Applicants propose to remove an existing greenhouse structure that is attached to a primary single-family dwelling both of which were constructed at the same time in 1976 by the predecessor-in-title to the Applicants. The dwelling/greenhouse is sited as close as about 21 feet from the southerly front yard lot line in the R-20 zoning district that requires a minimum front yard setback of 30 feet. The dwelling is entirely conforming as to setbacks, with a portion of the greenhouse sited within the 30-foot front yard setback area. When the dwelling and attached greenhouse (accessible directly from the interior of the dwelling) were constructed under one building permit the front yard setback requirement was 20 feet, thus the structure was conforming at the time of construction and is validly grandfathered. Applicants plan to maintain the existing greenhouse foundation, which is integrated with the foundation under the dwelling, and construct a single-story addition on the existing footprint, to expand the interior living space of the dwelling. The height of the existing greenhouse is about 16 feet above existing grade. The proposed new addition would have a height of about 16 feet at its highest point. A separate secondary dwelling was constructed in 1988 by the predecessor-in-title to the Applicants. Other conforming additions are also proposed that do not need relief from the Zoning Board of Appeals as they are to be constructed outside of the required setback areas. The locus is otherwise conforming as to groundcover, lot size and setback requirements, as well as scalar separation between the primary and secondary dwelling units and 20% differential in groundcover. In the addition or in the alternative, Applicants are seeking a grant of VARIANCE relief pursuant to Nantucket Zoning By-law Section 138-16A to allow the removal of the greenhouse and construction of the new one-story addition without increasing the front yard nonconforming setback of about 21 feet should the Zoning Board of Appeals determine that the proposed project could not be completed by a grant solely of Special Permit relief. Linda Darby (Ballinger) purchased the property on March 17, 1993, with the deed recorded on March 23, 1993 at Deed Book 410, Page 262. The lot contained the structures shown today on the site plan in Exhibit A. The premises is located at 39 Millbrook Road (aka 7 Paradise Drive), Assessor's Map 56, Parcel 313, and is shown as Lot 11, Plan Book 20, Page 5. The property is zoned Residential-20. EXHIBIT A Included is the current as-built site plan, prepared by Charles W. Hart, licensed surveyor, dated April 28, 2010. The site plan shows a front yard setback of about 21 feet at the greenhouse's closest point. The wetland areas are delineated in detail on the site plan and indicate that the locus is further limited in buildable area outside of the 50-foot buffer area. The existing structures are shown as well as the proposed additions on the primary structure. The lot contains about 28,242 SF of lot area, in the R-20 district that requires a minimum lot size of 20,000 SF. Maximum groundcover allowed is 12.5%. The proposed groundcover for the lot will not exceed the maximum allowed. EXHIBIT B Included is the locus plan from the Town of Nantucket's GIS map site indicating the location of the locus. Two aerial photographs from said site are included with the enlarged photo showing the greenhouse. The second photograph shows the subdivision of "Paradise Drive" that was approved by the Nantucket Planning Board on January 11, 1977 as it was built out as of 2007. The entire larger lot was owned by the Stark family and subdivided by them. The primary dwelling and attached greenhouse was constructed prior to the subdivision and after the original cottage indicated in the next photo. The final aerial is from the Assessor's records from 1975. There is no roadway constructed as of early 1975. However there is a cottage shown that was located on the locus. It was removed in 1988 in order to allow the predecessor-in-title to the Applicants to construct the existing secondary dwelling. EXHIBIT C Included is a true copy of the 1975 Zoning By-law with "Section V. Intensity Regulations", currently Section 139-16. The chart indicates that the front yard setback for the R-2 zoning district, which the locus was situated within prior to the change a few years ago to R-20, was a minimum of 20 feet. Also included is a copy of the 1979 Zoning By-law "Section 5 Intensity Regulations". The chart indicates that the front yard setback for lots in the R-2 district was still 20 feet. Thus, when the primary dwelling and attached greenhouse were constructed in 1976, they were conforming as to front yard setback requirements and are now grandfathered as to the front yard setback nonconformity and thus Special