DECISION:
At a Meeting of the BOARD OF APPEALS held ozi Friday,
March 23, 1984 in the Town and County Building, in the matter
of the Application of STEVEN J. AND MARSHA A.. KUTOLAC on behalf
of their Lessee, CHARLES DAVIS (020-84), the BOARD .finds:
1. This is an Appli~atian for a SPECIAL PF.F.MIT under
SECTION ~ (E) (2) (e) of the Zon.inc~ By-Law. 'Phat Section allows
restaura:~t:: ~.n limited comm`rcial. Districts but only upon
issu~Ance ~= ~x SPECIAi, PERMIT. If granted, tre Applicant would
be allatti*ed tr have a take-out food restaurant at premises at the
corner :~ ` EF.: TC~N AND 230R'"H BELCH STREETS which is zoned LIMITED
r O ~`."~ E RC I t'1L .
2. The Applicant currently operates a hairdressing
shop in one part of the buildina~ which would be affected by this
Application. The Applicant also has parking space behind the
building. The BOARD at the Hea.s•ing was concerned over the
possible traffic hazard, litter. a.nd effect on the residential
Brant Point area if this Application were to be granted. The
BOARD also found this Application to be essentially similar to
that of Mr. Arno for a similar premises two buildings removed
from this Applicant's location. This BOARD denied Mr. Arno's
Application.
3. Based upon a review of the Application, supporting
documents, knowledge of the site: and testimony at the Public
Hearing, the BOARD finds that t:he proposed takeout food rest-
aurant would not be in harmony with the general purpose and intent
u£ ziae ~vi':iriy By-Law.
4. For the reasons set forth, the BOARD DENIES this
Applicant a SPECIAL PERMIT under SECTION 4(E)(2)(e) of the
Zoning By-Law, by UNANIMOUS vote.
