Exhibit "A"
The Applicant is seeking a MODIFICATION of the Decision in BOA File No. 006-01,
which waived a portion of parking requirements and the load zone requirement for a
construction of an office building, with a basement apartment on the Premises. The
Applicant seeks to change the commercial use of the existing building from an office to a
retail use on the first floor and storage on the second floor. This change of use reduces the
parking requirement for the Premises froin eight (8) parking spaces to six (6) parking
spaces. The four (4) conforming parking spaces and two (2) non-conforming "stacked"
spaces allowed in BOA File No. 006-01 are to remain and there shall be no physical
change to building. No loading zone is provided on Premises. In all other respects, the
Locus and building comply with dimensional zoning requirement. In the alternative and
if necessary, SPECIAL PERMIT relief is also requested waive sufficient parking and
loading zone requirement to allow this change of use.
The Premises are located at 2 Mary Ann Drive, Assessor's Map 68, Parcel 467 and is
shown as Lot 584 on Land Court Plan No. 13514-33. The Premises is zoned Residential
Commercial- 2.

Street, Nantucket, Massachusetts 02554, on the Application of EDWARD C. MURPHY,
TRUSTEE of OLD SOUTH REALTY TRUST FOR HIMSELF AS FORMER OWNER, and for
WILLIAM;McGUlRE and STEPHEN~HEROU'X, TRUSTEES OF M.T. NOMINEE TRUST,
CONTRACT PURCHASERS and CURRENT OWNERS, c/o 20 Federal Street, Nantucket,
Massachusetts 02554, Board of Appeals File No. 006-01, the BOARD made the following
Decision:
I. Applicants (McGuirefTheroux) are seeking reliefby SPECIAL PERMIT under
Nantucket Zoning By-law Section 139-18 (Parking Requirements). Applicants are seeking a
waiver of four (4) of the seven (7) required parking spaces for a proposed structure that will
contain one (I) office and one (I) basement apartment. The new building on the Lot will meet all
dimensional zoning requirements, other than parking. To the extent necessary, Applicants are
also seeking relief by SPECIAL PERMIT under Nantucket Zoning By-Law Section 139-20 to
waive the loading zone requirements. Finally, Applicants are seeking SITE PLAN APPROVAL
under Section 139-23 of the By-law.
2. The Decision is based on the Application and materials submitted with it, and the
testimony and evidence presented at the Hearing. The Planning Board recommended that
Applicants provide all of the required off-street parking on the Property unless the Applicants
took steps to limit the number of vehicles traveling to the Property. There was no other
opposition to Applicants' request for relief and no letters on file.
3. Applicants, through counsel, represented to the BOARD they had purchased the
Property on January 8, 2001 and intended to construct a new office building for their
architectural business on the site. The Property has an area of approximately 5,0 I 0 square feet is
located on the comer of Old South Road and Mary Ann Drive and has a required front yard set
back of twenty (20') feet and a side yard set back often (10') feet from the other street.
Applicants explained to the BOARD that their architectural business did not generate a great
number of vehicle trips to their office; their two (2) employees either walked to work or rode the
municipal shuttle bus which has a bus stop near the Property. The Applicants met with most of
their clients and contractors in the field. Applicants also stated to the BOARD that although eight
(8) off-street parking spaces were required under Section 139-18 of the By-Law, the allocation of
four (4) off-street parking spaces on the Property sufficiently provided adequate parking for the
proposed building uses: a 852:!:: square feet basement apartment and a I \4 story architectural
office with an area of 1,392:!:: square feet, and a waiver of four (4) parking spaces was reasonable

in the circumstances. Moreover, Applicants stated to the BOARD that their architectural office
did not involve the loading and unloading of transport vehicles and, therefore, no off-street
loading zone was required under Section 139-20 of the By-Law. The BOARD agreed that given
the nature of Applicants' architectural business, no off-street loading zone was required because
the business did not require regular service by transport vehicles; however, members of the
BOARD expressed concern about the limited number of off-street parking spaces proposed by
the Applicants given the mixed office/residential use of the Property but also acknowledged that
the lot was a small, corner lot that made provision of all the required off-street parking spaces
difficult. The BOARD noted that the Nantucket Historic District Commission ("HOC")
suggested that the parking area be sited on the rear of the lot and the building be located closer to
Old South Road on the interior of the lot, away from the intersection of Mary Ann Drive and Old
South Road. The HOC also stated that all vehicular access to the Property must be from Mary
Ann Drive, not Old South Road.
