The applicants wish to construct alterations to their dwelling,
which is the primary dwelling upon the lot. At the time of
construction of the dwellings upon the lot, it was subject to a
zoning plan freeze with the applicable zoning being Residential-1,
with minimum lot area of 5,000 square feet, minimum front yard
setback of 10 feet, minimum side and rear yard setback of 5 feet,
and maximum ground cover ratio of 30%. This freeze period has
expired, and the applicable zoning is now Residential 10, with
minimum lot area of 10,000 square feet, minimum front yard setback
of 20 feet, minimum side and rear yard setback of 10 feet, and
maximum ground cover ratio of 25%. The locus and the structures
thereon n ow have pre-existing, nonconforming status, with lot area
being about 8,957 square feet. The applicants' dwelling is
nonconforming as to front yard setback, which is about 11.2 feet,
and side yard setback, which is about 6 feet from the northeasterly
side lot line and about 5.1 feet from the southwesterly side lot
line. Ground cover ratio upon the lot is now about 28.2%. (The
other dwelling upon the lot, which is under a separate residence
agreement, is not proposed to be altered.) The applicants propose
to construct alterations to their dwelling within the southwesterly
side yard which will not be closer to the southwesterly lot line
than the present setback of 5.1 feet, and which will increase
ground cover by about 95 square feet, resulting in a ground cover
ratio of about 28.6%. Accordingly, the applicants request relief
by Special Permit under Nantucket Zoning By-law ~ 139-33.A, for the
alteration of pre-existing nonconformities without creating any new
nonconformities.

DECISION:
1. At a public hearing of the Nantucket Zoning Board of
Appeals, on Thursday, May 13, 2010, at 1:00 P.M., at 2
Fairgrounds Road, Nantucket, Massachusetts, the Board made the
following decision on the application of BRUCE R. McBREARTY and
DENISE D. McBREARTY (NASHAQUISSET COOPERATIVE, INC, Owner), c/o
Reade, Gullicksen, Hanley & Gifford, LLP, Post Office Box 2669,
Nantucket, Massachusetts 02584, File No. 029-10:
2. The applicants wish to construct alterations to their
dwelling, which is the primary dwelling upon the lot. The locus
is part of the Nashaquisset Cooperative, and the applicants hold
a residence agreement covering the subject dwelling. At the time
of construction of the dwellings upon the lot, it was subject to
a zoning plan freeze with the applicable zoning being
Residential-I, with minimum lot area of 5,000 square feet,
minimum front yard setback of 10 feet, minimum side and rear yard
setback of 5 feet, and maximum ground cover ratio of 30%. This
freeze period has expired, and the applicable zoning is now
Residential 10, with minimum lot area of 10,000 square feet,
minimum front yard setback of 20 feet, minimum side and rear yard
setback of 10 feet, and maximum ground cover ratio of 25%. The
locus and the structures thereon now have pre-existing,
nonconforming status, with lot area being about 8,957 square
feet. The applicants' dwelling is nonconforming as to front yard
setback, which is about 11.2 feet, and side yard setback, which
is about 6 feet from the northeasterly side lot line and about
5.1 feet from the southwesterly side lot line. Ground cover

ratio upon the lot is now about 28.2%. (The other dwelling upon
the lot, which is under a separate residence agreement, is not
proposed to be altered.) The applicants propose to construct
alterations to their dwelling within the southwesterly side yard
which will not be closer to the southwesterly lot line than the
present setback of 5.1 feet, and which will increase ground cover
by about 95 square feet, resulting in a ground cover ratio of
about 28.6%. Accordingly, the applicants request relief by
Special Permit under Nantucket Zoning By-law ~139-33.A, for the
alteration of pre-existing nonconformities without creating any
new nonconformi ties. The locus is situated at 3 Paupamo Way,
Assessor's Parcel 55-572.1, is shown upon plan recorded with
Nantucket Deeds in Plan Book 25, Page 21, as Lot 175, and is now
situated in a Residential-10 zoning district
3. Our decision is based upon the application and
accompanying materials, and representations and testimony
received at our public hearing. There was no Planning Board
recommendation, on the basis that no matters of planning concern
were presented. Several messages from neighbors in support of
the application were read into the record by the applicants'
attorney; no other support nor opposition was presented at the
public hearing.
4. As presented by the applicants' counsel, the applicants
propose to alter their single-family dwelling by constructing an
addition with a net increase in ground cover of about 95 square
feet and with the nonconforming southwesterly side yard setback
of 5.1 feet at the closest point remaining unchanged, although
work will be done within the southwesterly side yard; other
nonconformities of the dwelling and of other structures upon the
locus would remain unchanged. Because this involves changes in
pre-existing nonconformities of a single-family structure, relief
is by Special Permit under the provisions of M.G.L., c. 40A, ~6.
Existing conditions and present conditions upon the locus are
shown upon two plans by Blackwell & Associates, Inc., dated April
9, 2010, copies of which are attached to this decision as
Exhibits A-1 and A-2, respectively.
5. By unanimous vote of the sitting members, the Board of
Appeals made the finding that the alteration of the pre-existing,
nonconforming single-family dwelling upon the locus as proposed
would not be substantially more detrimental to the neighborhood
than the existing conditions, and granted the requested relief by
Special Permit, subject to the following conditions:
(a) The alterations shall be constructed in
substantial conformity with Exhibit A-2 and the plans approved by
the Nantucket Historic District Commission under their
Certificate of Appropriateness No. 54648; and
2
(b) No exterior construction shall
between Memorial Day and Labor Day in any year.
