At a public hearing of the Nantucket Zoning Board of Appeals on Thursday, March 11, 2010, and Thursday June 10, 2010 at 1:00 P.M., at 2 Fairgrounds Road, Nantucket, Massachusetts, the Board made the following Decision on the Application in Zoning Board of Appeals File No. 010-10 of Char 1 es Ar akel i an, Trustee of the Ar akel i an Farri 1 y 11~nt uc lcet Real t y Trust, of 5 Driftwood Lane, Lynnfield, MA 01940. 2. Applicant is requesting Special Permit relief pursuant to Nantucket Zoning Bylaw Section 139-16.C.(2) (setback intrusion) in order to validate the location of a gunite pool that is sited as close as eight (8) feet from the rear yard setback in a zoning district that requires a ten (10) foot rear yard setback. In the alternative, the Applicant is requesting Variance relief pursuant to Nantucket Zoning Bylaw Section 139-32 (variances) from the setback regulations found in Nantucket Zoning Bylaw Section 139-16 (intensity regulations) to validate the location of the pool sited in the rear yard setback. The site is located at 11 Tetawkimmo Drive, is shown on Nantucket Tax Assessor's Map 53 as Parcel 34, is shown on Plan File 45-R, and title is recorded at the Nantucket County Registry of Deeds in Book 853, Page 33. The site is zoned Limited Use General - 3. 3. Our Decision is based upon the Application and accompanying materials, representations and testimony received at our public hearing. The Planning Board did not make a recommendation as this was not a matter of planning concern. No abutter comment was received either in favor of or against the Application. 4. Charles Arakelian represented himself and had Michael Touchette, the builder of the single family dwelling, present at the hearings. Mr. Arakelian explained to the Board that the error stemmed from the pool company improperly siting the pool by accidentally rotating it from the approved location. This, in turn, resulted in a corner of said pool to be sited within the rear yard setback. Accordingly, Mr. Arakelian informed the Board that he is requesting a Special Permit pursuant to Nantucket Zoning Bylaw Section 139-16.C.(2) to validate the gunite pool which is sited as close as 7.5 feet from the rear yard setback in a zoning district that requires a ten foot rear yard setback with a Special Permit. Mr. Arakelian submitted approved Building Department plans that illustrate the location of the pool being outside the ten foot rear yard setback. Accordingly, the Board determined that the error stemmed from the individuals siting the pool and that this was an unintentional error. 5. The Board finds that the burden of correcting the intrusion substantially outweighs any benefit to an abutter of eliminating the intrusion as no abutters have commented on the existence of the intrusion. Therefore, the Board finds that the issuance of a special permit to validate the location of the gunite pool under these circumstances is in harmony with the general purpose and intent of the Zoning Bylaw. 6. Accordingly, by a motion made and duly seconded to GRANT the requested relief by SPECIAL PERMIT pursuant to Nantucket Zoning Bylaw Section 139-16(C)(2) to validate the location of the gunite pool that is sited as close as 7.5 feet from the rear yard setback in a zoning district that requires a ten (10) foot side and rear yard setback with the condition that no further construction of structures, nor additions to the existing structure, shall take place within ten feet of the rear yard lot line without the issuance of further relief by the Board of Appeals, as shown on the plan entitled "Plan of Land in Nantucket, Mass', prepared by Hayes Engineering, Inc., dated March 25, 2010, and attached as Exhibit A, there were five (5) votes in favor and none (0) opposed.