4. Therefore, The BOARD finds that given the special facts and circumstances in
this Application, a waiver of four (4) off-street parking spaces is appropriate and not substantially
more detrimental to the neighborhood than the existing use of the Property, subject to specific
conditions. One Member stated that the Property is vacant land and, in most cases, the owners of
vacant land should provide all required off-street parking spaces for the owner's project. Another
Member took note of the Applicants' willingness to limit the number of vehicles using the
Property and suggested the addition oftwo (2) non-conforming, "stacked" parking spaces on the
northerly side of the Property so that Applicants would provide four (4) conforming parking
spaces and two (2) non-conforming parking spaces. The BOARD acknowledges that unlike most
commercial uses, Applicants' architectural business may not generate the need for all of the
required off-street parking spaces and the provision for six (6) aggregate parking spaces was
appropriate and in harmony with sound traffic policy and the general purpose and intent of the
Nantucket Zoning By-law based upon the facts of this case. The BOARD noted that any change
from the commercial use of the building as an architectural office would require additional relief
from the BOARD.
Further, the BOARD finds the submitted Site Plan, as revised to reflect two (2) "stacked"
parking spaces as recommended by the BOARD, in addition to the four (4) approved off-street
parking spaces, will complete and will meet the requirement of Section 139-23 of the By-Law.
To the extent necessary, the BOARD waives the requirement of an off-street loading zone under
Section 139-20 of the By-Law because the proposed use ofthe building does not generate
frequent deliveries by transport vehicles and is in harmony with the general purpose and intent of
the Zoning By-Law.
5. Accordingly, by MAJORITY VOTE (O'Mara, Parent, Sevrens, Sanford in favor;
Toole dissenting) the BOARD GRANTS the Applicants a SPECIAL PERMIT under Section
139-18 of the By-law and waives four (4) off-street parking spaces with respect to the
construction and use of the proposed office-building with basement apartment on the Property,
subject to the following conditions:
A. Applicants shall provide four (4) conforming off-street parking spaces and two (2)
non-conforming, "stacked" off-street parking spaces on the Property as shown on
PS2378
the Revised Site Plan prepared by Nantucket Architecture Group, Ltd. dated
January 16, 2001, a reduced copy of which is annexed hereto as Exhibit "A";
B. Any change from the commercial use of the proposed building as an architectural
office by these Applicants to another commercial use shall require further relief
from this BOARD;
C. Applicants shall maintain adequate natural screening, e.g., privet hedge, along the
perimeter of the Property as shown on Exhibit "A";
D. Applicants shall provide their employees each year with a riding pass for the
NRTA shuttle bus.
E. The proposed commercial/residential uses on the Property are limited to a
commercial architectural office with a maximum floor area of I ,392:!: square feet
and an 852:!: square feet basement apartment.
6. Further, by MAJORITY VOTE (O'Mara, Parent, Sevrens, Sanford in favor, Toole
dissenting), the BOARD hereby APPROVES the Revised Site Plan entitled "NEW BUILDING
for M.T. TRUST, subject to the revisions recommended by the BOARD. The REVISED SITE
PLAN dated January 16, 2001 reflecting a mixed use building with a maximum ground cover of
I IOO:!: square feet with 1,392:!: square feet of office space and an 852:!: square feet basement
apartment, is annexed hereto as Exhibit "A".

