A copy of Special Permit No. 076-OS is attached hereto and incorporated herein as "Exhibit A" In 2005 Applicants applied for and received Special Permit No. 076-OS for the renovation and additional construction at 103 Orange Street, apre-existing, non-conforming residential tri-plex which stands in condominium ownership. The locus at 103 Orange Street is located in what is known as the Residential Old Historic ("ROH") zoning district where the requested/existing uses are allowed with the issuance of Special Permit from the ZBA. ROH zoning requires a minimum lot size of 5,000 sf, minimum frontage of fifty (50) feet, no minimum front setback and five (5) foot side and rear setbacks. A site plan showing the locus as approved with Special Permit No. 076-OS is attached hereto and incorporated herein as "Exhibit B". Applicants seek modification of Special Permit No. 076-OS Paragraph 7(e) to the extent that this paragraph allowed "stacked" and tandem parking for three (3) cars in the existing driveway at 103 Orange Street and Applicants now propose to provide a second driveway/parking area on the locus which would access the separate cottage unit off of Back Street. See proposed parking/driveway location at "Exhibit C". Applicants are currently pursuing a request with the Nantucket Planning Board simultaneously with this Application to allow for the second curb cut/driveway requested herein. Should that application be heard first, it will be contingent on this approval. Should this application be heard first it will be contingent on that approval. Applicants states that because the area on Back Street along Applicants' property line is a "no parking" yellow-lined area, no parking spaces will be lost as a result of the proposed second curb cut. Moreover, there are numerous areas on Back Street that allow on-street parking in the alternative. Applicants would comply with all standards associated with By-Law Ch. 139-20-1(B)(2) and have the DPW sign off on the driveway construction. Applicants states that allowing the second curb cut/driveway/parking area on the lot will not have a significant and/or adverse effect on the scenic or historic integrity of the neighborhood due to the numerous driveways on Back Street as well as Orange Street and is not contrary to sound traffic and safety considerations because Back Street is not a highly trafficked street. Moreover, a second driveway/parking area will relieve the unsightly appearance of multiple, stacked cars in the existing driveway on Orange Street as well as free up on-street parking for other residents of Nantucket as well as remedy some of the non-conformities and concerns associated with the existing parking plan as approved in Special Permit No. 076-05. At the public hearing of the .Nantucket Zoning Board of Appeals, on Friday, October 14, 2005, at 1:00 P.M., in the Conference Room in the Town Annex Building, 37 Washington Street, Nantucket, Massachusetts, the Board made the following Decision on the Application (076-05) of BETH N. BROOKS (OWNER OF UNTFS 1 AND 3); MARK H. SCHARWENKA AND ASHLEY H. BROOKS (OWNERS OF UNIT 2}, AND THE 103 ORANGE STREET CONDOb~ TRUST, of 6 Union Street, Nantucket, MA 02554, in connection with property known as 103 Orange Street, Nantucket, Massachusetts. 2. Applicants are seeking relief by SPEQAL PERMIT under Nantucket Zoning By-law Section 139-33A (alteration/expansion of a pre- existing, nonconforming use/structure}. Applicants propose to demolish and reconstruct two separate structures, one containing two dwelling units and one containing asingle-family dwelling unit due to a toxic mold situation affecting the structures. An existing shed would also be demolished and not replaced. The lot is conforming as to all dimensional zoning requirements and ground cover. The existing nonconforming setback intrusions would be eliminated when the structures are demolished and reconstructed and three parking spaces would be provided. There would continue to be three dwelling units on the property all held in condomixvium ownership. The lot is nonconforming as to use, having three dwelling units on one lot when a rnaximnm of two are allowed in this zoning district; and as to setbacks, with the sepazate cottage being sited as close as about zero feet from the northerly side yard lot line and as close as about 1.3 feet from the westerly rear yard lot line, and with the shed being sited as close as about 2.4 feet from the westerly rear yaxd lat line, in a district that requires a minimum side and reax yard setback of five feet. The Premises is located at 103 ORANGE STREET, Assessor's Map 55, Parce1426, Plan File 05-29. The property is zoned Residential-0ld--Historic. Historic. 