Oberting, requests a Special Permit pursuant to Sections 139-30A and 139-16(C)(2) of the Nantucket Zoning By-law for his property located at 38 Wanoma Way, Nantucket, MA 02554, ("hereinafter the Property"). The Property is shown as Lot 124 on Land Court Plan 5004-0, Sheet 5, filed with Certificate of Title No. 791 at the Nantucket Registry District of the Land Court, being a subdivision plan on a plan entitled "Plan of Tom Nevers Tract, Section A, Nantucket, Mass., owned by Nantucket Land Trust, June, 1916, H.A. Millhouse, C.E.," filed at the Land Registration Office, Boston, July 7, 1916. The Property is located in the Limited Use General - 3 (LUG-3) zoning district. The current rear yard setback requirement in the LUG-3 zoning district is twenty (20') feet (ten (10') feet for Lots of Record). The Property is a lot of record as evidenced by the above-referenced registered Plans dated 1916. There is currently one (1) single family dwelling on the Property. The door on the exterior northerly elevation of the dwelling has two (2) wooden steps directly adjacent to the door. As shown on the As- Built Plot Plan prepared by Nantucket Surveyors, Inc., dated May 8, 1997, a copy of which is attached as Exhibit "A", the steps are currently located 7.2 feet from the northerly rear yard lot line. Accordingly, the steps intrude into the rear yard setback by 2.8 feet. The Applicants purchased the Property from Edwin W. Obrecht, Jr. and Anne S. Obrecht on May 23, 1997. The Nantucket Building Department issued the Obrecht's predecessor in title, Thomas J. Albani, a Building Permit for the dwelling, No. 2848-83, on June 10, 1983, and a corresponding Certificate of Occupancy, No. 2848-85, issued for this Permit on July 10, 1985. The architectural plans for this work, attached hereto as Exhibit "B", which were submitted to the Building Department as part of the Albani application process, show the two (2) wooden steps on the northerly elevation of the dwelling in their current location and configuration. Accordingly, the structure on the Property and specifically the two (2) wooden steps at issue have existed in their current location and configuration since at least July 10, 1985. See Affidavit of Thomas J. Albani, attached hereto as Exhibit "C". Section 139( 16)(C)(2) of the Zoning By-Law provides that: The Board of Appeals may grant a special permit to validate unintentional setback intrusions not greater that five feet into a required yard and not closer than four feet from a lot line, provided that it shall first find that the burden of correcting the intrusion substantially outweighs any benefit to an abutter of eliminating the intrusion. . . The Applicants are seeking a Special Permit pursuant to section 139-16(C)(2) to validate the minor setback intrusion. The steps only invade into the rear yard set back by 2.8 feet. The steps are no closer than 7.2 feet to the lot line. The steps have been in 1 their current location and configuration for over twenty five (25) y~ars. See Exhibit "C". Additionally, the burden of correcting the intrusion substantially outweighs any benefit to abutters. Alternatively, and to the extent the Board deems it necessary, the Applicants request a Variance pursuant to Section 139-32 to validate the location of the wooden steps within the 10' rear yard setback due to the shape ano tppograhphy of the lot and the structures thereon such that the literal enforcement of the 10' rear yard setback would involve a substantial hardship to the Applicants to remove the door and steps thereto and because granting this relief does not involve substantial detriment to the public good or a derogation of the intent of the By-law. At a public hearing of the Nantucket Zoning Board of Appeals on Thursday, February 11, 2010, at 1:00 P.M., at 2 Fairgrounds Road, Nantucket, Massachusetts, the Board made the following Decision on the Application in Zoning Board of Appeals File No. 006-10 of Gary C. Oberting, c/o Vaughan, Dale, Hunter, Stetina, and Beaudette, P.c., PO Box 659, Whaler's Lane, Nantucket, MA 02554. 2. Applicant is requesting Special Permit relief pursuant to Nantucket Zoning Bylaw Section 139-16.C.(2) (setback intrusion) in order to validate wooden steps constructed with the dwelling in 1983 that are sited as close as 7.2 feet from the rear yard setback in a zoning district that requires a ten (10) foot side and rear yard setback. In the alternative, the Applicant is requesting Variance relief pursuant to Nantucket Zoning Bylaw Section 139-32 (variances) from the setback regulations found in Nantucket Zoning Bylaw Section 139-16 (intensity regulations) to validate the location of the steps sited in the rear yard setback. The site is located at 38 Wanoma Avenue, is shown on Nantucket Tax Assessor's Map 92.4 as Parcel 236, is shown as Lot 124 on Land Court Plan 5004- D, Sheet 5, and is registered as Certificate of Title No. 13420 in the Nantucket County Registry District of the Land Court. The site is zoned Limited Use General - 3. 3. Our Decision is based upon the Application and accompanying materials, representations and testimony received at our public hearing. The Planning Board did not make a recommendation as this was not a matter of planning concern. No abutter comment was received either in favor of or against the Application. 4. 4. Attorney Lori D'Elia represented the Applicants at the hearing. Attorney D'Elia informed the Board that they are requesting a Special Permit pursuant to Nantucket Zoning Bylaw Section 139-16.C.(2) to validate wooden steps constructed with the dwelling in 1983 that are sited as close as 7.2 feet from the northerly rear yard setback in a zoning district that requires a ten (10) foot side and rear yard setback. While the side and rear yard setbacks in the Limited Use General- 3 zoning district are usually twenty (20) feet, the locus is a Lot of Record, and, therefore, the locus is benefited from having a ten (10) foot side and rear yard setback. Attorney D'Elia informed the Board that on June 10, 1983, the Building Department issued a Building Permit, No. 2848-83, for the dwelling. On July 10, 1985, a corresponding Certificate of Occupancy, No. 2848- 85, was duly issued for this Permit. Additionally, the Building Department file contains an As Built Plot Plan entitled "Mortgage Inspection Plan in Nantucket, MAli, prepared by Nantucket Surveyors, Inc., dated May 8, 1997, which shows the steps in their current location and configuration. Accordingly, the board determined that the steps existed in their current location and configuration since at least May 8, 1997. 5. The Board finds that the burden of correcting the intrusion substantially outweighs any benefit to an abutter of eliminating the intrusion as the intrusion has been in existence for at least thirteen years and no abutters have commented on the existence of the intrusion. Therefore, the Board finds that the issuance of a special permit to validate the location of the wooden steps under these circumstances is in harmony with the general purpose and intent of the Zoning Bylaw. 6. Accordingly, by a motion made and duly seconded to GRANT the requested relief by SPECIAL PERMIT pursuant to Nantucket Zoning Bylaw Section 139-16(C)(2) to validate wooden steps constructed with the dwelling in 1983 that are sited as close as 7.2 feet from the rear yard setback in a zoning district that requires a ten (10) foot side and rear yard setback with the condition that no further construction of structures, nor additions to the existing structure, shall take place within ten feet of the rear yard lot line without the issuance of further relief by the Board of Appeals, as shown on the plan entitled "Mortgage Inspection Plan in Nantucket, MAli, prepared by Nantucket Surveyors, Inc. dated May 8, 1997, and attached as Exhibit A, there were five (5) votes in favor and none (0) opposed.
