DECISION:
1. At a public hearing of the Nantucket Zoning Board of
Appeals, on Thursday, May 13, 2010, at 1:00 P.M., in the Garage
Area at 2 Fairgrounds Road, Nantucket, Massachusetts, the Board
made the following decision on the application of ATHALYN K.AND
MICHAEL J. SWEENEY of 16D Milestone Road, Nantucket, MA 02554,
File No. 026-10:
2. Applicant is requesting Special Permit relief pursuant
to Nantucket Zoning Bylaw Section 139-33.A. (alteration of
preexisting, nonconforming structure) for the alteration of a
preexisting, nonconforming structure in order to construct a rear
and side yard deck to be as close as ten (10) feet from the side
and rear yard lot lines in a zoning district that requires a
fifteen (15) foot side and rear yard setback. The site is
located at 16D Milestone Road, is shown on Nantucket Tax
Assessor's Map 54 as Parcel 130.3, and is shown on Plan No.
10937-10-1 as Unit 4, and is registered as Certificate of Title
No. U6018 at the Nantucket County Registry of Deeds. The site is
zoned Village Residential.
3. Our decision is based upon the application and
accompanying materials, and representations and testimony
received from the applicant at our public hearing. The Planning
Board recommendation was not of planning concern. There were no
letters of support or in opposition to the application.
4. At the hearing, the applicant stated that he is
requesting Special Permit relief pursuant to Nantucket Zoning
Bylaw Section 139-33.A in order to alter his pre-existing,
nonconforming structure.
The applicant owns one of the condominium units in the
Island Village development off of Milestone Road. The
applicant's condominium is in the Northeasterly corner of the
lot. The applicant's brick steps are located in the setback due
to the change in zoning from a ten (10 ) feet side and rear yard
setback to a fifteen (15) foot side and rear yard setback.
Nonetheless, the applicant is proposing a deck and a pent
roof over the door in the Northeasterly setback. The deck will
be sited in the northeasterly corner of the structure that will
be as close as ten (10) feet from the side and rear yard
setbacks. The applicant contends that but for the zoning change,
this addition would conform to the setback regulations. The
applicant represented that allowing this alteration to his
structure will not have a significant and/or adverse impact on
the integrity of the neighborhood.
5. The Board finds that granting the requested Special
Permit relief to allow the applicant to construct a deck as close
as ten (10) feet from the side and rear yard setbacks on the
locus is in harmony with the purpose and intent of the Zoning
Bylaw and will not be substantially more detrimental to the
neighborhood than the existing nonconformities upon the Premises.
6. By a vote of FOUR in favor and ONE (Poor) opposed, the
Board votes to grant the requested Special Permit to allow for
the construction of a deck to be as close as ten (10 ) feet from
the side and rear yard setbacks, as well as a pent roof over the
door in the Northeasterly setback which shall in substantial
conformity with the attached "Exhibit A."
