I, CARA NIELSEN, formerly known as CARA STEIN, of
Nantucket, Ma., for and in consideration for One Hundred
($100.00) Dollars, grant to
CARA NIELSEN and TUE NIELSEN, husband and wife as
tenants by the entirety, of 29D South Shore Road, Nantucket, Ma.
with QUITCLAIM COVENANTS the following property:
Unit 4 (the "Unit") of the Cottage in the Pines Condominium (the
"Condominium") located at 29D South Shore Road, Nantucket,
Massachusetts, created pursuant to Massachusetts General
Laws, Chapter 183A by Master Deed February 14,1995 and
recorded with Nantucket Registry of Deeds at Book 466, Page 49
(the "Master Deed") together with an undivided 230/0 in both the
common areas and facilities of the Condominium and in the
Cottage in the Pines Condominium Trust (the "Trust") dated
February 14, 1995 and recorded in Book 466, Page 59.
The Unit is conveyed subject to and with the benefit of all matters
set forth in the .Master Deed and Trust, other matters of record
and all matters set forth in the deed into the Grantor herein
recorded at Book 1075, Page 307, the entire contents of which
are incorporated herein by refere:1ce.

DECISION:
1. At a public hearing of the Nantucket Zoning Board of Appeals on
Thursday, January 14, 2010, at 1:00 P.M., at 2 Fairgrounds Road, Nantucket,
Massachusetts, the Board made the following Decision on the Application in
Zoning Board of Appeals File No. 001-10 of Cara Nielsen and Tue Nielsen of
Unit 4 of the Cottage in the Pines Condominium, located at 29D South Shore
Road, Nantucket, MA 02554.
2. Applicant is requesting Special Permit relief pursuant to Nantucket
Zoning Bylaw Section 139-33.A.(4) in order to increase the ground cover of their
pre-existing, nonconforming structure. In the alternative, the Applicant is
requesting Variance relief pursuant to Nantucket Zoning Bylaw Section 139-32
(variances) from the provisions of Nantucket Zoning Bylaw Section 139-16
(ground cover). The Applicant proposes to increase the size of their dwelling
from 370 square feet to 858 square feet giving their lot 5.1 % ground cover in a
zoning district that has a maximum ground cover ratio of 4 %. The site is located
at 29D South Shore Road, is shown on Nantucket Tax Assessor's Map 80 as
Parcel 296.4, is shown in Plan Book 25, Page 87, and is recorded at the Nantucket
County Registry of Deeds in Book 1095, Page 125. The site is zoned Limited Use
General - 2.
3. Our Decision is based upon the Application and accompanying
materials, representations and testimony received at our public hearing. The
Planning Board recommended that the board grant the requested relief. No
abutter comment was received either in favor of or against the Application.
4. At the hearing, the Applicants represented themselves and stated that
they are requesting Special Permit relief pursuant to Nantucket Zoning Bylaw
Section 139-33.A.(4) in order to increase the ground cover on their lot.
The structure in question is a condominium on South Shore Road. Each Unit is
over the allowable ground cover (the last page in this application packet states
the various ground covers for the Units). The Unit in question, Unit 4, presently
has an existing ground cover of 370 square feet, with a ground cover ratio of 2%.
However, with the deck, the ground cover would be 786 square feet and have a
ground cover ratio of 4.6%.
The Applicants are requesting to renovate their existing structure so that Unit 4
will now have a ground cover of 858 and a ground cover ratio of 5.1 %. The
proposed ground cover ratio is lower than all of the other Units.
5. Based on the foregoing, the Board finds that increasing the allowable
ground cover to a total of 858 square feet for Unit D would be in harmony with
the purpose and intent of the Bylaw and would not be substantially more
detrimental to the neighborhood than the existing nonconformity because the
other Units are over the allowable ground cover as well.
6. Accordingly, by a motion made and duly seconded to GRANT the
requested relief by SPECIAL PERMIT pursuant to Nantucket Zoning Bylaw
Section 139-33.A.(4) to increase the allowable ground cover to a total of 858
square feet for Unit D with the condition that the existing structure is moved out
of the setback and all setbacks are met there were four (4) votes in favor and
none (0) opposed.