Permit relief is available to remove the greenhouse and construct a new one-story addition. EXHIBIT D Included is a set of "as-built" plans for the existing primary dwelling and attached greenhouse. Also included are photographs of the dwelling. EXHIBIT E Included is a copy of the plans approved by the Historic District Commission ("HDC") in Certificate of Appropriateness No. 54,282. The proposed alterations to the greenhouse and other additions are included. The site plan indicates that the greenhouse is only partially sited within the currently required 30-foot front yard setback area as the house is angled to the front yard lot line. EXHIBIT F Included is the building permit for the primary dwelling from 1976. At the time no precise proposed site plan or an as-built were required to obtain a Certificate of Occupancy ("CO"). Such surveyed plot plans were not required until the mid-late 1980's. The plan was submitted with the Building Permit Application No. 385-76 and shows the proposed dwelling in a different location. The lot also had a different configuration. The elevations attached are the HDC approved plans from 1976 clearly showing the greenhouse at part of the original house. Included also is the CO indicating that the structure complied with zoning requirements of the time. EXHIBIT G Included is the 1986 "Plot Plan of Land", prepared by John Shugrue, licensed surveyor, which showed that the house was sited at about 22 feet from the front yard lot line. The front yard zoning requirements had changed by that point to a minimum front yard setback of 30 feet. The notation on the plan clearly indicates that in the opinion of the surveyor the lot and dwelling complied with the zoning requirements "at the time of construction". This plan was submitted with the application for Building Permit No. 6109-88 for the secondary dwelling in 1988. Also included is the septic plan, prepared by the same indivicual, indicating the placement of the existing cottage that was removed from the site, as well as the proposed cottage. The primary dwelling is shown in the current location. What is also shown is the triangular parcel that was part of this lot. It was carved out of the locus and sold to the then property owner to the west. This conveyance resulted in the creation of a nonconforming side yard setback for the new cottage as detailed in "Exhibit I". The cottage was supposed to be sited about 14 feet from the northwesterly side yard lot line. The CO is included. EXHIBIT H Included is a third Building Permit No. 1385-04 for a shed with a groundcover of about 80 SF, and thus does not count towards groundcover ratio. EXHIBIT I Included is the Zoning Board of Appeals Decision 051-90 that had to be obtained prior to the issuance of the CO for the cottage. The same septic system site plan that was prepared to obtain the building permit for the cottage was used to show setbacks. The grant of Special Permit relief reduced the side yard setback from the required ten feet to five feet to validate the siting of the cottage. .. EXHIBIT J Included is the "Order of Conditions No. SE48-470" issued to Sam and Rita Stark, predecessors - in-title to the Applicants, issued for the cottage in 1988. It clearly indicates that the locus is impacted to a great degree by wetlands, both within the 100- and 50-foot buffer areas and thus reducing the options for additional construction, particularly on the primary dwelling. CONCLUSION The primary dwelling with attached greenhouse is validly grandfathered as to the nonconforming front yard setback distance of about 21 feet. Thus, special permit relief is available to alter and extend the greenhouse in order to construct the new one-story addition. The finding that the alteration and expansion of the greenhouse could be granted based upon a finding that said alteration would not be substantially more detrimental to the neighborhood than the existing nonconformity. A review of the aerials indicates that the subdivision is built out with several structures appearing to be similarly sited. The setback nonconformity is almost 35 years old and has existed without detriment and negative impact to the surrounding neighborhood since the time of construction in 1976. Should the Zoning Board of Appeals determine that variance relief is necessary due to the temporary removal ofthe greenhouse from the setback area, despite the maintaining of the existing substantial foundation, and the construction of the single-story addition to increase living space, the proper findings could be made to grant such relief, based upon the uniqueness of the situation as detailed above, Le. shape of the lot; the triangular configuration; the structure was built prior to the actual subdivision having taken place and clear lot lines established; topography of the structure, with