At a meeting of the BOARD OF APPEALS held at 1:30 p.m., Friday, April 27,
1984, in the Town and County Building, Nantucket, in the matter of the
Application of ROBERT F. MOONEY (0l7-84), the BOARD finds:
1. This is an Application for a Variance from Section 6(B) of the Zoning By-
Law (Off-Street Parking Requirements), seeking relief in order to operate a
year-round muffin shop, seasonal clam bar, and daytime restaurant, not to
exceed thirty (30) seats. The premises are located on Commercial Wharf in a
Residential/Commercial district.
2. Based upon review of the Application, supporting documents, testimony at
Public Hearing, and submitted plans, the BOARD finds that the subject pro-
perty includes a 10-foot wide easement that deprives the owner of space for
off-street parking, that the locus abuts property owned by the Electric Company,
and is effectively limited to commercial use, that the proposed muffin shop will
involve no exterior expansion of the building, that it is physically impossible
to meet the off-street parking requirements of the Zoning By-Law, that the
subject area is traversed primarily by pedestrian and bicycle traffic and that
the proposed muffin shop will provide a needed service to guest house tourists
and tourists in the boat basin. Moreover, a waiver of off-street parking
requirements will not cause a substantial detriment to the neighborhood and
imposition of off-street parking requirements will cause a substantial hardship
to the Applicant.
3. The BOARD further finds that the Applicant's tot is subject to circumstances
relating to its shape, size, topography, and encumbrances especially affecting
such land but not affecting generally the zoning district in which it is located,
a literal enforcement of the provisions of this By-Law would involve substantial
detriment to the public good and without nullifying or substantially derogating
from the intent or purposes of the By-Law. This Application, having been
filed before the latest amendment to the By-Law, the Applicant need not pay
any additional fee for this relief.

4. For the reasons set forth, the BOARD hereby GRANTS the Applicant a
VARIANCE from SECTION 6(B), Off-Street Parking Requirements, on the
express condition that the seating capacity of the muffin shop not exceed
thirty (30) seats, that the muffin shop operate only between the hours of
6:00 a.m: and 8:00 p.m. on a year-round basis, and that the Applicant
provide adequate parking at the subject property for bicycles and mopeds,
by UNANIMOUS VOTE.
