DECISION:
1. At a public hearing of the Nantucket Zoning Board of
Appeals, on Thursday, March 11, 2010, at 1:00 P.M., in the Garage
Area at 2 Fairgrounds Road, Nantucket, Massachusetts, the Board
made the following decision on the application of GERALD W.
SEIGEL and SUZETTE T. SEIGEL, c/o Reade, Gullicksen, Hanley &
Gifford, LLP, Post Office Box 2669, Nantucket, Massachusetts
02584, File No. 012-10:
2. Applicants are requesting Special Permit relief pursuant
to Nantucket Zoning By-law ~139-16.C (1) to reduce the
requirement for one ten (10) foot side yard setback to five (5)
feet. The existing dwelling, constructed prior to the R-5
upzoning is six (6) feet from the westerly side yard line;
applicant also proposes to site a shed upon the Premises, to be
located five (5) feet from both the rear and side yard lines.
The Premises is located at 56 Goldfinch Drive, shown on Nantucket
Assessor's Map 68 as Parcel 677, and as Lot 318 on Land Court
Plan 16514-12. For title, see Certificate of Title No. 19558.
The Premises is zoned Residential-5.
3. Our decision is based upon the application and
accompanying materials, and representations and testimony
received from the applicant's attorney at our public hearing.
The Planning Board recommendation was not of planning concern.
Two letters in support of the applicant were presented at the
public hearing.
4. Applicant owns the Premises, as well as the adjacent
property at 58 Goldfinch Drive, all of which are located within a
subdivision commonly referred to as Naushop. Applicant informs
us that the existing dwellling at 56 Goldfinch Drive, as shown
upon the plan attached hereto as Exhibit A, was built in 1999,
and a Certificate of Occupancy No. 285-00 issued therefore in
July, 2000. There is also currently located upon the adjacent
property a small shed. At the 2009 Town Meeting, the Naushop
subdivision was upzoned to Residential-5 zoning, of which a
requirement is that one of the side yard setbacks be at least 10
feet from a side yard line; the minimum side yard setback for the
other side yard and the rear yard setback, remained at five feet.
Because of Applicant's ownership of the adjacent parcel of land
and pre-existing siting of the Applicant's home, absent zoning
relief, the upzoning would result in a merger to the extent
necessary to cure the 10 foot side yard requirement. In addition,
the existing shed at 58 Goldfinch Drive, is to be relocated five
feet of the westerly side yard line and the rear yard line of the
Premises. It was noted by the Board that most of the homes within
the Naushop subdivision are located not more than five feet from
rear and both side yard lines, and that sheds are routinely
located in such areas. We also note that there is pending a
change to the zoning by-law which would allow, as of right,
ancillary structures in the R-5 zoning district to be located
within five feet of rear and side yard lines provided such
structures are sited within 20 feet of the rear yard line. Not
only does the Applicant's proposal for siting the shed meet such
requirements, but will also ensure that the shed is located upon
the same lot as the dwelling to which it is ancillary.
5. The Board finds that granting the Special Permit relief
to allow the existing dwelling to maintain its existing side yard
line, and to allow the shed to be relocated as shown upon the
plan will not be substantially more detrimental to the
neighborhood than the existing uses upon the Premises.
6. By a UNANIMOUS (5-0) vote, the Board votes to grant the
special permit relief requested to reduce the required 10 foot
side yard setback to 5 feet, and to allow for the shed relocation
as proposed.
