Previous Zoning Board Application Nos.: 014-76
APPLICANT is seeking modification of that certain VARIANCE (Zoning Board of Appeals File No. 014-76)
recorded with the Nantucket Registry of Deeds in Book 154, Page 192, a copy of which is attached hereto.
Premises is 4 Newtown Road, shown as Lot 6B on plan field with the Nantucket Registry of Deeds in Plan Book
19, Page 128. Premises is undersized with respect to lot area as its area is 7,639, where the minimum lot size for
R-I0 is 10,000 square feet.
In accordance with said Variance, Katherine Terry subdivided Lot 6 as shown on plan filed with the said Registry
of Deeds in Plan Book 15, Page 56 into Lots 6A and 6B, Plan Book 19, page 128. The original lot was 20,944
square feet. The language of the decision states that one lot is to be 8,000 square feet, fronting 103 feet on
Newtown Road (Lot 6B) and one lot is to be 12,000 square feet, fronting 100 feet on Sparks Avenue (lot 6A).
Inasmuch as the original lot consisted of 20,944 square feet (944 square feet more than the aggregate lot sizes set
forth in the language of the decision), it is assumed that the lot sizes set forth in the decision were intended to be
approximate.
Lot 6B which fronts on Newtown Road 103.13 feet, contains 7,639 square feet, which is less than the 8,000
square feet set forth in the decision. Similarly, Lot 6A which fronts on Sparks Avenue 114.31, contains 13,155
square feet, which is more than the 12,000 square feet set forth in the decision, The dwelling on Lot 6A was
constructed prior to 1972 and since that time, only a permit for roof and sidewall shingling has been filed with the
Building Department. The dwelling on Lot 6B was constructed in 1977 (Building Permit No. 682-77) and a
certificate of occupancy was issued July 7, 1978 (Certificate of Occupancy No. 682-78). The dwelling on lot 6B
(the Premises) complies with the ground cover and set-back requirements ofR-10 and, with the exception of lot
size, is in compliance with current zoning.
Because the area of Lot 6B is less than 8,000 square feet, the Zoning Enforcement Officer is of the opinion that it
is necessary to have said Variance modified to clarify that the lots actually created by the subdivision for which
the variance was granted are deemed to comply with the provisions of said variance,
APPLICANT respectfully requests that Variance Decision No, 014-76 be modified as follows to reflect the
correct areas of the lots created as a result of the subdivision allowed by said Variance:
1. revise the language in paragraph 2 of said decision to read as follows: "The premises under
consideration may be divided into two lots as shown on Exhibit A attached hereto and incorporated
herein, without detriment to the area or surrounding neighborhood"; and
2. to attach as Exhibit A that certain Plan entitled "Land of Katherine V, Terry, July 6, 1976",
prepared by Josiah S, Barrett, Surveyor, dated July 6, 1976, and filed with the Nantucket Registry
of Deeds in Plan Book 19, Page 128.

1. At a public hearing of the Nantucket Zoning Board of Appeals on Thursday,
February 11,2010, at 1 :00 P.M., at 2 Fairgrounds Road, Nantucket, Massachusetts,
the Board made the following Decision on the Application in Zoning Board of
Appeals File No. 004-10 of Elizabeth Dasilva of6 Executive Drive, Mashpee, MA
02649.
2. Applicant is requesting a modification of the Variance in ZBA Decision No. 014-
76. There is no site plan attached to said decision - only a reference that the newly
created undersized lot will be 8,000 square feet. The actual size of the lot is 7,639
square feet and, accordingly, the Applicant would like this discrepancy clarified in the
decision. The site is located at 4 Newtown Road, is shown on Nantucket Tax
Assessor's Map 55 as Parce1302, is shown as Lot 6B in Plan Book 19, Page 128, and
title is recorded at the Nantucket County Registry of Deeds in Book 1039, Page 282.
The site is zoned Residential- 10.
3, Our Decision is based upon the Application and accompanying materials,
representations and testimony received at our public hearing. The Planning Board
recommended that the board grant the requested relief. No abutter comment was
received either in favor of or against the Application.
4, At the hearing, the Applicant was represented by counseL Counsel for the
Applicant stated that the Applicant is requesting a modification in order to validate
the actual size of the lot in question. In 1976 the owner received a variance in order
to create an undersized buildable lot of 8,000 square feet. Unfortunately, no survey
was ever prepared for the application and the actual size of the undersized lot is about
7,639.
Because the area of Lot in question is less than the 8,000 square feet permitted in the
decision, the Zoning Enforcement Officer has advised the owner that a modification
of the variance is necessary to confirm that the subdivision resulting from the
variance is in compliance with the variance Decision.
To that end, Applicant requests that Variance Decision No. 014-76 be modified as
follows:
. The language in paragraph 2 of said decision be revised to read as follows:
"The premises under consideration may be divided into two lots as shown
on Exhibit A attached hereto and incorporated herein, without detriment to
the area or surrounding neighborhood"; and
. Attach as "Exhibit A" that certain Plan entitled "Land of Katherine V.
Terry, July 6, 1976", prepared by Josiah S. Barrett, Surveyor, dated July 6,
1976, and filed with the Nantucket Registry of Deeds in Plan Book 19,
Page 128.
5. Accordingly, by a UNANIMOUS vote, the board votes to approve the requested
modification to Decision No. 014-76, Revise the language in paragraph 2 of said
decision to read as follows: "The premises under consideration may be divided into
two lots as shown on Exhibit A attached hereto and incorporated herein, without
detriment to the area or surrounding neighborhood" and to attach as Exhibit A that
certain Plan entitled "Land of Katherine V. Terry, July 6, 1976", prepared by Josiah
S. Barrett, Surveyor, dated July 6, 1976, and filed with the Nantucket Registry of
Deeds in Plan Book 19, Page 128.
