At a Meeting of the BOARD OF APPEALS held on Friday,
March 23, 1984 in the Town and County Building in the matter of
the Application of JOSEPH ARNO (014-84), the BOARD finds:
1. This is an Application for relief by SPECIAL PERMIT
from the parking requirements of SECTION 6(B) of the Zoning By-
Law. If granted, the Applicant would be permitted to expand the
seating capacity of his restaurant by the addition of a second
floor dining area. The premises is located at 41 MAIN STREET
and is zoned, RESIDENTIAL-COMMERCIAL.
2. The Applicant presently operates a popular rest-
aurant on the premises. The meals served by the Applicant are
moderately priced and it has not been disputed that the clientelle
of the restaurant are primarily day visitors to the Island and
residents of guest houses and hotels. Such clientelle does not
characteristically bring a motor vehicle on the Island nor impose
a burden upon the limited parking available. Apparently, few
diners drive to the restaurant.
3. Based upon a review of the Application, supporting
documents and plans, knowledge of the site and testimony at the
Public Hearing, the BOARD finds that the proposed enlargement of
the restaurant would not be substantially more detrimental than
the existing use to the neighborhood.
4. For the reasons set forth, the BOARD hereby GRANTS
the Applicant relief by SPECIAL PERMIT from the parking require-
ments of SECTION 6(B) of the Zoning By-Law, by UNANIMOUS vote.
