At a public hearing of the Nantucket Zoning Board of Appeals, on Thursday, June 10, 2010, at 1:00 P.M., in the Garage Area at 2 Fairgrounds Road, Nantucket, Massachusetts, the Board made the following decision on the application of BRIAN RYDER of 12 Mary Ann Drive, Nantucket, MA 02554, File No. 033-10: 2. Applicant is requesting Special Permit relief pursuant to Nantucket Zoning Bylaw Section 139-30 (special permits) to be allowed to construct a standalone storage structure as allowed in Section 139-7.A. (allowed uses). The site is located at 3 Mary Ann Drive, is shown on Nantucket Tax Assessor's Map 68 as Parcel 988, is shown on Plan File No. 16514-78, and is registered as Certificate of Title No. 12206 at the Nantucket County Registry District of the Land Court. The site is zoned Commercial Trade, Entrepreneurship and Craft (CTEC). 3. Our decision is based upon the application and accompanying materials, and representations and testimony received from the applicant at our public hearing. The Planning Board recommendation was not of planning concern. There was a letter of support in the file and Staff had been in contact with two abutters regarding the type of materials stored, as.well as screening part of the locus. 4. At the hearing, the Applicant represented himself at the hearing. The Applicant stated that he is requesting Special Permit relief pursuant to Nantucket Zoning Bylaw Section 139-30 (special permits) to be allowed to construct a standalone storage structure as allowed in Section 139-7.A (allowed uses). The Applicant is the owner of Ryder Electric and plans on storing fixtures and wires as they are delivered to his business. There was concern expressed from the Board regarding the parking on the Locus and the type of~screening to be used. The Applicant and the abutter concerned with the screening were agreeable to the suggestion that the screening be on the front of the property and consist of Leland Cypress trees. The Applicant also stated that the parking configuration will be modified from what was originally proposed. 5. Based upon the following, the Board finds that granting the requested Special Permit relief to allow the applicant to construct a standalone storage structure is in harmony with the purpose and intent of the Zoning Bylaw as the Locus is situated in the CTEC zoning district and warehousing is an allowed use by Special Permit. 6. Accordingly, by a UNANIMOUS vote, the Board granted the requested relief for the Applicant to construct a standalone storage structure with the following conditions: a) The Applicant shall plant Leland Cypress trees along the front of the property on Mary Ann Drive except for the location of the driveway to enter the Locus; b) The standalone structure shall be constructed in substantial conformity to proposed structure as shown on the attached "Exhibit A" entitled "Rider - Garage" as prepared by Brook Meerbergen Designs; and, c) The hours of operation shall be 7:00 am to 5:00 pm, Monday through Saturday.
