of Chapter 40A, Massachusetts General Laws.

complaint in Land Court within TWENTY (20) days after this day's
date. Notice of the action with a copy of the complaint and
certified copy of the Decision must be given to the Town Clerk so
as to be received within such TWENTY (20) days.

DECISION:
1. At a public hearing of the Nantucket Zoning Board of Appeals on
Thursday, May 13, 2010, at 1:00 P.M., at 2 Fairgrounds Road, Nantucket,
Massachusetts, the Board made the following Decision on the Application in
Zoning Board of Appeals File No. 020-10 of Don Freedman of 42 Somerset Lane,
Nantucket, MA 02554.
2. Applicants are requesting variance relief pursuant to Nantucket
Zoning Bylaw Section 139-32 (variances) from the intensity regulations found in
Nantucket Zoning Bylaw Section 139-16 (intensity regulations) to validate the
siting of the pool equipment in the rear yard setback. The site is located at 42
Somerset Lane, is shown on Nantucket Tax Assessor's Map 66 as Parcel 77, is
shown on Plane File 3-B as Lot 15, and title is recorded at the Nantucket County
Registry of Deeds in Book 1190, Page 1. The site is zoned Residential- 20.
3. Our Decision is based upon the Application and accompanying
materials, representations and testimony received at our public hearing. The
Planning Board recommendation was not of planning concern. There were no
letters of support or in opposition to the application.
4. At the hearing, the Applicant was represented by Ted King. Mr.
King explained that the Applicants had recently purchased the property and
after completing a survey, noticed that the pool equipment was sited in the
northeasterly corner of the lot in the setback. Accordingly, the Applicant is
requesting variance relief pursuant to Nantucket Zoning Bylaw Section 139-32
from the intensity regulations in Section 139-16 to allow the pool equipment to be
sited in its present location. Mr. King further mentioned that the house is
conforming in all respects except for the location of the pool equipment in the
northeasterly corner of the lot. The heaters are as close as 3.2 feet from the side
yard setback and the filter is as close as 4.7 feet from the rear yard setback.
5. Based on the foregoing, the Board finds that owing to
circumstances relating to the shape of the locus and the structures thereon, and
especially affecting the locus but not generally affecting lots in the same zoning
district, a literal application of the provisions of the By-law would not result in a
substantial hardship to the applicants, and that desirable relief may not be
granted as requested without derogating from the purpose and intent of the By-
law to allow the Applicant to have the pool equipment sited in the setback as this
is an unfortunate situation; but, it does not Variance relief is not appropriate.
6. Accordingly, by a motion made and duly seconded to GRANT the
requested VARIANCE relief pursuant to Nantucket Zoning Bylaw Section 139-32
from the intensity regulations in Section 139-16 to validate the siting of the pool
equipment in the setback as shown on the plan entitled "Building Location Plan"
prepared by Island Surveyors, LLC, and dated March 14, 2010, there were two
(2) votes in favor and three (3) opposed (Toole, O'Mara, Botticelli).