the greenhouse foundation part of the dwelling foundation and integrated into the interior space; and soil conditions, with the large percentage of established wetlands present on the lot; and further finds that such unique conditions do not affecting generally the zoning district in which it is located. A finding could also be made that a literal enforcement of the provisions of this chapter would involve a substantial financial hardship on the Applicants as the greenhouse foundation is part of the main foundation of the dwelling and to relocate the planned interior expansion would be difficult due to the wetlands proximity to the house and the existing layout of the 35-year old dwelling would be compromised. A grant of relief could be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the Zoning By-law. PROPOSED CONDITIONS: There shall be no further expansion of the structure within the required 30-foot front yard setback area without further relief from this Board; and The siting of the structure is substantially shown on Exhibit A, a reduced copy of which Is attached hereto. Applicants are requesting Special Permit relief pursuant to Nantucket Zoning Bylaw Section 139-33A (alteration/expansion of a pre- existing, nonconforming structure). Applicants propose to remove an existing greenhouse structure that is attached to a primary single-family dwelling both of which were constructed at the same time in 1976 by the predecessor-in-title to the Applicants. The dwelling/ greenhouse is sited as close as about 21 feet from the southerly front yard lot line in the R-20 zoning district that requires a minimum front yard setback of 30 feet. The dwelling is entirely conforming as to setbacks, with a portion of the greenhouse sited within the required 30-foot front yard setback area. When the dwelling and attached greenhouse were constructed under one building permit the front yard setback requirement was 20 feet, thus the structure was conforming at the time of construction and is said to be validly grandfathered. Applicants plan to maintain the existing greenhouse foundation, which is integrated with the foundation under the dwelling, and construct a single-story addition on the existing footprint, to expand the interior living space of the dwelling. In addition or in the alternative, Applicants are requesting Variance relief pursuant to Nantucket Zoning Bylaw Section 139-32 (variances) from the intensity regulations in Section 139-16A (intensity regulations - front yard setback) to allow the removal of the greenhouse and construction of the new one-story addition without increasing the front yard nonconforming setback of about 21 feet as proposed. Attorney Hunter stated that the greenhouse and single-family dwelling were both constructed in 1976. The dwelling/ greenhouse is sited as close as about 21 feet from the southerly front yard lot line in the R-20 zoning district that requires a minimum front yard setback of 30 feet. The dwelling is entirely conforming as to setbacks, with a portion of the greenhouse sited within the 30-foot front yard setback area. When the dwelling and attached greenhouse (accessible directly from the interior of the dwelling) were constructed under one building permit the front yard setback requirement was 20 feet, thus the structure was conforming at the time of construction and is validly grandfathered. The height of the existing greenhouse is about 16 feet above existing grade. The proposed new addition would have a height of about 16 feet at its highest point. A separate secondary dwelling was constructed in 1988 by the predecessor-in- title to the Applicants. Other conforming additions are also proposed that do not need relief from the Zoning Board of Appeals as they are to be constructed outside of the required setback areas. The locus is otherwise conforming as to groundcover, lot size and setback requirements, as well as scalar separation between the primary and secondary dwelling units and 20% differential in groundcover. 5. Therefore, after a discussion with the Applicant and Counsel for the Applicant, the Board finds that such an alternation would not be substantially more detrimental to the neighborhood than the existing nonconformity because there will be no increase in ground cover and there evidence of four letters of support from the abutters. 2 6. Accordingly, by a motion made and duly seconded to GRANT the requested SPECIAL PERMIT pursuant to Nantucket Zoning Bylaw Section 139- 33A in order to remove the existing greenhouse and construct a single-story addition on the existing footprint in accordance with the site plan entitled "Site Plan of Land at 39 Millbrook Road", prepared by Charles W. Hart & Associates, Inc., dated April 28, 2010, attached hereto as "Exhibit A", there were FIVE votes in favor and none opposed.
