1. At a public hearing of the Nantucket Zoning Board of
Appeals, on Thursday, May 13, 2010, at 1:00 P.M., at 2
Fairgrounds Road, Nantucket, Massachusetts, the Board made the
following decision on the application of MICHAEL J. WILSON,
TRUSTEE OF ROBERT IAN REALTY TRUST, of PO Box 1433, Nantucket,
Massachusetts 02554, File No. 023-10:
2. Applicant is requesting Variance relief pursuant to
Nantucket Zoning Bylaw Section 139-32 (variances) from the
intensity regulations in Nantucket Zoning Bylaw Section 139-16
(intensity regulations lot size and frontage) in order to
construct a new replacement single family dwelling on a lot
containing 3,163 square feet, which is less than the 5,000 square
feet required in the R-l zoning district. The lot was created by
an Approval Not Required (ANR) plan (Planning Board File No.

pursuant to M.G.L. Chapter 41-81L, which allows the division of a
lot into two (2) or more lots if each contain one (1) or more
structures that predate the adoption of the Subdivision Control
Law (1955). The subject lot, shown as Lot 2 on the Approval Not
Required plan, contained a one-story dilapidated single family
dwelling. Although special permit relief would have been
available to alter or extend the then existing structure, the
structure was demolished before any applications to the Zoning
Board of Appeals were filed. The site is located at 3 Cherry
Street, is shown on Nantucket Tax Assessor's Map 55 as part of
Parcel 376 (Lot 2 as shown on Planning Board File No. 7258 signed
11/6/09), and title is recorded at the Nantucket County Registry

of Deeds in Book 1080, Page 216. The site is zoned Residential -
1.
3. Our decision is based upon the application and
accompanying materials, and representations and testimony
received at our public hearing. There were no letters of support
or opposition to the application.
4. Richard Bretschneider represented the applicant at the
hearing. Mr. Bretschneider informed the Board that the applicant
is requesting Variance relief pursuant to Nantucket Zoning Bylaw
Section 139-32 from the intensity regulations in Nantucket Zoning
Bylaw Section 139-16 in order to construct a new single family
dwelling on an undersized lot in the R-1 zoning district.
Upon receiving endorsement of the ANR plan by Planning Board,
thereby creating two separate and buildable lots, the applicant
then demolished the dilapidated structure on Lot 2. Although the
proposed new structure would conform to all the intensity
regulations (setbacks and ground cover ratio) of the R-1 zoning
district, the lot does not conform to minimum lot size or
frontage. It was the opinion of the Zoning Enforcement Officer,
that the proposed construction warranted Variance relief as the
applicant was proposing to construct a new dwelling on a
nonconforming lot.
At the hearing, it was explained that the applicant had created
two lots pursuant to M.G.L. Chapter 41-81L, which allows the
division of a lot into two (2) or more lots if each contain one
(1) or more structures that predate the adoption of the
Subdivision Control Law (1955). Accordingly, the applicant
informed the Board that at the time the lot was created, the
locus contained one (1) structure that predated Nantucket's 1955
adoption of the Subdivision Control Law. It is important to note
that Special Permit relief, which has a broader threshold than a
Variance, would have been available to the applicant had they
applied to the Board prior to demolishing the structure.
However, now the only available relief to allow the construction
of a new structure is through the issuance of a Variance.
Through the issuance of a Variance, the Board has the authority
to regulate the location and ground cover of any proposed
structure. Specifically, the Board found that the present
application meets the requirement for a Variance based upon the
uniqueness of the lot due to its creation pursuant to M.G.L.
Chapter 41-81L, which distinguishes it from other lots in the
same zoning district. Based on this information, the Board found
that the requested relief would not derogate from the purpose and
intent of the Zoning By-law.

In ascertaining the uniqueness of the situation and the proposed
structure on the locus, the Board examined the neighborhood in
which the locus is located. The Board considered the neighboring
parcels and the commercial aspect of the neighborhood. The Board
determined that by limiting the subject lot to one dwelling unit,
the proposal would be in harmony and conjunction with the
aesthetic of the neighborhood.
5. Accordingly, by unanimous vote of the sitting members,
the Board of Appeals made the finding that circumstances relating
to the soil conditions, shape or topography of such land or
structures and especially affecting such land or structures but
not affecting generally the zoning district in which it is
located, a literal enforcement of the provisions of this chapter
would involve substantial hardship to the applicant and the
desirable relief may be granted without substantial detriment to
the public good and without nullifying or substantially
derogating from the intent or purpose of the bylaw.
Specifically, the lot was validly created pursuant to M. G. L.
Chapter 41-81L and is significantly smaller than the minimum lot
size required in the R-1 district. The conflict between the
state law allowing the lot division and the intensity regulations
of the local bylaw has created a unique situation specific to
this lot.
Based upon the application and accompanying materials, and
representations and testimony received at our public hearing, the
applicant is granted Variance relief pursuant to Nantucket Zoning
Bylaw Section 139-32 (variances) from the intensity regulations
in Section 139-16 (intensity regulations - lot size and frontage)
to validate Lot 2 as buildable and to construct a single family
dwelling said lot. The lot dimensions and configuration as well
as the location and size of the proposed structure shall be in
substantial conformance with Exhibit A attached to this decision.
