Leddy Jr., Chairman BOARD OF APPEALS TOWN OF NANTUCKET BOARD OF APPEALS NANTUCKET, l~~ASSACHUSETTS 02554 March t~' , 1984 DECISION: At a Meeting of the BOARD OF APPEALS held on Friday, March 16, 1984 in the Town and County Building in the matter of the Application of MURRAY REAL ESTATE(Philip C. Murray and Elizabeth C.. Murray)(009-84), the BOARD finds: 1. This is an Application for relief by SPECIAL PERMIT under the provisions of Section 7(I)(expansion of a pre-existing non-conforming use) and Section 6(B)(parking requirements) of the Zoning By-Law. If granted, the Applicant would be permitted to ex- pand retail sales and storage area by excavation of a basement under existing premises. There is also insufficient lot area to provide the parking required under Section 6(B) and relief from those re- quirements may be granted in the original Old and Historic District by SPECIAL PERMIT. 2. Based upon a review of the Application, supporting doc- uments and plans, testimony at the Hearing and the favorable recommendation of the Planning Board, the BOARD finds that the proposed expansion and a waiver of the parking requirements would not be substantially more detrimental than the existing use to the neighborhood and would be in harmony with the general purpose and intent of the By-Law. 3. For the reasons set forth, the BOARD hereby GRANTS the Applicant the requested relief by SPECIAL PERMIT under Section 7(I) and Section 6(B) of the Zoning By-Law, by UNANIMOUS vote.