3. Our Decision is based upon the Application and accompanying materials, and photographs, representations and testimony received at our public hearings, including an extensive report documenting the toxic mold infestation of the structures. The Planning Boazd made no recommendation finding that the Application did not present any issues of planning concern. One abutter spoke in favor of certain aspects of the project and expressed concern about the location of the parking area. -" 4. Applicants, through counsel, submitted two affidavits from a predecessor in title to the property as well as the immediate abutter to the west, to establish that the Premises was improved with three dwelling units, one struM~ure that contained two dwelling units and a separate single-family dwelling, that contained a total of six bedrooms prior to the 1972 enactment of the Zoning By-law. The previous owner stated that the main building consisted of a one bedroom unit on the first floor and a three bedroom unit on the second floor, with the cottage containing one bedroom. The neighbor stated that he had owned his property since 1966 and at that time there were there dwelling units on the locus. Both structures were clearly visible on 1938 and 1957 aerials in the town records in substantially the same locations as currently sited. The main structure and the lot are conforming in all respects to the dimensional requirements of the Zoning By-law. However, the cottage did not comply with the five-foot northerly side and westerly rear yard setback requirements. Applicants stated that there was space for the pazking of three cars on the northerly side of the main house, but those parking spaces did not conform with current dimensional requirements for parking. The use of the Premises for three dwelling units, the size of the parking area, and the smaller building's setback nonconformities therefore pre-dated the 1972 enactment of the Nantucket Zoning By-law and were validly grandfathered. 5. The Applicants stated that they proposed to demolish the existing buildings on the site and to construct slightly larger replacement structures containing three dwelling units and a total of six bedxoams, which replacement structures would comply with the current setback and ground cover requirements. Applicants stated that both structures were permeated with a form of mold that was toxic and had made simple renovation of the structures problematic if not impossible given the extent of the damage and the substantial danger to the health of those inhabiting the structures. Demolition was proposed as the best and most cost-effective way to ensure the eradication of the mold. Plans for the project had not yet been submitted to the Nantucket Historic District Commission, and therefore were not available for the Board to review. In keeping with the Applicants' proposal to demolish the existing structures and reconstruct and expand the dwelling units, the Applicants agreed that the combined ground cover of the two buildings would not exceed 2,000 squaze feet, and that the smaller single-family structure would be constructed on the southerly portion of the site (on the Back Street side of the property to the south 2 of the main structure) and limited to one and one-half stories in height, without further relief from this Board. The main building would continue to contain two separate dwelling units, each with two bedrooms and the separate cottage would contain two bedrooms, maintaining the current total of six bedrooms. o than e was proposed to the narking area, so it would remain adequate to pazk three cars (one stacked space and two in tandem formation} withnvt strict comvhance with the dimensional requirements of the current By-law and accessed from Orange Street. Applicants stated that the three units were held in condomnuum ownership and would remain so after reconstruction. 6. Therefore, based upon the foregoing, the Boazd finds that the demolition and reconstruction of three dwelling units would not constitute an abandonment of the nonconforming use of three dwelling units (also held in condominium ownership) and would not be substantially more detrimental to the neighborhood than the existing nonconformity. There are presently three dwelling units and there would remain three dwelling units upon reconstruction of two new structures, one cottage with one dwelling unit and one structure with two dwelling units. There would be a public benefit as the side and rear yard setback intrusion of the existing cottage would be eliminated and all pazking provided on site. 7. Accordingly, the Board of Appeals, by a UNANIMOUS vote, GR.AN'TS the requested SPECIAL PERMPI' under Nantucket Zoning By-law Section 139-33A to allow the demolition and reconstruction of two conforming structures, one containing one dwelling unit and one structure containing two dwelling units, upon the following conditions: (a) The total ground caner of the structures to be constructed on the property shall not