In a Meeting of the BOARD OF APPEALS held on Friday,
March 23, 1984 in the Tawn and County Building in the Matter of
the Application of BEATRICE LOVELL (012-84) fhe BOARD finds:
1. This is an Application for relief under SECTION 7(I)
(extension of a pre-existing non-conforming use) of the Zoning By-
Law. If granted, the Applicant would be permitted to slightly
expand her guest house so as to create an owner's bedroom separate
from the remainder of the guest house. This would entail the re-
moval of some existing ground cover and the addition of new ground
cover, the net addition being 223 square feet. There would be no
increase in the number of bedrooms available for rental. At
present, the building occupies 42$ of the lot; afterwards it would
occupy 47g of the lot. As the lot is 4450sq~uare feet in a 5000
square foot area, it is non-conforming and restricted to a 30~
ground cover. The property is located at 49 Centre Street and is
zoned Residential Old Historic.
2. Based upon a review of the application, supporting
documents and plans, and testimony at the Hearing, a motion was
made that the Applicant be granted the relief she sought. One
member of the BOARD voted in favor of this motion.. Because a
unanimous vote of the three members is required to grant a
Special Permit this Application was DENIED.

I voted in favor of this motion. The relief sought is
of a type customarily granted with little hesitation by this BOARD.
Although the Applicant would be increasing a pre-existing non-
conformity, this BOARD routinely allows such increases by the
addition of wings to houses, etc., especially in the Residential
Old Historic District where there is hardly a house, I should think,
which is not non-conforming. Be that as it may, the test that
should have been applied for this Application was whether the sought-
after relief would be substantially more detrimental to the neighbor-•
homed than the pre-existing non-conforming use. It is inconceivable
to me that this minor addition to the house (which would, I think,
visually improve it) could be considered "substantially more
detrimental". The only rationale I can find for this decision which
seems to me to be both arbitrary and capricious. is that the other
members of this BOARD were swayed by the vehement oratory of a
local attorney and his attacks upon the Applicant and your Chairman.
