The site is zoned Residential Commercial - 2. 3. Our Decision is based upon the Application and accompanying materials, representations and testimony received at our public hearing. The Planning Board made no recommendation as this was not a matter of planning concern. One letter was received from an abutter's representative that she did not have any objection to the Application. 4. Attorneys Bill Hunter and Jeff Stetina, and representative from Nantucket Surveyors, Paul Santos, represented the Applicant. Attorney Hunter informed the Board that the Applicant is requesting a modification of the Special Permit in Decision No. 047-02. The request is to have condition 7.a deleted in order to allow the basement office space to be rented to a tenant, provided that such tenant and its uses do not trigger an increase in the parking requirement. Condition 7.a states, "The basement office space shall be used in conjunction with the first floor office space and not leased separately without further relief from this Board." Accordingly, the Applicant is requesting further relief from the Board of Appeals in order to lease said space. Additionally, the Applicant informed the Board that should the parking requirements be increased, the Applicant is prepared to ask for further relief from the Zoning Board of Appeals. 5. At the initial hearing on April 8, 2010, the Board expressed concerns regarding the number of tenants and, accordingly, the intensity of the use in this commercial area and the parking implications associated therein. At this time, the Applicants requested the matter be continued to the May hearing in order to better contemplate what compromises can be made regarding leasing spaces to tenants. 6. At the May 13, 2010 hearing, Attorney Stetina and representative Santos presented a proposal to the Board that sought to limit the potential leasable basement space to another tenant. Rather than lease the entire 2580 square feet of the basement space, the Applicant suggested restricting the leasable basement office space to 1370 square feet. The Board considered this amenable and accordingly found that this modification to the Applicant's existing Special Permit would be in harmony with the general purpose and intent of the Zoning Bylaw. 7. Accordingly, by a motion made and duly seconded to GRANT the requested MODIFICATION to existing SPECIAL PERMIT 047-02 to delete condition 7.a in order to allow the basement office space to be rented to a tenant, provided such tenant and its uses do not trigger an increase in the parking requirement without further relief from the Zoning Board of Appeals there were FIVE (5) votes in favor and none (0) opposed with the following condition: a) The leasable basement space shall be restricted to 1370 square feet as shown on the attached ZBA Exhibit Plan attached herein as "Exhibit A"; and, b) Any use increasing the parking requirements shall require further relief from this Board.
