Fee. At the time of their
application, the developer, Nantucket Homes For People Inc.,
could not have requested this fee waiver from the Board of
Appeals for their 40B Comprehensive Permit as the Comprehensive
Permit was filed with the Nantucket Town Clerk on April 27, 2001.
At that time, the Sewer Privilege Fee set forth in Warrant
Article 56 of the September Town Meeting had not been approved
and Section 120-6 of the Town Bylaws did not exist.
Subsequently, the Comprehensive Permit was appealed and as such,
the Permit was not recorded at the registry of deeds until 2006.
While the Comprehensive Permit was being litigated, the Sewer
Privilege Fee was enacted and accordingly the Town is requesting
the Homeowners pay their respective connection fees.
The other 40B development, Rugged Scott, LLC, did receive this
waiver when it applied for their Comprehensive Permit in 2006.
However, the Sewer Privilege Fee was enacted prior to this
application and therefore the Applicant was able to request a
waiver.
The 28 homeowners of Abrem Quary have each been assessed a
Privilege Fee of $6,322.15 per home. Accordingly, the Applicants
are requesting this fee be waived or their Comprehensive Permit
be modified so that the homeowners are exempt from paying this
fee.

At the hearings, it was uncertain as to whether or not the Zoning
Board of Appeals had jurisdiction for this matter. Attorney Paul
DeRensis, speaking as Town Counsel for the Selectmen, gave his
opinion to the Board of Appeals and stated that the Zoning Board
of Appeals is in fact the proper adjudicatory body to hear a
matter such as this one. Attorney DeRensis also indicated that
the standard for 4GB matters is whether or not a condition is
uneconomic for the developer and further suggested that this
standard be applied by the Board of Appeals in rendering a
decision.
At the October 14th hearing, Attorney Stetina informed the Board
that the Applicants further revised their request so to only
request fee waivers for the seven (7) Affordable Units and the
one (1) Elderly Unit rather than asking for the full 28 waivers.
At the hearings, homeowners living in the Abrem Quary subdivision
spoke in favor of granting the fee waiver. The Town Manager and
members of the Board of Selectmen, speaking as members of the
public, urged the Board not to grant the waiver.
The Board focused its discussions on whether or not the developer
should have known whether or not this fee would be assessed to
the homeowners and what liability, if any, the developer had
during this process.
5. Therefore, after a discussion with the Applicants and
Counsel for the Applicants the Board finds that such a
modification may be granted to the original Comprehensive Permit
in order to waive the Sewer Privilege Fees for the seven (7)
Affordable Units and the one (1) Elderly Unit as the request to
limit the fee waiver to only eight (8) of the units instead of
the proposed twenty-eight (28) is a more directly aids the goal
of promoting affordable housing on Nantucket.
6. Accordingly, by a unanimous vote of the sitting Board,
the Board of Appeals made the finding that the proposed
modification to the Comprehensive Permi t waiving the seven (7)
Affordable Units and the one (1) elderly unit, a list of which is
attached hereto as "Exhibit A," shall be in harmony with the
general purpose and intent of this chapter and with M.G.L.