exceed 2,000 squaze feet without further relief from this Board; (b) The cottage containing one dwelling unit shall be sited in the southerly portion of the lot (near Back Street), rather in its existing nonconforming location; (c) All new structures on the lot shall comply with setback requirements; (d) The cottage containing one dwelling unit shall be limited to one and one-half stories in height without further relief from this Board; {e) ee parking spaces shall be provided on site on the northerly s e of the main structure containing two dwelling units with cress to Orange Street ,with the Board's acknowledgment that the 3 ' existing spaces are non-conforming and do not meet the dimensional requirements and any reconfiguration of the parking spaces may be similarly sized; (f) There shall be no exterior construction allowed in connection with the work approved hereby between July 1 and September 1 of any given year.; and (g) each of the three units shall be limited to two bedrooms for a total of six bedrooms on the site. At a public hearing of the Nantucket Zoning Board of Appeals, on Thursday, March 11, 2010, at 1:00 P.M., in the Garage Area at 2 Fairgrounds Road, Nantucket, Massachusetts, the Board made the following decision on the application of BETH N. BROOKS, c/o Jamie Ranney, PC, 4 Thirty Acres Lane, Nantucket, MA 02554, File No. 007-10: 2. Applicant is requesting a modification of the Special Permit in ZBA Decision No. 076-05 in order to modify paragraph 7(e) of said decision. The Applicant proposes to provide a second driveway/parking area on the locus rather than continuing the allowed "stacked" and tandem parking for three (3) cars. The site is located at 103 Orange Street, is shown on Nantucket Tax Assessor's Map 55 as Parcel 426, is shown on Plane File No. 05- 29, and the master deed is recorded at the Nantucket County Registry of Deeds in Book 953, Page 225. The site is zoned Residential Old Historic. 3. Our decision is based upon the application and accompanying materials, and representations and testimony received from the applicant's attorney at our public hearing. The Planning Board recommendation was not of planning concern. There were no letters of support or in opposition to the application. 4. Applicant requests a modification to her existing Special Permit No. 076-05, dated October 26, 2005 and recorded in Book 991, Page 265 at the Nantucket Registry of Deeds in order to modify Paragraph 7(e) in said decision. Paragraph 7(e) allowed "stacked" and tandem parking for three (3) cars in the existing driveway at 103 Orange Street. The Applicant now proposes to provide a second driveway/parking area on the locus which would access the separate cottage unit off of Back Street. There will now be two (2) cars parked in the existing parking area and one (1) car parked in the new 10' by 20' parking area towards the south of the locus. The number of parking spaces will remain at three (3); but, now there will be two separate parking areas. Applicant, through counsel, represented that allowing this modification will not have a significant and/or adverse impact on the scenic or historic integrity of the neighborhood due to the numerous driveways on Back Street as well as Orange Street. Further, counsel for the Applicant stated that this modification to allow a second driveway/parking area will relieve the unsightly appearance of multiple, stacked cars in the existing driveway on Orange Street as well as free up on-street parking for other residents of Nantucket. Also, the proposed modification will remedy some of the nonconformities and concerns associated with the existing parking plan as approved in Special Permit No. 076-05. 5. The Board finds that granting the modification to Decision No. 076-05 to modify Paragraph 7(e) to the extent that it allowed "stacked" and tandem parking for three (3) cars in the existing driveway on 103 Orange Street and the Applicant proposes a second driveway on the locus is in harmony with the purpose and intent of the Zoning Bylaw and will not be substantially more detrimental to the neighborhood than the existing uses upon the Premises. 6. By a UNANIMOUS (4-0) vote, the Board votes to grant the requested modification to modify Paragraph 7(e) to the extent that it allowed "stacked" and tandem parking for three (3) cars in the existing driveway on 103 Orange Street and the Applicants propose to create a second driveway, thereby eliminating the need for three (3) cars to be parked in the northerly parking area; but, to have two (2) spaces available in the existing northerly parking area and one (1) conforming space in the southerly parking area on the locus in substantial conformity with the plan entitled "Building Location Plan for 103 Orange Street," prepared by Weller & Associates, dated December 29, 2009, and herein attached as "Exhibit A."