At a public hearing of the Nantucket Board of Appeals held at 1 :00 p.m., on
Thursday, May 13, 2010, at 2 Fairgrounds Road, Nantucket, Massachusetts, on the
Application of Wayne D. Petty, c/o Paul S. Jensen, P.C., P.O. Box 3097, Nantucket, MA
02584 (Board of Appeals File No. 031-10), the Board made the following Decision:
(1) Applicant is requesting a modification of the Decision in Board of
Appeals File No. 006-01 to allow a change ofthe commercial use of the building from an
office to retail use on the first floor and storage on the second floor. The four (4)
conforming parking spaces and two (2) nonconforming "stacked" spaces allowed in the
Decision in Board of Appeals File No. 006-01 are to remain and there shall be no
physical change to the building.
The site is located at 2 Mary Ann Drive, is shown on Nantucket Tax Assessor's
Map 68 as Parcel 467, is shown as Lot 584 on Land Court Plan No. 16514-33, and is
registered as Certificate of Title No. 19790 in the Nantucket County Registry of Deeds.
The site is zoned Commercial Neighborhood.
(2) Our decision is based upon the application and accompanying materials,
representations and testimony received at our public hearing. The Planning Board made
no recommendation. There were six (6) letters from abutters on file expressing support
for the application and two (2) letters from abutters expressing support for the
application, if the certain conditions on proposed retail use were imposed.
(3) The Applicant, through counsel, represented that the Applicant is
proposing to use 696 square feet of the first floor of the existing building as custom
picture frame shop and remaining 846 square feet of commercial space in the building for
storage. No change to the residential use of basement apartment in the building is
proposed. A custom picture frame shop is allowed, by right, as retail use under the
Zoning By-law. However, a custom frame shop is more a service, than a retail use, and
does not generate much traffic. Deliveries to the frame shop would be by Fedex, UPS and
personal vehicles. The proposed frame shop and storage use of the building, with up to
three (3) employees, and the existing basement apartment, requires six (6) parking spaces
under the Zoning By-law. There are six (6) parking spaces provided on the Premises, two
(2) of which are stacked and do not conform to Zoning By-law, but were allowed by
decision in BOA file 006-01. The Applicant is thus seeking a modification ofthe decision
in BOA file 006-01 to allow these proposed retail and storage uses, or the existing office
use that was allowed by that decision. Prior to hearing, abutters raised concern about a
retail use in the building and effect of the associated parking, delivery, trash, and noise on
neighborhood. The Applicant in discussions with these concerned abutters agreed to the
imposition of certain conditions on retail use of building, which conditions have been
incorporated herein to alleviate these concerns.
(4) Therefore, based upon the foregoing, the Board finds that the requested
modification of the SPECIAL PERMIT relief granted in the decision in BOA File (006-
01) to allow the proposed retail and storage uses in the existing building, to be in
harmony with the general purpose and intent of the Zoning By-law, and would not be
substantially more detrimental to the neighborhood.
(5) Accordingly, by a unanimous vote, the Board GRANTS the requested
MODIFICA nON of the previous SPECIAL PERMIT relief to allow, in the alternative,
the proposed retail and storage uses in the building on the following conditions:
a. Employees shall be given NRTA passes;
b. The existing hedge shall be maintained;
c. Retail and storage space shall be occupied by a single entity and no subtenants
shall be allowed;
d. Retail use is strictly limited to use of premises as a picture framing shop,
meaning sales of frames and related materials and supplies; there shall be no
manufacturing of frames on site, no sales of food or alcohol, and no
promotional parties on the premises;
e. The second floor shall be limited to storage use only;
f. There shall be no exterior dumpster or machines shall be allowed;
g. There shall be no deliveries by tractor-trailer trucks shall be allowed; all pick-
up/delivery activity shall occur on-site;
h. The hours of operation for retail use shall begin after 8:30 am and end by 5:30
pm, with no retail hours on Sundays;
1. There shall be no off-site parking related to the commercial or residential uses
shall be allowed; and,
J. This relief shall be personal to the Applicant. No retail use by anyone other
than the Applicant, or an entity owned by the Applicant, shall be allowed
without further relief from this Board.
