DECISION:
At a meeting of the BOARD OF APPEALS held at 1:30 p.m.,
Friday, May 4, 1984, in the Town and County Building,
Nantucket, in the matter of the Application of Charlotte
Appleton (023-84), the Board finds:
1. This is an Application for a SPECIAL PERMIT granting
relief under Section 4(c)(2)(c)(7) of the Zoning By-Law (Garages
for Storage, Repairs and Servicing Motor Vehicles). If granted,
the Applicant will be permitted to erect and operate a car
wash facility on premises located on Sparks Avenue, Nantucket,
now owned by Alfred F. Sanford, III, and Edward J. Sanford,
Trustees of Lower Pleasant Trust (Certificate of Title No.
8118), zoned as RESIDENTIAL COMMERCIAL (Assessor's Parcel
55-267).
2. Based upon a review of the Application, supporting
documents, plans, testimony, viewing of the site, and a
favorable recommendation by the Planning Board, this Board
finds that the use of the premises for a car wash facility
as proposed would be in harmony with the general purpose
anal interest of the Zoning By-Law. The Board also specifi-
cally finds that the proposed use will not be in violation
of Section 6(D) of the By-Law (Prohibited Uses-All Districts).
3. The Board also finds that the operation of such
premises should be conditioned upon strict compliance with
all architectural and landscaping requirements lawfully imposed
by the appropriate bodies of the Town of Nantucket and with
all legal requirements for the safe discharge or removal
of water and chemical or other effluents.
4. For the reasons and upon the conditions set forth,
the BOARD hereby GRANTS the Applicant relief under Section
4(c)(2)(c)(7) of the Zoning By-Law by SPECIAL PERMIT, by
UNANIMOUS VOTE.
