ADDENDUM
Application to the Nantucket Zoning Board of Appeals,
41 Jefferson Avenue, Nantucket, Massachusetts
The Applicant is seeking a Special Permit under Nantucket Zoning
By-law (the "By-law") S139-33 to alter and extend the pre-
existing structures and uses on the Locus. The Locus is located
in a Residential-Commercial (RC) zoning district, contains about
41,987 square feet of land area, and conforms to the lot area,
frontage, and ground cover requirements of the By-law. The
Locus is currently improved by a one-bedroom cottage and a main
structure containing a total of nine (9) separate units, five
(5) of which are dwelling units, each with a kitchen. Since a
time prior to 1972, the Locus has been operated as a ten (10)
unit hotel, both independently and in conjunction with the
Cliffside Beach Club. The Applicant proposes to renovate the
main structure; to reduce the number of dwelling units in the
main structure to four (4), having a total of four (4) kitchens
and eight (8) bedrooms; to construct a new free-standing, one-
bedroom cottage; to eliminate the hotel use of the Locus and
convert it to single-family dwelling use; and to potentially
change the form of ownership to a condominium. There will be no
increase in kitchens or bedrooms on the Locus as a result of
this proposal. The existing one-bedroom cottage on the Locus is
non-conforming as to rear yard setback, having a rear setback of
about 1.5 feet, more or less, at its closest point, and no
changes to that cottage are proposed. The Locus is
nonconforming as to curb cuts, and a total of two curb cuts are
proposed. A total of ten (10) parking spaces will be provided,
where a total of eight (8) spaces are required. To the extent
necessary, the Applicant seeks relief by special permit from the
parking, screening, off-street loading facilities, and driveway
access provisions of By-law SS139-18, 19, 20, and 20.1. The
Applicant also seeks minor site plan review under By-law S139-
23.

DECISION:
1. At a public hearing of the Nantucket Zoning Board of
Appeals, on Thursday, June 10, 2010, at 1:00 P.M., at 2
Fairgrounds Road, Nantucket, Massachusetts, the Board made the
following decision on the application of PURPLE WAMPUM, LLC, c/o
Sarah F. Alger, P.C., 2 South Water Street, Nantucket, MA 02554,
File No. 035-10:
2. Applicant is requesting Special Permit relief pursuant
to Nantucket Zoning Bylaw Section 139-33.A. (alteration of
preexisting, nonconforming structures and uses) in order to alter
and extend the preexisting, nonconforming structure on the
locus. The locus presently conforms to lot area, frontage, and
ground cover of the Bylaw. There is a one-bedroom cottage and a
main structure containing a total of nine (9) separate units,
five (5) of which are dwelling units, each with a kitchen. Since
before 1972, the locus has been operated as a ten (10 ) unit
hotel. The Applicant proposes to renovate the main structure; to
reduce the number of dwelling units in the main structure to four
(4), having a total of four (4) kitchens and eight (8) bedrooms;
to construct a new free-standing, one-bedroom dwelling unit; to
eliminate the hotel use of the Locus and convert it to be used
for multiple single-family dwellings; and to potentially change
the form of ownership to a condominium. There will be no
increase in kitchens or bedrooms on the Locus as a result of this
proposal. The existing one-bedroom cottage on the Locus is non-
conforming as to rear yard setback having a rear yard setback of
1.5 i. feet in a zoning district that requires a five (5) foot

rear yard setback. The Locus is nonconforming as to curb cuts
and a total of two curb cuts are proposed. A total of ten (10)
parking spaces will be provided, even though only eight (8) are
required. To the extent necessary, the Applicant is requesting
Special Permit relief pursuant to Nantucket Zoning Bylaw Sections
139-18, 139-19, 139-20, and 139-20.1 (parking, screening, off-
street loading, and dri veway access , respectively) . The
Applicant is also requesting minor site plan review pursuant to
Nantucket Zoning Bylaw Section 139-23. The site is located at 41
Jefferson Avenue, is shown on Nantucket Tax Assessor's Map 30 as
Parcel 45, is shown as Lots 5 and 6 on Land Court Plan 16877-0,
and is registered as Certificate of Title No. 20365 at the
Nantucket County Registry District of the Land Court. The site
is zoned Residential Commercial.
3. Our decision is based upon the application and
accompanying materials, and representations and testimony
recei ved at our public hearing. There was no Planning Board
recommendation, on the basis that no matters of planning concern
were presented. There was a letter of support to the application
and one abutter was represented by Counsel at the hearing and was
in favor of the application.

structure containing a total of nine (9) separate units, five (5)
of which are dwelling units - each with a kitchen.

Beach Club. The Applicant proposes to renovate the main

cottage; to eliminate the hotel use of the locus and convert it

To the extent necessary, the Applicant is requesting Special
Permit relief pursuant to Nantucket Zoning Bylaw Sections 139-18,
139-19, 139-20, 139-20.1. Also, the Applicant is requesting
minor site plan review pursuant to Section 139-23.
5. Accordingly, by unanimous vote of the sitting members,
the Board of Appeals made the finding that the alteration of the
pre-existing, nonconforming structure upon the locus as proposed
would not be substantially more detrimental to the neighborhood
than the existing conditions granted the requested relief by
Special Permit, with the following conditions:
a) That the work shall be done in substantial conformity
to with the plan titled "Site Plan of Land to
Accompany ZBA Application," prepared by Blackwell and
Associates, Inc., dated May 6, 2010, attached hereto
as "Exhibit A"; and,
b) There shall be no exterior construction done during
June 1st and September 15th of any year.
